Legal Expert Phill Kline: Congress Must Legislate Clearly to Avoid Legal Battles Derailing Trump’s Agenda

Phill Kline, former Kansas Attorney General and current law professor at Liberty University School of Law, said Congress is the central problem in many of the legal and constitutional battles facing the country today as lawmakers fail to address policy issues directly.

Kline, during an appearance on Wednesday’s edition of The Michael Patrick Leahy Show, argued that Congress is the root cause behind the legal challenges to President Donald Trump’s executive actions as lawmakers have stalled in passing clear, updated laws on issues like trade, immigration, and emergency powers – topics all of which Trump has acted on through executive actions.

Noting how many of Trump’s executive actions are being challenged by the courts, Kline said a solution to eliminating these legal challenges would be for Congress to “pass some simple reforms that codify the president’s efforts” when legal authority is in question.

“Many of these decisions are the Supreme Court interpreting congressional acts. The problem herein is Congress. Congress can eliminate many of these fights by passing some simple reforms that codify the president’s efforts,” Kline explained.

“He’s facing this issue as it relates to the exercise of his tariff power. Congress can constrain that power, and has through various acts. The president is trying to assert his authority under an emergency procedure claiming that there’s an economic emergency because of our trade deficits. That issue’s going before the court, while Congress could act today,” Kline added.

Kline criticized Congress for avoiding its constitutional responsibilities and delegating too much authority to the executive branch, which he explained leads to an imbalance of power and repeated judicial intervention.

“Congress has this power and throughout most of these cases, Congress can fix the problem, but they’re refusing to act,” Kline said.

Kline went on to emphasize that reforming the “deep state” is not enough, explaining that Congress itself must be restructured or reinvigorated to effectively fulfill its constitutional role.

“I think that this effort by the president to reform the deep state, so to speak, should be followed up with an effort by the president to reform Congress,” he said.

Kline further urged Trump to hold Congress accountable by putting political pressure on uncooperative members, suggesting that the president actively campaign in the districts of lawmakers who resist his key policy initiatives.

“I hope the president, once he gets done and gets the big, beautiful bill that he’s trying to get passed, decides to apply all of his persuasive force on reforming Congress. He needs to go into the districts of those congressmen that are not supporting the agenda and say, ‘Look, I am here to say I like such and such, but he’ll not return if he doesn’t vote this way and I’ll be back to ensure that you elect the right person.’ Congress is most of the problem here, not the courts,” Kline said.

    Anyone who has read our Constitution as well as The Federalist Papers knows that Congress has control over our courts. We have 3 separate branches but NOT equal. Even our Supreme Court can only give an opinion- not make laws or Executive decisions.

    This judicial law fare being carried out against a President, who only is doing all that THE PEOPLE sent him back into office to do, has to end!
