Justice Gorsuch Says Pandemic Created ‘Greatest Intrusions on Civil Liberties’ in America’s Peacetime History

Justice Neil Gorsuch called government responses to the COVID-19 pandemic the “greatest intrusions on civil liberties in the peacetime history of this country” on Thursday.

Gorsuch made his comments in reaction to the Supreme Court’s Thursday dismissal of a case dealing with red states’ attempt to keep in place a Trump administration policy, Title 42, which allowed the U.S. to expel over 2.5 million migrants from the border due to a public health emergency. In an eight-page long statement attached to the decision, Gorsuch slammed an array of emergency power abuses employed by local leaders during the pandemic, from lockdowns to church closures.

Mark Brnovich Applauds SCOTUS for Upholding the First Amendment Rights of a Former Public High School Coach

Arizona Attorney General Mark Brnovich (R) applauded the Supreme Court of the United States for upholding the First Amendment rights of Joseph Kennedy, a former Washington high school football coach.

“This is a great win, strongly affirming our constitutional recognition for freedom of speech, religion, and personal expression for all,” Brnovich said. “The First Amendment is at the core of who we are as Americans, and we must vigorously uphold it not only in court but every day of our lives.”

GOP Senators Chastise Conservative Justices in the Wake of Leak

Two moderate Republican senators criticized the Supreme Court’s decision to overturn Roe v. Wade in a leaked draft opinion written by Justice Samuel Alito on Tuesday.

Sen. Lisa Murkowski of Alaska said that if the draft opinion was accurate, “it rocks my confidence in the court right now,” Politico’s Burgess Everett reported. Chief Justice John Roberts confirmed the accuracy of the leak in a statement Tuesday.

Supreme Court Decision Claims Minnesota County Officials Bullied Amish Over Religious Beliefs

The Supreme Court recently decided in favor of a Fillmore County Amish community after the county attempted to force the Amish to violate their religious beliefs by installing a septic system, after a lower court had previously ruled in favor of the county and Minnesota Pollution Control Agency. 

According to the Court’s decision, written by Justice Neil Gorsuch, the county engaged in bullying tactics in an attempt to get the Swartzentruber Amish community to agree to its terms. Those tactics included “threats of reprisals and inspections of their homes and farms” and attacks on “the sincerity of the Amish’s faith.”

Justice Neil Gorsuch Will Replace Joe Biden as Honorary Chair of the National Constitution Center

  Supreme Court Justice Neil Gorsuch is taking on a new role as the honorary chairman of a nonpartisan group devoted to education about the Constitution, replacing former Vice President Joe Biden. The National Constitution Center in Philadelphia said Tuesday that Gorsuch, named to the high court by President Donald Trump, will serve as a spokesman for civics education and civility in politics. The 51-year-old Gorsuch is the first sitting Supreme Court Justice to be the center’s chairman. Vice President Biden stepped down when he launched his campaign for the presidency in April. Justice Gorsuch said he’s concerned by polls that show most Americans would flunk a citizenship test and many say incivility keeps them away from public affairs. “For a government of and by the people to work, everyone must have some idea how our Constitution works and we must be able to talk to each other about important ideas in an atmosphere of mutual respect,” Gorsuch said in a comment provided by the Supreme Court. Clarence Thomas Clerks Dominate Trump’s Judicial Appointments

As of this writing, the president has appointed seven Thomas clerks to the federal appeals courts, while an eighth is expected in the near future. As such, Thomas’s legal approach — sometimes branded unusual or idiosyncratic — can claim adherents among a new generation of judges. “At this point, Justice Thomas is clearly the leading intellectual force on the conservative side of the bench,” said Carrie Severino, a former Thomas clerk who leads the Judicial Crisis Network, an advocacy group that supports Trump’s efforts to recast the judicial branch. “His principled approach to the law is very much in the ascendency and those are the kind of judges that this president has pledged for the courts,” Severino added. Thomas generally hires law clerks who share his originalist judicial philosophy. A Little-Noticed Opinion Portends Big Changes for Religious Liberty at the Supreme Court

