Teachers Could Carry Firearms Under Proposed Legislation Set for Tennessee Senate Vote

Tennessee teachers could soon be allowed to carry firearms while on school property. The State Senate is poised to vote on legislation allowing faculty and staff to carry concealed weapons if they are licensed, trained, and undergo a psychiatric evaluation.

The Senate Judiciary Committee voted on Tuesday to advance SB 1325, which would authorize school faculty or staff members “to carry a concealed handgun on school grounds subject to certain conditions, including obtaining an enhanced handgun carry permit and completing annual training.”

Bills Would Let Some Tennessee Gun Owners Carry in Restricted Areas, Strip Ability to Restrict Firearms in Buildings and Private Property

Tennessee State Representative Jody Barrett (R-Dickson) filed a bill last week that will allow Tennessee gun owners with an enhanced handgun carry permit to bring their firearm into buildings that otherwise prohibit or restrict carrying weapons.

A second bill filed by Barrett, which would prevent individuals, businesses, or governments in Tennessee from prohibiting firearms, is scheduled to be heard this week.

State Senator to Reintroduce Pennsylvania Constitutional-Carry Bill

Pennsylvania state Senator Cris Dush (R-Bellefonte) is asking colleagues to cosponsor legislation to let law-abiding state residents carry concealed firearms without a permit, something he tried but failed to get enacted last session. 

The senator’s original bill passed the General Assembly in autumn of 2021 but Governor Tom Wolf (D) vetoed it. Its chances of becoming law have diminished even further insofar as Democratic Attorney General Josh Shapiro recently was elected in November to succeed Wolf and Democrats won a majority of seats in the state House of Representatives.

The Republican Party struggled with young voters ages 18-29 in the 2022 midterm election, largely due to issues such as abortion, gun rights, and climate change, according to an analysis from Look Ahead Strategies. 

CNN found that House Democratic candidates “won voters under 30 by 28 points,” which was a two-point increase over the 2020 election data for that age group.

The FBI Secretly Pressured Americans to Waive Away Their Gun Rights

The FBI secretly pressured Americans into signing forms that relinquish their rights to own, purchase or even use firearms, according to a trove of internal documents and communications obtained by the Daily Caller News Foundation.

The forms were presented by the FBI to people at their homes and in other undisclosed locations, according to bureau documents unearthed through the Freedom of Information Act by the firearm rights group Gun Owners of America (GOA) and shared with the DCNF. At least 15 people between 2016 and 2019 signed the secret forms, which ask signatories to declare themselves as either a “danger” to themselves or others or lacking “mental capacity adequately to contract or manage” their lives.

Pennsylvania Bill Would Raise Firearm Purchasing Age to 21

State Rep. Darisha Parker (D-PA-Philadelphia) this week began asking fellow lawmakers to cosponsor a bill to raise the minimum firearm purchase and possession age in Pennsylvania from 18 to 21. 

The freshman representative cited data from the San Francisco-based Giffords Law Center to Prevent Gun Violence indicating that U.S. residents ages 18 to 20 account for 17 percent of confirmed murderers despite being only four percent of the population. She also noted that those ages 14 to 21 have the highest propensity toward suicide or attempted suicide among all Americans.

Jake Evans, the Trump-endorsed candidate in the Republican primary runoff election for Georgia’s 6th Congressional District, criticized his opponent Rich McCormick’s stance on the 2nd amendment on The John Fredericks Show on Tuesday.

“[McCormick] is backed by special interest groups. AMA is one of them, the American Medical Association. If you look at their website they are clear. They are a liberal organization. Make no bones about it,” Evans said.

Abrams Says Kemp Signed ‘Criminal Carry’ Bill into Law

Democrat gubernatorial candidate Stacey Abrams in a Friday post accused her incumbent opponent of signing a bill into law that does not appear to exist.

“Our children across Georgia are bearing the heartbreaking consequences of gun violence. Instead of addressing the crisis, Brian Kemp signed criminal carry legislation that will put more guns on our streets and make our communities less safe,” said Abrams on Twitter.

Biden Administration Collecting Information on Millions of American Gun Owners

In just one year, the Biden Administration has collected records of over 54 million legal gun-owners in the United States, for the purpose of increased surveillance of such citizens by the federal government, according to the Washington Free Beacon.

As shown in internal documents from the Bureau of Alcohol, Tobacco, and Firearms (ATF), the ATF processed approximately 54.7 million records in fiscal year 2021. These documents were obtained by the gun rights advocacy group Gun Owners of America (GOA). The records in question are “out-of-business” documents, which consist of all firearms-related transactions made by a particular gun store after the store has gone out of business, at which point those records become property of the ATF.

