A petition asking President Joe Biden to appoint Dr. Carol Swain, an accomplished professor of law and Yale University graduate, to be the next United States Supreme Court Associate Justice has reached over 1,000 signatures in just one week.
“We, the undersigned, respectfully suggest – and fully support – Carol M. Swain, Ph.D. as your nominee to serve as the next Associate Justice on the United States Supreme Court,” the petition says.
Swain has four more degrees to go along with her master’s degree in law studies from Yale, including a Ph.D. from the University of North Carolina (UNC).
She joined The Star News Network’s CEO and Editor-in-Chief Michael Patrick Leahy earlier this week to discuss the petition.
“Well, you know, Michael, one of the most serious mistakes I think the Democrats and Republicans make is they sort of limit the pool disproportionately to the Ivy League,” she said on the show. “And I don’t care who they are, they’re indoctrinated in the Ivy League into a particular kind of way that they tend not to be trustworthy and we end up with Kavanaugh and Roberts and people [whose] decisions are so elitist – that they’re not connected with the rest of us.”
Swain is not only an expert in the field of law, but she meets Biden’s controversial standards for his planned appointee.
Biden said he will appoint a black woman to serve as the next associate justice, causing an uproar among conservatives.
Sen. Ted Cruz (R-TX) has been particularly outspoken about the race and sex criteria for the nomination.
“The fact that he’s willing to make a promise at the outset that it must be a black woman – I gotta say, that’s offensive,” Cruz said Saturday on his podcast. “Black women are, what, 6% of the U.S. population? He’s saying to 94% of Americans: ‘I don’t give a damn about you. You are ineligible.’”
Fox News contributor and George Washington University (GWU) law professor Jonathan Turley agreed.
“What’s astonishing is, this is not just unprecedented, but unnecessary, for the president to say that he would not consider any other candidate based on their race or gender. He would only consider black females,” he said. “You know, diversity issues have been raised by presidents in the past. But they have been raised as sort of preferences, not exclusionary rules. Indeed, the Supreme Court has declared exclusionary rules like this one to be unconstitutional or unlawful when applied to schools or businesses.”
Swain said she thinks Biden’s criteria are illegal.
“Well first of all, nominating a person on the basis of their race is a violation of the Civil Rights Act of 1964, so it’s racially discriminatory,” she told Leahy. “I think it probably violates the equal protection clause. And so we start off nominating a justice using unconstitutional means.”
