Federal Agencies Push Back on Claim They Sanctioned Private Border Wall Construction

by Andrew Kerr   The founder of the nonprofit group that built a half-mile border wall over Memorial Day weekend said the Trump administration sanctioned the project, but two federal agencies disputed his claim Wednesday. Triple amputee and Air Force veteran Brian Kolfage said Wednesday that the Trump administration called the International Boundary and Water Commission (IBWC) and authorized the construction on private property near El Paso, Texas. He also said that the Department of Homeland Security (DHS) approved the venture. However, a spokeswoman for the IBWC told The Daily Caller News Foundation it received no such call from the Trump administration regarding We Build The Wall, which is funded by the viral $20 million GoFundMe fundraising campaign Kolfage launched in December. Liberal Mayor Javier Perea Targets We Build the Wall with Cease-and-Desist Shutdown Order While City Prepares for ‘Amnesty Week’

  The City of Sunland Park, New Mexico on Tuesday waged a legal and PR attack against the private builders of the border wall, trying to shut them down with a cease and desist order. As The Tennessee Star reported Tuesday, We Build the Wall is nearing completion of just less than a mile of border fencing in New Mexico. That did not sit well with officials in Sunland Park, who claimed the builders did not have a permit. The city on Tuesday afternoon issued a cease and desist order on construction at the site, KVIA said. We Build the Wall shot back, KVIA said. ”We Build The Wall has done everything they need to do to be in compliance with all regulations. We’ve had members from Sunland Park city government out to inspect the site and to witness the first concrete pour. We believe this is a last ditch effort to intimidate us from completing this historic project by a local government with a long history of corruption problems.” The cease-and-desist order came at the end of the work day. We Build the Wall Builds First Half-Mile Section of Border Wall in New Mexico – in Four Days

  The group We Build the Wall announced Monday it has completed construction of a large section of wall spanning between a half-mile and a mile along an open area of the Southern border previously believed to be unbuildable. According to a story by The Washington Times, the wall section is along the southern border in New Mexico, and the organization says that is a first in the history of the border. The wall is made of 18-foot steel bollard like what the Border Patrol uses, the Times said. Just late last week, a federal judge ordered a halt to part of President Donald Trump’s emergency declaration and shifting of money within the Pentagon to make up for Congress’s refusal to fund the wall, the Times said. The new section closes a gap that was between the end of the El Paso, Texas border wall and Mount Cristo Rey, across from the City of Juarez, The Gateway Pundit said. FBI Arrests Member of New Mexico Group that Stops Illegal Border Crossers at Border

Reuters   The FBI on Saturday said it had arrested Larry Hopkins, a member of an armed group of U.S. citizens who have been stopping migrants illegally crossing the U.S.-Mexico border in New Mexico. Hopkins, 69, also known as Johnny Horton, was arrested in Sunland Park, N.M., on a federal complaint charging him with being a felon in possession of firearms and ammunition, the Federal Bureau of Investigation said in a statement. Hopkins had represented himself as the commander of the United Constitutional Patriots (UCP), a volunteer group camped out near Sunland Park since late February. The UCP has posted videos showing its members holding migrants, many of them Central American families with children seeking asylum, until U.S. Border Patrol arrives to arrest them. Migrants’ surrender on video The group drew a complaint from the American Civil Liberties Union, and widespread media attention, after an April 16 video showed a group of around 300 migrants surrendering to the UCP at its camp. New Mexico Gov. Michelle Lujan Grisham on Friday said citizens had no authority to arrest or detain anyone and police and justice officials were looking into the UCP’s activities. Popular Vote Compact Adds New Mexico, Now Has 189 Electoral Votes

by Whitney Tipton   New Mexico Democratic Gov. Michelle Lujan Grisham signed legislation Wednesday officially joining a group of states agreeing to elect the president by popular vote. By formally adding HB55 to the Governor’s list of signed legislation, Grisham confirmed that New Mexico is the 14th state the National Popular Vote Interstate Compact (NPVIC). The measure passed through both chambers of the New Mexico legislature with no Republican votes, according to the state’s website. The NPVIC is an agreement between states to pool their electoral votes together for the candidate who wins the states’ aggregated popular vote. States will award their electoral votes regardless of individual state voting results. States that have passed similar legislation to join the NPVIC now represent 189 electoral votes. The compact could become official when that number hits 270, enough votes to elect the president of the United States. Under the U.S. Constitution, a state gets one Electoral College vote for each of its seats in Congress. New Mexico is a winner-take-all state, which means it allocates all five of its Electoral College votes to the presidential candidate who wins the popular vote in the state. Audit Finds Signs of Fraud in New Mexico House Race

