Julie Kelly Commentary: Ties Between Judge Merchan’s ‘Child’ and Adam Schiff Represent Major Conflict in Hush Money Trial

Loren Merchan

At the end of 2019, Representative Adam Schiff, chairman of the House Intelligence Committee, was leading the first impeachment effort against President Donald Trump.

After months of making accusations and conducting Congressional inquiries related to Trump’s July 2019 call with Ukrainian President Volodymyr Zelensky—a conversation Democrats described as a “quid pro quo” attempting to trade military aid for an investigation into the Biden family’s corrupt business deals—Schiff and six other Democrats delivered articles of impeachment to the Senate in January 2020.

‘Truly Unprecedented:’ Donald Trump Is Dominating the Early Primary Season Like Nothing in Modern History

Former President Donald Trump continues to dominate the early primary season in an unprecedented third bid for the White House, polling experts told the Daily Caller News Foundation.

This Republican primary cycle is like none other as the frontrunner is a former president, has a massive lead in the polls, his former vice president is running against him and Trump has two federal indictments under his belt. Polling analysts stressed to the DCNF the stark difference between this GOP primary season and previous cycles, arguing that it’s difficult to draw comparisons in modern history.

Senator JD Vance Calls ‘Political Persecution’ of Trump a ‘Grave Miscarriage of Justice’

U.S. Senator JD Vance (R-OH) said that the indictment against former President Donald Trump, a 2024 presidential candidate, is a “grave miscarriage of justice.”

Thursday’s indictment results from the protracted investigation into Trump’s alleged use of hush money in connection with porn star Stormy Daniels. To keep Daniels from disclosing her alleged 2006 affair with Trump, Trump’s then-lawyer, Michael Cohen, paid her $130,000 as part of a non-closure agreement near the end of the 2016 presidential campaign. Trump allegedly then paid Cohen back in installments. Trump has denied the affair.

Trump announced last week that he expected to be arrested imminently. While that arrest has not yet occurred, the prospect of a Trump indictment looms large as Manhattan District Attorney Alvin Bragg continues his investigation into an alleged 2016 hush money payment to porn actress Stormy Daniels.

Newspaper Giant McClatchy ‘Taking a Close Look’ at Its Cohen-Prague Reports in Wake of New Evidence

McClatchy news service says it is reviewing two reports published in 2018 that claimed to validate a key part of the infamous Steele dossier after declassified information showed that Russian operatives may have fed disinformation to dossier author Christopher Steele.

“We are taking a close look at this new information and will update or correct our story based on its merits. Until then, we continue to stand by our reporting,” McClatchy said in a statement to The Washington Post’s Erik Wemple.

Christopher Steele Refuses to Cooperate with US Prosecutor Looking Into Origins of Trump-Russia Probe

by Chuck Ross   Dossier author Christopher Steele will not cooperate with U.S. Attorney John Durham’s investigation into the origins of the Trump-Russia probe, telling an audience at Oxford University that he believes U.S. investigators have acted in “bad faith.” Steele, a former British spy, said at the Oxford event on Friday that he and his firm, Orbis Business Intelligence, had already “done our duty” by cooperating with a Justice Department inspector general’s (IG) investigation of the FBI’s surveillance of Trump campaign aide Carter Page. According to The Daily Beast, which attended the Oxford event, Steele also criticized the IG, saying that he cooperated with the probe for “four or five months,” and observed “very bad qualities” on the part of government officials. He said some acted in “bad faith.” Reuters reported on Friday that Durham’s team has recently approached Steele seeking an interview. The former MI6 officer rejected the request because he believes that he would not be treated fairly, three sources familiar with the matter told Reuters. Numerous questions remain unanswered about how Steele collected information for his dossier, and how many of his allegations about Trump associates turned out to be inaccurate. Steele alleged that the Trump campaign, including Page,…

House May Vote Today on Green’s Resolution to Force Vote on Whether to Refer Cohen to Justice Department for Perjury Investigation

