DeSantis Admin Says Private Schools, Colleges Must Use Bathrooms on Basis of Biological Sex

The Florida Board of Education (BOE) voted Wednesday to require restrooms in private K-12 schools and state colleges to be used on the basis of biological sex rather than gender identity, according to the Tallahassee Democrat.

The new rule requires all institutions within the Florida College System to alert the Florida BOE if their bathrooms and locker rooms within instructional spaces and dormitories are separated on the basis of biological sex rather than gender identity, according to the Tallahassee Democrat. If violations of the policy are reported, institutions must have an investigation process that determines disciplinary actions, such as termination, under the rule.

America First Legal is demanding answers after the Justice Department under President Joe Biden intervened in a Virginia school district’s adoption of Gov. Glenn Youngkin’s policies that center parental rights in transgender issues.

“The Department of Justice seems to suggest that protecting the constitutional rights of parents and students will lead to ‘hate crimes,’” Ian Prior, senior adviser at America First Legal, told The Daily Signal in a written statement Monday. “Once again, we are witnessing the top law enforcement organization in the land come unglued from reality and unmoored from its core functions, all in the name of opposing anyone that doesn’t approve of its state-approved message.”

Largest Virginia School District Defies Gov. Youngkin’s Guidance on Bathrooms, Pronouns

Virginia’s largest school district announced Tuesday that it will be defying guidance from Republican Gov. Glenn Youngkin’s administration that requires students to use bathrooms on the basis of biological sex, rather than gender identity, according to a press release.

The Virginia Department of Education released a final version of its model policies for the state’s public schools in July that requires teachers to use a student’s biological name and pronouns unless given written permission by a parent to use something else. Fairfax County Public Schools said it does not plan to adopt the state guidance after determining that the district policies are in line with federal and state anti-discrimination laws, according to a press release.

Florida Bill Could Require Trans People to Use Bathrooms According to Biological Sex

Florida legislators passed a bill Wednesday that, if signed by Republican Florida Gov. Ron DeSantis, will require people to use facilities according to their biological sex in certain public restrooms.

Individuals who use opposite-sex facilities and refuse to leave when asked could be charged with criminal trespassing under the new legislation, which LGBT activists have characterized as anti-transgender. It would apply to K-12 schools, government buildings, prisons and detention centers.

Caldwell School Board put its gender identity policy on hold on Monday after community backlash caused a previous meeting to abruptly end. The pause comes as Idaho’s Senate Education Committee introduced legislation that would require Idaho students to use bathrooms and locker rooms on the basis of biological sex, according to KTVB 7.

Arizona State University Student Finds Urinal in Women’s Restroom

An Arizona State University (ASU) student who serves as vice chair of the East Valley Young Republicans discovered a urinal in a women’s restroom and asserted ASU is “putting men’s urinals in the women’s restroom!”

Rachel Hope tweeted on Jan. 26, “ASU caves to the far left by putting men’s urinals in the women’s restroom!! 🤢🤡.” Along with the tweet she displayed a video of entering a women’s restroom and encountering a urinal inside a stall next to a toilet.
