Arizona Abortion Activists Sued to Keep ‘Unborn Human Being’ Off Referendum Because Term ‘Tinged with Anti-Abortion Sentiment’

An article published by the spokesperson for the group of Arizona activists who successfully gathered signatures for an abortion referendum, Prop. 139, explained the group sued to remove the phrase “unborn human being” from the November ballot because they view it as unscientific and “tinged with anti-abortion sentiment.”

The Louisiana Illuminator reported on Sunday that Arizona for Abortion Access spokesperson Chris Love told the outlet on August 16 they sought to replace the phrase “unborn human being” with “fetus,” describing it as “the scientific, medically-accurate language.”

Arizona for Abortion Access, a coalition looking to put legal access to abortion in the Arizona constitution, won their lawsuit against the Arizona Legislative Council over the language in a voter guide that will accompany their ballot measure.

On July 3, Arizona for Abortion Access successfully submitted enough signatures, over 823,000, to put the abortion measure on the November ballot for voters to decide whether abortion access should be enshrined in the Arizona constitution.

Arizona has avoided potential abortion law confusion with the conclusion of the legislative session.

Since the session concluded on Saturday night, all normal legislation without an emergency clause signed by Gov. Katie Hobbs will go into effect on Sept. 14. This also includes the May repeal of the abortion law that was created in 1864 and re-codified in 1977 that banned abortion in nearly all circumstances.