U.S. Rep. Dr. Mark Green (R-TN-07) filed a motion in the House Tuesday to force a vote on referring Michael Cohen to the Justice Department for a perjury investigation, with a showdown coming as early as today. Cohen is President Donald Trump’s former lawyer. House Resolution 304 is meant to hold Michael Cohen accountable for his alleged lies to the House Oversight and Reform Committee, Green said in a press release. “The integrity of the Oversight Committee and entire House is at stake. We must defend our honor, refer Michael Cohen’s testimony to the Justice Department for a perjury investigation and show the American people that the People’s House will not tolerate a man lying under oath,” said Rep. Green. “Sixty-two days ago, Chairman Cummings welcomed convicted liar Michael Cohen to testify before the House Oversight Committee. Republicans warned the Democrats against giving Cohen a platform and in return Chairman Cummings promised that if Cohen lied again, the Chairman would hold him accountable. During Cohen’s testimony he lied at least seven times and yet the Chairman has yet to uphold his pledge of maintaining the integrity of our Committee in the face of these false statements that were given under oath.…

Mueller Report Directly Contradicts Bombshell BuzzFeed Story

by Peter Hasson   Special counsel Robert Mueller’s report on the Russia investigation directly contradicts an explosive BuzzFeed story that claimed Mueller had evidence President Donald Trump directed Michael Cohen, his former attorney, to lie to Congress about a potential Moscow real estate deal. The Jan. 18 BuzzFeed story claimed that Cohen “told the special counsel that after the election, the president personally instructed him to lie — by claiming that negotiations ended months earlier than they actually did — in order to obscure Trump’s involvement.” The story claimed that Mueller’s office “learned about Trump’s directive for Cohen to lie to Congress through interviews with multiple witnesses from the Trump Organization and internal company emails, text messages, and a cache of other documents. Cohen then acknowledged those instructions during his interviews with that office.” BuzzFeed touted its story as “the first known example of Trump explicitly telling a subordinate to lie directly about his own dealings with Russia.” But Mueller’s report states that “Cohen said that he and the President did not explicitly discuss whether Cohen’s testimony about the Trump Tower Moscow project would be or was false, and the President did not direct him to provide false testimony. Cohen…

House Oversight Committee Republicans on Wednesday introduced a resolution, sponsored by U.S. Rep. Mark Green (R-TN-07), that directs Chairman Elijah Cummings (D-MD-07) to submit an official copy of the transcript of Michael Cohen’s testimony to the Department of Justice for investigation and potential prosecution. Full text of the resolution can be found here. “If Chairman Cummings fails to refer Mr. Cohen to the Department of Justice for perjury, it will forever mar the reputation of the Oversight Committee and call into question the integrity of the entire House. Mr. Chairman, do what you said you’d do and hold Mr. Cohen accountable for lying before our committee,” Green said in a press release. Green has been a critic of Cohen’s in the past. DOJ Official’s Testimony Highlights Why One GOP Lawmaker Believes Glenn Simpson Faces ‘Real Legal Jeopardy’

Glenn Simpson, Bruce Ohr

by Chuck Ross   Justice Department official Bruce Ohr’s congressional testimony undercuts testimony given by Glenn Simpson, the founder of the opposition firm that commissioned the infamous Steele dossier. Ohr’s testimony, a transcript of which was published Friday, also confirms reports that Simpson was the source of a heavily disputed allegation about conservative attorney Cleta Mitchell. Ohr told lawmakers in an Aug. 28, 2018 hearing that he met Simpson prior to the 2016 election to discuss information gathered by Christopher Steele, the former British spy who authored the dossier. That conflicts with Simpson’s testimony to the House Intelligence Committee that he met Ohr only after the election and at Ohr’s request. Ohr also revealed Simpson provided him during a meeting in December 2016 with a seemingly false lead about Mitchell that ended up in a news article published in 2018. Both of Simpson’s inaccurate claims have been reported in the past, but they were not officially confirmed until Friday, when Georgia GOP Rep. Doug Collins released a transcript of Ohr’s testimony before the House Judiciary and House Oversight Committees. In his interview, Ohr discussed his interactions with Simpson and Steele, a former MI6 officer. Ohr served as a back channel…

