Rep. Green to File Constitutional Amendment Bill to Freeze Supreme Court Bench at Nine Justices to Counter Democrats’ Push to Pack the Court

U.S. Rep. Dr. Mark Green (R-TN-07) says he will introduce a constitutional amendment to halt Democrats’ desire to pack the Supreme Court in a maneuver hearkening back to progressive president FDR.

Green on Tuesday tweeted, “This Thursday, I will be introducing a constitutional amendment that would limit the number of Supreme Court justices to 9 – the number of seats since 1869. The Supreme Court must remain a fair and impartial branch of government not beholden to party.”

Green also tweeted, “Schemes to pack the court are dangerous to the Founders’ vision of an independent judiciary that serves as a check on both the Executive and Legislative branches of government.”

The Hill said the court-packing suggestion has become a “key litmus test” for 2020 Democratic presidential primary candidates.

Former Attorney General Eric Holder has thrown the idea around. South Bend, Indiana, Mayor Pete Buttigieg and former Texas Rep. Beto O’Rourke (D-TX-16) have both said they could support the concept.

The Hill said:

The courts have emerged as a lightning rod during the Trump administration for the Democratic Party’s resurgent base, which remains deeply bitter over Senate Majority Leader Mitch McConnell’s (R-Ky.) decision to block Merrick Garland, President Obama’s final Supreme Court nominee.

Other Democrats indicating support, if elected president, include Sens. Cory Booker (D-NJ), Elizabeth Warren, (D-MA), Kamala Harris (D-CA) and Kirsten Gillibrand (D-NY), Fox News said. O’Rourke has called for up to 15 justices in the court.

President Donald Trump has scoffed at the idea, saying Democrats are playing “catch up” from losing the 2016 election.

The current Democratic idea hearkens back to President Franklin Roosevelt, who in 1937 put forth a plan to expand the Supreme Court’s size up to 15 justices, according to History.com. Opponents said FDR was trying to pack the court to fight against justices who had stricken down several pieces of the New Deal.

The number of justices on the Supreme Court changed six times before settling at the present total of nine in 1869, according to the court’s website.
