A new lawsuit filed in Pennsylvania asks the state court to scrub Republican U.S. Rep. Scott Perry from the upcoming primary ballot.

Gene Stilp, a Harrisburg-based activist, filed the legal challenge in Commonwealth Court on Tuesday, claiming Perry – who represents the 10th Congressional District in south-central Pennsylvania – violated the Constitution’s 14th Amendment for his support of 2020 election fraud “conspiracy theories.”

Biden’s DOJ Tried to Seize Pennsylvania GOP Lawmaker’s Texts: Report

The Justice Department (DOJ) has sought to access text messages on Republican Pennsylvania Rep. Scott Perry’s cell phone as part of a 2020 election interference probe, having confiscated it in August, CNN reported

FBI agents seized Perry’s phone Aug. 9, he confirmed to the Daily Caller News Foundation that day, ostensibly as part of a federal criminal investigation into the Jan. 6 Capitol riots and efforts to hinder the transfer of power to President Joe Biden, CNN reported. The DOJ’s approach to Perry’s phone seizure involved using one warrant to image the phone and pursuing a data access warrant in confidential proceedings, sources familiar with the investigation and public filings indicated, according to CNN.

Republicans Condemn FBI Seizure of Pennsylvania Congressman Scott Perry’s Phone

One day after the Federal Bureau of Investigation searched former President Donald Trump’s Palm Beach home on Monday, agents seized the cell phone belonging to U.S. Rep. Scott Perry (R-PA-10), eliciting outrage on his side of the political aisle.

The FBI has refused to comment on the investigation, leaving it presently uncertain what messages or other data the bureau seeks to obtain from the lawmaker’s device. Perry, who represents Harrisburg, York and surrounding communities, has been at odds with Congress’s Democratic majority and Joe Biden’s White House over investigations related to the January 6, 2021 riot and Capitol Building breach. The U.S. House select committee probing the event issued a subpoena to the congressman with which he declined to comply.

Key Republican Says Party Must Assure Voters It Will Impeach Garland, Force Overhaul at DOJ

The incoming chairman of the House Freedom Caucus says congressional Republicans must create a clear agenda and messaging in the 2022 election to overcome voter perceptions that there’s little difference between the establishment parties in an era of freewheeling spending and large government.

“We need to be in contact with more individual citizens and every single district in every state bringing the message to them so that they understand what the difference is and that there is a true difference,” Rep. Scott Perry (R-Pa.) told Just the News.

“A lot of people say, ‘Well, look, there’s not a dime’s worth of difference between Republicans and Democrats.’ And you know this, John, when it comes to the establishment cartel in Washington that can’t stop spending taxpayer money, there is some truth to that,” he acknowledged, adding that “we should be here to say, ‘Just do what you said you were going to do.'”