CNN Leak During Michael Cohen Testimony Recalls Memories of Network’s Bungled Don Jr. Story

by Chuck Ross   In the middle of Michael Cohen’s private testimony to the House Intelligence Committee on Wednesday, CNN reported the former Trump fixer provided the panel with documents allegedly showing President Donald Trump’s attorneys edited false statements that Cohen made to Congress in 2017 regarding efforts to build a Trump Tower in Moscow. The leak harkens back to another provided to CNN that led to an embarrassing retraction for the network. CNN reported Dec. 8, 2017, during the middle of Donald Trump Jr.’s testimony that he had received an email Sept. 4, 2016, with a link of unreleased WikiLeaks documents. CNN had wall-to-wall coverage of the scoop, which would have been the first evidence that Trump associates received WikiLeaks materials before their release. But CNN got the story entirely wrong. The email was actually sent to Trump Jr. on Sept. 14, 2016, a day after the same WikiLeaks documents contained in the email had been released to the public. CNN corrected its story but previously declined The Daily Caller News Foundation’s requests to explain the error. It remains to be seen whether the CNN report during Cohen’s testimony will suffer a similar fate. According to CNN’s anonymous sources,…

On Friday’s Tennessee Star Report with Steve Gill and Michael Patrick Leahy – broadcast on Nashville’s Talk Radio 98.3 and 1510 WLAC weekdays from 5:00 am to 8:00 am – Gill and Leahy talked to Tennessee Congressman Mark Green about his opening statements and questions posed to Michael Cohen during the hearing in Washington yesterday. The Congressman admitted that this was a strategic move that would allow a light to be shown on the true intentions of the Democrats. Towards the end of the segment, Mark Green touched upon his positions regarding the Fetal Heartbeat bill and the border wall security funding.  He went on to note that there are many Republicans not siding with the President and joining the Democrats in their resolution bill to stop the national emergency as declared by President Trump while noting the several national emergencies declared by previous Presidents in number. Congressman Mark Green Destroys Convicted Felon Michael Cohen

U.S. Rep. Mark Green, a Republican representing Tennessee’s Seventh Congressional District, delivered a blistering speech against Michael Cohen in Washington, D.C. Wednesday. Green scolded Cohen as, among other things, a liar, narcissist, and a tax cheat. Green also reprimanded House Democrats for even thinking to give Cohen a platform on a national stage. Cohen, of course, testified against U.S. Republican President Donald Trump Wednesday in front of the U.S. House Oversight Committee. Cohen spoke of Trump’s alleged payoffs and other alleged illegal acts. Green belongs to that committee. And when it was his turn to speak, Green unloaded: “The chairman of this committee promised the American people a fair and open process, yet the Democrats have vastly limited the scope of this hearing. They’ve issued a gag order to try to tell members of this committee what we can and cannot talk about. My colleagues on the other side of the aisle claim that they want the truth, that they want transparency and fair oversight, yet the Democrats’ witness to testify before Congress today is none other than a scorned man going to prison for lying to Congress. Let it sink in. He’s going to prison for lying to Congress,…

