A federal judge ruled on Tuesday against President Donald Trump’s executive order (EO) banning transgender people from serving in the military.
Trump issued his EO that attempts to restore high standards to military members after years of DEI and wokeness infecting America’s military.
“Consistent with the military mission and longstanding DoD policy, expressing a false “gender identity” divergent from an individual’s sex cannot satisfy the rigorous standards necessary for military service. Beyond the hormonal and surgical medical interventions involved, adoption of a gender identity inconsistent with an individual’s sex conflicts with a soldier’s commitment to an honorable, truthful, and disciplined lifestyle, even in one’s personal life,” the EO issued in January said.
“A man’s assertion that he is a woman, and his requirement that others honor this falsehood, is not consistent with the humility and selflessness required of a service member,” the EO added.
This EO also banned people with “conditions that require substantial medication or medical treatment to bipolar and related disorders, eating disorders, suicidality, and prior psychiatric hospitalization.”
U.S. District Judge Ana Reyes, who was appointed by former President Joe Biden, put her ruling on hold until Friday to allow the Department of Justice to seek relief from the U.S. Court of Appeals for the District of Columbia Circuit.
Reyes said the transgender soldiers who are the plaintiffs in this case face their constitutional rights being violated.
“Indeed, the cruel irony is that thousands of transgender servicemembers have
sacrificed—some risking their lives—to ensure for others the very equal protection rights the
Military Ban seeks to deny them,” she wrote.
The defendants, which is the federal government, have not displayed how transgender individuals are “burdened by continuing the status quo pending this litigation, and avoiding constitutional violations is always in the public interest.”
A Gallup poll in February showed that 58 percent of people said America should allow openly transgender people to serve in its military. This support has decreased by 13 percentage points since 2019.