Democrat Xochitl Torres Small squeaked by Republican Yvette Herrell in the final results of the Nov. 6 election. On election night, Herrell declared victory in the race to represent New Mexico’s 2nd Congressional District. But as more votes were counted, Torres Small secured the win. The roughly 3,500-vote victory for Torres Small—out of about 200,000 cast in the southern New Mexico district—relied heavily on absentee ballots from Doña Ana County, the largest county in the district, including the Las Cruces area. A new audit report obtained by The Daily Signal alleges a “concerted effort” to push for absentee votes where New Mexico voter ID laws are not enforced. It also points to potential fraud in applying for absentee ballots, and says a significant number of absentee ballots were time-stamped after the 7 p.m. deadline election night. The report was prepared for the losing Herrell campaign by Full Compliance Consulting LLC and Herrell campaign lawyer Carter B. Harrison. New Mexico IT Professional Files a Class Action Lawsuit Against Public Sector Union After Allegedly Forcing Him to Pay Dues

by Tim Pearce   A New Mexico state employee filed a class action lawsuit against a branch of the Communication Workers of America (CWA) over “forced” nonmember union dues, according to the National Right to Work Legal Defense Foundation (NRTW). IT technician David McCutcheon filed a lawsuit against CWA Local 7076 on Dec. 20. McCutcheon and the NRTW, which is representing McCutcheon, allege that the union violated federal law by restricting non-union members’ chance to opt out of paying “agency fees,” dues paid by non-members, according to NRTW. In its June 27 decision in the case Janus v. AFSCME, the Supreme Court banned government employers from requiring workers to pay union agency fees as a condition of employment. The decision impacted roughly 5 million government workers across 22 states. The case could potentially cost unions millions of dollars’ worth of revenue from nonunion members opting out of paying mandatory dues and union members taking advantage of their recently-secured right and quitting the union altogether. Following the Supreme Court decision, CWA gave nonunion members that paid agency fees and benefit from union representation a “window period” to opt out of paying the union. DOI Discovers Largest US Oil and Gas Reserve Ever Found in New Mexico

by Chris White   New Mexico and West Texas are sitting on a bonanza of potentially recoverable oil and gas reserves in the Delaware Basin that lies between the two Western states, the Department of the Interior announced Thursday. Two underground layers in the Delaware known as the Wolfcamp Shale and Bone Spring Formation contain 46.3 billion barrels of unrecovered oil and 281 trillion cubic feet of natural gas, the DOI announced. That’s the largest oil and gas reserve the U.S. Geological Survey has ever discovered. “Even for someone who understands the resources and potential of the Permian Basin, I can’t help but be surprised by the sheer enormity of what the USGS has reported,” New Mexico Oil and Gas Association Executive Director Ryan Flynn told reporters. He added: “The Permian resources shared by New Mexico and Texas make this area one of the most important places in the world in terms of oil production.” Total reserves in the Delaware Basin could be far larger than reported. The USGS only looked at the Wolfcamp and Bone Spring formations, or just two of the many layers of hydrocarbon-filled shale rock zones in the Permian Basin. The United States Constitution does contain a few references relative to immigration and naturalization as well as to persons seeking to enter the United States in contravention of its laws — whether violently or non-violently and whether singly or in the form of a human tsunami. In its Article I, Section 8, Clause 4, the Constitution specifically grants Congress the power “To establish a uniform Rule of Naturalization….” By expressly allocating this capacity to Congress, the Constitution seeks to prevent the confusion which would inevitably result if an individual state could itself bestow U.S. citizenship upon a person not born within the boundaries of that — or any other — state. Construing Clause 4, the United States Supreme Court, in the 1892 case of Boyd v. Nebraska ex rel. Thayer, defined “naturalization” as “…the act of adopting a foreigner, and clothing him with the privileges of a native [U.S.] citizen.” In Clause 11 of that same Article I, Section 8, the Constitution authorizes Congress “To declare War…and make Rules concerning Captures on Land and Water….” Interpreting Clause 11, the High Court ruled in the 1795 case of Penhallow v. Wahhaj is the son of a Brooklyn imam, also named Siraj Wahhaj, who was named by prosecutors as an unindicted co-conspirator in the 1993 World Trade Center bombing, the New York Post reported. During the raid eleven abused children were taken into care by authorities and the remains of one dead child (since identified as Wahhaj’s son) were found at the compound. Lucas Morton, Jany Leveille, 35, Hujrah Wahhaj, 38, and Subhannah Wahhaj, 35, were arrested along with Wahhaj on the property on Friday and all face child abuse charges according to Fox News. After the arrest attorneys for the five Muslim adults claimed that they were being persecuted by Islamophobic and racist police. New Mexico Judge Sarah Backus, an elected Democrat, set a nominal $20,000 bail for the five defendants and ordered the two men and three women to wear ankle monitors, have weekly contact with their attorneys and not consume alcohol or own firearms while on bail. Members of the state’s Sandoval County commission claim activists are haranguing them for contemplating rules permitting gas extraction. Documents also show activists are pressuring commissioners to block industry representatives from discussing future ordinances on natural gas production. “We got blasted by the public about being racists and baby killers,” Jay Block (pictured), one of the commission’s two Republicans, told The Daily Caller News Foundation, referring to insults people hurled at him during debates about gas exploration in the county. Block is in an untenable position, stuck in between an animated anti-gas movement and concerns about the county’s economic well-being. “The citizens are driving the narrative,” said Block, a conservative who worked for the Jack Kemp presidential campaign in 1987. “They are delivering misinformation to the public and not one time has the industry been invited,” he added, referring to the Citizens Watch Group (CWG), an activist group created after the commission voted down ordinances in 2017 following significant public outcry.