Michael Cohen Pours Cold Water on Collusion in Congressional Testimony, But Makes Bombshell Wikileaks Claim

by Chuck Ross   Michael Cohen will make several bombshell allegations about President Trump during his testimony on Capitol Hill Wednesday, including that he overheard political operative Roger Stone tell Trump during the 2016 presidential campaign that he had spoken to WikiLeaks founder Julian Assange about the release of emails stolen from the Democratic National Committee. While Cohen will offer scathing testimony against his former boss, he also claims he has no “direct evidence” that the Trump campaign colluded with the Russian government. Cohen will also testify that, contrary to recent BuzzFeed News report, Trump did not directly instruct him to lie to Congress about negotiations to build a Trump Tower in Moscow. Cohen, who will begin a three-year prison sentence on May 6, will also provide numerous anecdotes from his decade of working for Trump which he says shows the former real estate mogul to be “a racist…a conman…a cheat.” Cohen’s 20-page opening statement was released Tuesday night ahead of his testimony before the House Oversight and Reform Committee. Cohen testified earlier on Tuesday in a closed hearing before the Senate Select Committee on Intelligence. Cohen’s claims about Roger Stone are perhaps the biggest bombshell contained in the opening…

Michael Flynn Sentencing Delayed

A U.S. judge in Washington on Tuesday sternly rebuked President Donald Trump’s first national security adviser, Michael Flynn, for lying to investigators about his contacts with Russia in the weeks before Trump assumed power in early 2017, but delayed his sentencing. “I can’t hide my disgust, my disdain,” U.S. District Judge Emmet Sullivan said of Flynn’s behavior, before later acceding to a request by Flynn’s lawyers to postpone his sentencing. Flynn acknowledged to Sullivan, “I was aware,” that it was a crime to lie to interrogators when they asked him about his discussions with Russia’s then-ambassador to Washington, Sergey Kislyak. The judge told Flynn that his offense was “very serious” and that “arguably, you sold your country out.” Special counsel Robert Mueller had recommended the 60-year-old Flynn, a retired Army general and once head of the country’s Defense Intelligence Agency, not be sentenced to any prison time because he had provided “substantial” cooperation with prosecutors in their ongoing 19-month investigation of Trump 2016 campaign links with Russia and whether, as president, Trump obstructed justice by trying to thwart the probe. But Sullivan said he could not guarantee that Flynn will avoid a prison term when he is eventually sentenced, sometime…

Commentary: Michael Cohen’s Guilty Plea on Fake Campaign Finance Violations Does Not Make Law

by Robert Romano   President Donald Trump’s former personal attorney Michael Cohen never sought reimbursement from the 2016 Trump campaign for non-disclosure agreement payments of alleged mistresses of Trump’s. Instead, the reimbursements were sought and delivered from Trump’s business, the Trump Organization. Cohen didn’t think these were campaign expenditures back in 2016 to settle a private matter. Yet now on a post hoc basis, the U.S. Attorney for the Southern District of New York and Cohen have determined that it was. These were non-disclosure agreements that Trump would have entered into even if he had not been a candidate for public office just to protect his businesses, his reputation and his family. Trump has individual rights under the Constitution to contract with an attorney to enter into just these sorts of legal settlements with potential litigants, something Congress cannot preempt. But the U.S. Attorney coercing Cohen’s guilty plea to campaign finance violations that were not campaign violations does not — and cannot — make law. That is Congress’ job, and the statute is very specific. It requires that to be an expenditure under the law, 52 U.S. Code § 30101(9)(A)(i), it must be “for the purpose of influencing any election…

Michael Cohen Sentenced to Three Years in Federal Prison

by Chuck Ross   Michael Cohen, the former personal attorney for Donald Trump, was sentenced to three years in prison by a judge in New York on Wednesday. The sentence, handed down by U.S. District Court Judge William Pauley, is lower than prosecutors’ recommendation that the longtime Trump fixer receive slightly less than between 51 and 63 months in prison. Pauley cited a “smorgasbord” of Cohen crimes before announcing the jail term. Cohen, 52, pleaded guilty on Aug. 21 to tax evasion, bank fraud and making illegal campaign contributions over his payments to Stormy Daniels, the porn star who claims she had an affair with Trump in 2006. Cohen paid Daniels $130,000, he claims at the direction and in coordination with Trump. Legal analysts have debated for days whether Trump is in legal jeopardy, with some observers saying that he could be impeached or even indicted after leaving office. Cohen created shell companies both to avoid paying taxes on his taxi business as well as to make the payment to Daniels. Trump defended the payment on Tuesday, telling Reuters that he did not view it as a campaign contribution. “Michael Cohen is a lawyer. I assume he would know what he’s doing,” he said…

