In response to President Joe Biden’s promise to nominate a black woman to replace outgoing Supreme Court Justice Stephen Breyer, a Monday petition was launched urging Biden to nominate legal expert and professor Dr. Carol Swain, PhD.
“We, the undersigned, respectfully suggest – and fully support – Carol M. Swain, PhD as your nominee to serve as the next Associate Justice on the United States Supreme Court,” the petition says.
“Dr. Swain is an extraordinary and accomplished former professor of political science and professor of law at Vanderbilt University,” the petition continues. “Before that, she was a tenured associate professor of politics and public policy at Princeton University’s Woodrow Wilson School of Public and International Affairs.”
Swain has five college degrees, including a PhD from the University of North Carolina (UNC), and a Master’s Degree in Law from Yale Law school. Her work has been cited in many court decisions, all the way up to the Supreme Court.
Swain joined The Tennessee Star’s CEO and Editor-in-Chief Michael Patrick Leahy on his radio show Monday morning to discuss the petition.
Noting that one does not have to have to be an attorney to serve on the Nation’s highest court, and despite her own Ivy League pedigree, she said both parties are making a mistake by almost exclusively appointing Justices from Ivy League schools.
“Well, you know Michael, one of the most serious mistakes I think the Democrats and Republicans make is they sort of limit the pool disproportionately to the Ivy League,” she said. “And I don’t care who they are, they’re indoctrinated in the Ivy League into a particular kind of way that they tend not to be trustworthy and we end up with Kavanaugh and Roberts and people that their decisions are so elitist – that they’re not connected with the rest of us.”
In the waning months of former President Donald Trump’s final term, he appointed Amy Coney Barrett to the Supreme Court, who notoriously did not attend an Ivy League school. She obtained her law degree from the University of Notre Dame.
On the subject of Biden’s nomination based on sex and race, Swain said the criteria are illegal.
“Well first of all, nominating a person on the basis of their race is a violation of the Civil Rights Act of 1964, so it’s racially discriminatory,” she said. “I think it probably violates the equal protection clause. And so we start off nominating a Justice using unconstitutional means.”

This appointment has nothing to do with being a good politician. It’s about who understands the Constitution which must be apolitical. If thry are putting politics into their decisions they don’t deserve the position!
Also, studying something and knowing how to apply what you study are two different things.