In the year 2021, the ATF used this method to collect 53.8 million paper records, and roughly 887,000 electronic records. Gun stores are currently allowed to destroy records that are 20 years old or older; the Biden Administration is actively pursuing avenues to ensure that such records are made permanent and cannot be destroyed.

Biden, Congress Seek to Chip Away at Gun Rights with United Nations Arms Treaty, Military Red Flag Law

Congressional Democrats and the Biden administration are attempting to nibble away at the Second Amendment from both within and without the U.S., gun rights advocates warn, as Congress seeks to pass a red flag law for military members and the president eyes signing on to a United Nations arms treaty.

Red flag laws that would apply to military members were slipped into the National Defense Authorization Act (NDAA) passed by the House of Representatives last week with the help of 135 Republicans.

Red flag laws are “essentially bypassing due process,” Gun Owners of America’s Director of Outreach Antonia Okafor told the John Solomon Reports podcast on Wednesday. “It is going from one person who says they accuse you of being a danger to yourself, or to somebody else, and then going to a judge that then gets reasonable suspicion, right, that you are a danger to yourself or somebody else.”

Florida Supreme Court to Hear Contentious Gun-Rights Case

The Florida Supreme Court is taking up a gun-rights case related to a 2011 state law which implements penalties on local governments if they pass stricter gun-control laws.

Florida Agriculture Commissioner Nikki Fried and a group of municipal governments brought the case to Florida’s high court. Before Fried was elected in November 2018, a coalition of local officials filed suit against the law after the February 2018 school shooting at Marjory Stoneman Douglas High School.

Petition Urges North Dakota County to Ban Sanctuary Cities, Illegal Immigrants, and Refugees

A petition urging officials in a North Dakota county to ban sanctuary cities, illegal immigrants, and refugees gained around 5,000 signatures as of Tuesday, the Minot Daily News reported.

The Ward County Commission said they would uphold laws prohibiting illegal immigration and those supporting Second Amendment rights, though they asked petitioners to provide more specific language to be considered, according to the Minot Daily News. The petition asked the commission to ban illegal immigration and refugees from the county and to establish the region as a “gun sanctuary.”

Residents in Ward County started the petition “to ban sanctuary cities, illegal immigrants, aliens, refugees in Ward County, North Dakota, and add Ward County, North Dakota, as a Second Amendment gun sanctuary county,” the Minot Daily News reported.

Tucson Pledges Allegiance to Biden Administration on Gun Regulation, Snubs Arizona’s New Second Amendment Protection Law

Tucson will side with the federal government over state law when it comes to gun regulations, according to its city council’s latest resolution. 

According to the resolution, passed last Tuesday, states don’t have the right to reject federal law. The city council directed the city manager to continue using city personnel and financial resources to carry out any federal actions or programs regulating guns. It also directed the city attorney to engage in litigation concerning Second Amendment sanctuary laws or proclamations.

Record High 300,000 Gun Sales Blocked by Background Checks in 2020

The U.S. background check system prevented over 300,000 gun sales in 2020, a record high, the Associated Press reported Tuesday.

Background checks blocked almost double the number of sales in 2020 compared to the year before, with 42% of rejections due to felony convictions, according to FBI data obtained by the AP. The data also shows that the rate of barred would-be gun owners increased from 0.6% to 0.8% over the past two years.

The rate increase could be because a number of people buying guns for the first time did not realize they were unable to purchase a gun, Adam Winkler, a UCLA Law professor specializing in gun policy, told the AP. “Some may have a felony conviction on their record and not think about it,” he said.

Court Backs Concealed Weapons Applicant over Florida Dept. of Agriculture

The 1st District Court of Appeals has ruled Nikki Fried’s Florida Department of Agriculture and Consumer Services improperly denied a concealed weapons license to a man who was previously convicted in 1969 in Illinois.

The man, only identified as R.C., said his rights were restored in 1971, two years after his conviction for stealing an eight-track tape player, and even was approved for a concealed weapons license in Illinois before moving to Florida.

Gov. Lee’s Signature Makes Tennessee a Second Amendment Sanctuary

Tennessee Gov. Bill Lee signed a bill Wednesday that makes the state a Second Amendment sanctuary.

Senate Bill 1335 prevents any “law, treaty, executive order, rule, or regulation of the United States government” that violates the Tennessee Constitution or the Second Amendment of the U.S. Constitution from being enforced in the state.

That violation would have to be determined by either the Tennessee or U.S. Supreme Court. The stipulation was added during debate of the bill in the Tennessee House, and the Senate concurred.