Commentary: Mueller’s Collusion Hoax Collapses

by Conrad Black   The sudden death of the unutterable nonsense of collusion between the 2016 Trump campaign and the Russian government, announced as it was in the hand-off to the Southern New York U.S. Attorney of the shabby fruit of Michael Cohen’s plea bargaining, has divided onlookers into three communities of opinion. The true believers in the collusion canard are left slack-jawed, like the international Left after the announcement of the Nazi-Soviet Pact: an immense fervor of faith is instantly destroyed; it is the stillness of a sudden and immense evaporation. The professional Trump-haters, the Democratic Party assassination squads in Congress and the media, like disciplined soldiers, have swiveled with parade ground precision and resumed firing after a mere second to reload, at the equally fatuous nonsense about illegal campaign contributions. Disreputable, contemptible myth-makers and smear-jobbers though they are, they deserve credit for fanaticism, improvisation, and managing in unison to sound half plausible in the face of the crushing defeat they have suffered and the piffle and pottage they are left to moralize about. Third, and slowest to respond, so sudden has been the change of the whole Trump-hate narrative, are those who never wavered from the requirement of…

Victor Davis Hanson Commentary: Defeat and the Dossier Explain Everything

by Victor Davis Hanson   Donald Trump’s former consiglieri Michael Cohen, along with being charged with tax avoidance and improper business deals, allegedly is guilty also of trying to leverage money and attention by exaggerating his influence with candidate and later President Trump. In other words, Cohen to spec followed the standard creepy daily fare for Washington and New York wannabe fixers. But did we need Robert Mueller’s 18 months and $40 million to uncover and redirect to federal attorneys what was largely self-evident? Could not the U.S. government long ago, without the prompt of a special counsel, have uncovered that Michael Cohen did not fully pay his taxes—in the manner of an Al Sharpton, Timothy Geithner, and Tom Daschle? The diabolical Cohen also tried to enforce, extend, or create non-disclosure agreements (Swampese for hush money) with two women from Trump’s past. The two reappeared out of nowhere in 2016, apparently to translate their alleged Trump hookups of a few hours in years past to notoriety and additional profit in the new age of “President Trump.” Swamp Crimes In other words, Michael Cohen was a sort of rough-hewn version of former Bill Clinton crony Vernon Jordan. The latter, remember, was…

Rep. Steve Cohen Says President Donald Trump is a ‘Criminal Enterprise’

U.S. Rep. Steve Cohen (D-TN-09), the same man who said he wants U.S. Sen.-elect Marsha Blackburn to jump off a bridge, has concluded that President Donald Trump is a “criminal enterprise.” On Friday’s broadcast of MSNBC’s “The Last Word,” Steve Cohen spoke about the sentencing memos on former Trump lawyer Michael Cohen. He said, “Donald Trump is a criminal enterprise.” Host Lawrence O’Donnell said, “Only three presidents of the United States have been accused of federal crimes by … a prosecutor, a federal prosecutor of any kind while in office, and Donald Trump is now one of them.” O’Donnell pointed out that any impeachment proceedings would start in the House Judiciary Committee, where Cohen is a member. Steve Cohen said, “I think that what we’ve learned today is what we — many of us have known for at least two years, and some for maybe 10 or 15, that Donald Trump is a criminal enterprise. The Trump family is a criminal enterprise, and that most of the people he’s involved with, like Michael Cohen and Manafort, are shady folks.” The representative said many committees would investigate “Trump activities” but they would not start out with impeachment. Steve Cohen added, “proof…

