The Georgia Court of Appeals granted former President Donald J. Trump’s request for an interlocutory appeal in the disqualification case against Fulton County District Attorney Fani Willis on Wednesday.
The official document from the Court of Appeals of the State of Georgia states, “Upon consideration of the Application for Interlocutory Appeal, it is ordered that it be hereby GRANTED.”
The appeal challenges a Fulton County Superior Court’s previous ruling, which allowed Fulton County District Attorney Fani Willis to continue prosecuting a case involving the former president and others despite allegations of questionable conduct.
Article III Project founder and President Mike Davis called the court’s grant of appeal “extraordinary” on WarRoom with Stephen K. Bannon. “You’re getting interlocutory appeal,” he said, meaning that the appeal is being made while the case is ongoing.
Davis stated that the attorney general should reassign the case after the disqualification of the Fulton County DA’s Office.
“What I imagine is going to happen is this is going to get reassigned to another DA in Georgia, and this case is going to get dismissed because any DA who looks at this with clear eyes is going to see that this is a bogus case against President Trump. It’s part of the Democrat’s lawfare and election interference,” he added.
According to legal analyst Phil Holloway, the appeal pauses the case against the former president.
“Next comes briefing by the parties, to be followed by oral argument sometime this summer[,] Holloway said on the X platform. “It will be heard by a 3 judge panel so 2 votes will be needed to reverse the trial court[.] Whatever the Court of Appeals rules can be appealed by the losing party[.] The Fulton Case is effective[ly] dead in the water for a while[.]”

Calling the case election interference, Representative Elise Stefanik (R-NY-21) said, “Another one of the Democrats’ illegal sham cases is CRUMBLING. President Trump will have his appeal HEARD in Georgia! The Far Left Democrats’ only strategy for the 2024 election has been blatant lawfare and election interference but that plan is failing.”

In a statement posted on X, Josh McKoon, chairman of the Georgia Republican Party, said, “The Georgia Court of Appeals made the right decision this morning to take up the appeal filed by two of our Republican Presidential Electors and President Trump to disqualify Fulton District Attorney Fani Willis.”

The GOP chair also spoke about the harm caused by DA Willis.
“The damage done by Fani Willis to the innocent defendants in this ridiculous case, the taxpayers of Fulton County, and the wife and family of Nathan Wade will take years to repair. But this is the first step in clearing the stench of mendacity that she has brought to the Fulton County Courthouse,” he said.
McKoon added, “This simply would not have happened without the unanimous decision of the State Executive Committee to indemnify our wrongfully indicted Presidential Electors. We are committed to fighting Fani Willis all the way to put an end to her evil weaponization of our criminal justice system.”