Supreme Court Unanimously Rules Against Warrantless Gun Seizures

On Monday, in a rare unanimous decision, the Supreme Court of the United States ruled against the Biden Administration in a case regarding the legality of warrantless searches and seizures of firearms, The Epoch Times reports.

The case, Caniglia v. Strom, began oral arguments roughly two months ago. The case stems from an incident in Cranston, Rhode Island, back in August of 2015, where a man named Edward Caniglia had an argument with his wife of 22 years. Eventually, Caniglia withdrew an unloaded gun and suggested that his wife shoot him and “get me out of my misery.” His wife then called the police asking them to carry out a welfare check, where Caniglia was taken to the hospital.

Despite the police’s assurance that his guns would not be confiscated, they ultimately did seize his firearms without a warrant after he had been hospitalized, and refused to return them to him after he was discharged. Caniglia subsequently sued, claiming that the exception for community caretaking, which is what the police claimed to have used in this case, should not apply inside his home.

Tennessee House Passes Second Amendment Sanctuary Act

The Tennessee House passed the “Second Amendment Sanctuary Act,” asserting the state can ignore unconstitutional federal gun rules and regulations. The act would also punish any official who violates this legislation by removing them from their position.

The act reasserts that Tennessee doesn’t have to enforce any federal law, treaty, order, rule, or regulation that the United States Supreme Court (SCOTUS) or the Tennessee Supreme Court has ruled unconstitutional. The Second Amendment Sanctuary Act passed 74 to 13, with just one Democrat voting for it – State Representative Antonio Parkinson (D-Memphis). Last week, it passed in the Senate along party lines, 24 to 4 with two abstaining their votes.

Blacksburg Council Considering Ordinance to Ban Carrying of Firearms in Certain Locations

The Blacksburg Town Council will consider passing a proposed ordinance that bans the carrying of firearms on town property as well as in public spaces when being used for or next to a permitted event.

Localities in the Commonwealth are now allowed to take such action after the General Assembly passed legislation during the 2020 regular session last spring and took effect in July.

The legislative counsel for the Gun Owners of America, one of the country’s largest pro-gun advocacy organizations, said Barrett appears to be a strict constitutionalist. He also pointed to a dissenting opinion the judge wrote in 2019 in which she wrote in favor of a non-violent felon seeking to restore his firearms rights.

Virginia Blocked Over 1,000 Handgun Purchases During First Month of One-Pistol-per-Month Regulation

A total of 1,102 people were denied handguns in Virginia in July, following the implementation of a new law that prohibits more than one pistol purchase per 30 days.

Roughly 59% of Virginia’s 1,877 total firearm denials were attributed to confusion about exactly when the first 30-day period began, according to data obtained by the Richmond Times-Dispatch. The policy, which Democratic Virginia Gov. Ralph Northam signed into law in April along with other gun regulations, took effect on July 1. However, the state had been tracking handgun purchases since June, the Dispatch reported.

A host of gun control laws, passed months ago and spearheaded by Democratic Virginia Gov. Ralph Northam, took effect on Wednesday in the commonwealth after months of fierce opposition from pro-firearm groups.

“I don’t want prayers. I don’t want thoughts,” said a mother whose son died this week when a lone gunman opened fire in a bar in California. Susan Schmidt-Orfanos’ son Telemachus had already survived the onslaught of another lone gunman at a music festival in Las Vegas last year. This week, he went to the Borderline Bar and Grill in Thousand Oaks, California, along with other survivors of the Las Vegas massacre. Schmidt-Orfanos’ son died Wednesday less than 10 minutes away from home. He was at the bar when a shooter fired into the crowd, killing 12 people. Schmidt-Orfanos said Congress needs “to pass gun control so no one else has a child that doesn’t come home.” The shooter, Marine Corps veteran Ian David Long, 28, apparently killed himself after gunning down customers in the bar. Investigators are looking for clues to Long’s “state of mind” before Wednesday’s late-night shooting. “It’s a gun culture,” California’s Democratic Governor-elect Gavin Newsom lamented Thursday. “You can’t go to a bar or a nightclub? The National Rifle Association is demanding Phil Bredesen retract a misleading ad from his U.S. Senate campaign in which he uses an old rating to make it appear the organization supports him. The Washington Free Beacon on Friday reported on the gun rights organization’s demand. Watch Bredesen’s ad: The Democratic former governor of Tennessee had received an “A” rating from the NRA – in 2002. His current grade is far different. “Phil Bredesen is a ‘D’ rated candidate, and he will not protect our constitutional rights in Washington, D.C.,” Chris W.