NPR Falsely Accuses Don Jr of Lying in Senate Testimony

by Chuck Ross   NPR published a report Friday asserting that Donald Trump Jr.’s testimony to the Senate about efforts to build a Trump Tower in Moscow were inconsistent with Michael Cohen’s claims about the same project in his plea deal Thursday. A transcript from Trump Jr.’s Sept. 7, 2017 testimony to the Senate Judiciary Committee shows that he claimed the Trump Organization ceased pursuing a deal to build Trump Tower in Moscow by the end of 2014, NPR reported. The news organization quoted Trump Jr. as saying that the project “faded away” by “the end of ’14.” “But not in 2015 or 2016?” Trump Jr. was asked. “Certainly not ’16,” the president’s son replied. “There was never a definitive end to it. It just died of deal fatigue.” NPR asserted that the testimony would pose a problem for Trump Jr. since attorney Cohen said in his plea agreement with the special counsel’s office that he continued negotiating the building through June 2016. He also said he briefed President Donald Trump and his children that year before the deal fell through. NPR issued a lengthy editor’s note to the article five hours after publication but did not retract the piece. As…

Cohen Attorney Backtracks on Claim That Trump Had Advance Knowledge of Russian Hacking

by Chuck Ross Lanny Davis says he does not know whether President Trump had advance knowledge of Russian hacks of Democrats Earlier this week, Davis said that his client, Michael Cohen, had information linking Trump to the hacks Now he claims that he merely had an ‘instinct’ about what Trump knew Lanny Davis, an attorney for Michael Cohen, is backtracking from his stunning claim earlier this week that President Trump had advance knowledge of Russian hacking efforts. Memphis Democrat Steve Cohen Increasingly Unhinged, Calls President Trump and Rudy Giuliani ‘Pathological Liars’

Steve Cohen

Memphis-area Democrat Representative Steve Cohen appeared on MSNBC’s “Live With Alex Witt” Sunday to react to the latest, if unusual, developments with former Trump attorney Michael Cohen (no relation) and Special Counsel Robert Mueller’s ongoing ‘Trump-Russia Collusion’ investigation. The five-term congressman has a well-established record of vitriolic statements aimed at conservative and Rebublicans, but Cohen managed to “find a new gear” when President Trump surprised the world with his election victory over Hillary Clinton in 2016. Since then, the avowed progressive has become uncreasingly unhinged as his efforts to block, obstruct, resist, and even oust President Trump or his policy agenda have failed. Regarding new questions about Michael Cohen’s credibility, Alex Witt asked if the fact that Cohen has been exposed as “wiretapping” his clients impairs his belivability on the stand, “Or do you believe it is the President who loses in the credibility department?” Rep Cohen, who is a member of the House Judiciary Committee answered, “I think that Michael Cohen, Rudy Giuliani and Donald Trump have about the same amount of credibility. They all use, at best, situational ethics – but probably more likely they just lie constantly, and they’re all three pathological liars.” (emphasis added) Surprised at the…

FBI Seized 12 Audio Recordings During Michael Cohen Raid

by Chuck Ross   Twelve audio files recorded by former Trump attorney Michael Cohen were handed over to federal prosecutors on Friday, according to a document filed Monday in federal court. Barbara S. Jones, who is serving as special master in a review of documents seized from Cohen in an April 9 FBI raid, said in the court filing that the 12 recordings were provided to the government as part of its investigation into Cohen’s financial dealings. “On July 20, 2018, the parties withdrew their designations of ‘privileged’ as to 12 audio items that were under consideration by the Special Master. Based upon those de-designations, the Special Master released the 12 items to the Government that day,” Jones wrote. Jones, a former federal judge, is reviewing the hundreds of thousands of documents seized in the raids to see what can be released to the government and what is protected by attorney-client privilege. Cohen recorded a conversation he had with President Donald Trump in 2016 about possible payments to a media company for a story about Karen McDougal, the Playboy playmate who claims to have had an affair with Trump in 2006, The New York Times reported Friday.