by Kevin Daley   The Supreme Court’s conservative bloc released a short, little-noticed statement on Jan. 22 that portends far-reaching changes for religious liberty. The statement — which Justice Samuel Alito authored and Justices Clarence Thomas, Neil Gorsuch and Brett Kavanaugh joined — criticized the 1990 Employment Division v. Smith decision, a landmark ruling that held laws interfering with religious exercise are constitutional provided that they apply to everyone and are neutrally enforced. “In Employment Division v. Smith the Court drastically cut back on the protection provided by the free exercise clause,” Alito wrote. “In this case, however, we have not been asked to revisit that decision.” In the understated parlance of the Supreme Court, it was a clarion call for litigants to bring cases challenging Smith. It was all the more remarkable in that four justices signed onto the statement, an uncommon occurrence for opinions of this nature. The late Justice Antonin Scalia authored the 5-4 Smith ruling. Outrage at the decision prompted passage of the 1993 Religious Freedom Restoration Act (RFRA), which requires courts to subject federal action that infringes on religious practice to the highest degree of scrutiny. The Left would like to remove Justices Kavanaugh and Thomas.  Their goal is to gain control of the Court using any means necessary. On October 6, the day of the Senate vote to confirm Judge Brett Kavanaugh’s nomination to the U.S. Supreme Court, Charlie Savage, writing for The New York Times, discussed liberal strategies for gaining control of the Court. Acknowledging that the Supreme Court would be controlled by a conservative majority for the foreseeable future, Savage reported, “Liberals have already started to attack the legitimacy of the majority bloc and discussed ways to eventually undo its power without waiting for one of its members to retire or die.” One idea is to regain control of the of the government in 2020 and have a liberal president increase the number of Supreme Court justices to create a liberal majority.  Another scheme is to find a means to “impeach, remove and replace Justice Kavanaugh,” as well as Justice Thomas.    Currently, there is a petition with over 47,000 signatures to impeach Thomas.  In the past, opportunities to fill Supreme Court seats depended on the death…

by David Harsanyi   Sure, some of the anger aimed at President Donald Trump’s nomination of Judge Brett Kavanaugh to the Supreme Court is partisan bluster meant to placate the activist base. Still, most Democrats were going to get hysterical about any pick, because any conservative pick was going to take the Constitution far too literally for their liking. For those who rely on the administrative state and coercion as a policy tool—forcing people to join political organizations, forcing them to support abortion, forcing them to subsidize socially progressive sacraments, forcing them to create products that undermine their faith, and so on—that’s a big problem. Some, such as former Virginia Gov. Terry McAuliffe, indulged in the histrionic rhetoric we’ve come to expect in the Trump era, claiming that Kavanaugh would “threaten the lives of millions of Americans for decades to come.” But almost none of the objections coming from leading Democrats have been even ostensibly about Kavanaugh’s qualifications as a jurist or, for that matter, his interpretation of the Constitution. President Trump Meets with Supreme Court Candidates

President Donald Trump says he met Monday with four candidates for the Supreme Court and plans to meet with two to three more as he seeks to nominate a replacement to succeed retiring Supreme Court Justice Anthony Kennedy. Trump told reporters in Washington Monday that the candidates he met with are “incredible people in so many different ways, academically and in every other way.” White House Spokeswoman Sarah Huckabee Sanders said Trump met with each candidate for roughly 45 minutes on Monday. She did not reveal the names of the candidates but said Trump is looking for someone who will uphold the U.S. Constitution and who has the “right intellect” and “right temperament.” When asked if Trump is looking for a candidate that will overturn Roe v. Wade, the landmark Supreme Court ruling on abortion, Sanders reiterated Trump’s stance that he is not asking the candidates their views on abortion rights. “The president is pro-life, but in terms of the process of selecting a Supreme Court nominee, as the president said last week, he is not going to discuss specific cases with the nominees,” Sanders said. Rendall   It may be a little hard to remember now, nearly ten months later, but the newly sworn in President Donald Trump created waves throughout the country when he introduced a little known federal judge from Colorado as the prospective replacement for the late legendary Justice Antonin Scalia at the end of January. Neil Gorsuch and his wife Marie Louise stood patiently behind President Trump as the announcement was made to the country. The Justice-to-be then delivered a brief but stirring tribute to the man whom he would succeed and promised, if confirmed, to do everything in his power to maintain Scalia’s tradition of upholding the original meaning of the Constitution. Because of his conservative textualist philosophy Gorsuch endured a grueling senate confirmation battle at the hands of the desperate Democrat opposition which ultimately ended in the slim Republican majority’s “nuking” of the filibuster for Supreme Court nominees, which then paved the way for the appeals court judge to elevate to the high court with 54 votes. Commentary: Gorsuch Swearing-In Finally Makes Supreme Court Whole Again

Rendall Considering the huge amount of effort that was expended by both sides of the Supreme Court confirmation fight since he was officially nominated by President Donald Trump at the end of January, Judge Neil Gorsuch’s final senate vote went off without much exertion on Friday. Ryan Lovelace of the Washington Examiner reported, “The Senate confirmed Judge Neil Gorsuch to the U.S. Supreme Court on Friday. “The Republican majority was joined in the 54-45 vote by a few Democrats in confirming the 10th Circuit Court of Appeals judge to the high court. Gorsuch’s success comes after the Senate killed the filibuster for Supreme Court nominations on Thursday, effectively paving the way for Gorsuch to join the high court.” Democrats technically could have dragged out the process until early evening on Friday, but it wouldn’t have made any difference in the outcome. For once it looked like the minority party simply capitulated. Or maybe they just wanted to commiserate with their leftist interest groups or start their Easter recess early.
