At two minutes a ballot, the team will barely finish in time to slip away before the early shift opens the building so the sheriff’s deputy can load the boxes to transport for final counting. Suddenly the snap of a light switch drowns the flashlight beams in merciless fluorescent light. The conspirators freeze as a pair of legs descends the stairs. “What are you doing?” A voice asks, half puzzled and half accusing. “Making corrections.” One of the workers responds as he brushes No. 2 pencil eraser crumbs from a ballot. “This is a waste of time.” The consultant tells the workers. “I have a better way.” Such is the scene that might play out in the hours after a future presidential election. Motivation, context, identity, matter not at all. You violate it, you are guilty and are punished accordingly. Here it is: (a) Whoever knowingly and willfully communicates, furnishes, transmits, or otherwise makes available to an unauthorized person, . . . any classified information— (1) concerning the nature, preparation, or use of any code, cipher, or cryptographic system of the United States or any foreign government; or (2) concerning the design, construction, use, maintenance, or repair of any device, apparatus, or appliance used or prepared or planned for use by the United States …or (3) concerning the communication intelligence activities of the United States or any foreign government; or (4) obtained by the processes of communication intelligence . . . Under intense questioning by Representative Trey Gowdy (R-S.C.) in May 2017, Brennan squirmed and stammered and twirled his pen as Gowdy demanded to know why the former CIA chief concluded in mid-2016 that the Trump campaign was conspiring with the Russians to manipulate the outcome of the presidential election. “I encountered and am aware of information and intelligence that, um, revealed contacts and interactions between Russian officials and U.S. persons involved in the, uh, Trump campaign that, um, I was concerned about because of known Russian efforts to suborn such individuals and it, uh, raised questions in my mind, again, whether or not the Russians were able to gain cooperation of those individuals,” Brennan told the House Intelligence Committee. He rambled on: “I don’t know whether or not such ‘collusion,’”—Brennan used air quotes—”and that’s your term, existed. I don’t know. Commentary: Eight Historic Cases That Show the FBI and CIA Were Out of Control Long Before Russiagate

Second, they tend to instinctively give law enforcement the benefit of the doubt. These tendencies help explain why conservatives for decades have been able to overlook the many abuses—constitutional, legal, and moral—of US intelligence agencies. Judge Blocks Use of Guantanamo Bay Detainees’ Statements to FBI Interrogators

In the U.S. case against five Guantanamo detainees who are accused of aiding in the Sept. 11, 2001, terror attacks, a military judge has ruled that prosecutors may not use statements the detainees made to FBI interrogators after they were removed from a secret CIA prison. Army Colonel James Pohl, the judge for the proceedings, ruled on Friday that the detainees’ statements, made to FBI “clean teams,” were not to be used in the death penalty trial. The detainees had been interrogated while being held in a network of secret overseas prisons run by the Central Intelligence Agency (CIA). After the detainees were transferred to the Guantanamo detention center, an FBI “clean team” — agents who were not privy to the detainees’ previous statements or interrogations — again questioned the detainees. Defense attorneys had argued that the detainees’ statements to the Federal Bureau of Investigation (FBI) could have been tainted by the previous interrogations. As part of their defense, the attorneys had sought to investigate the conditions under which the CIA had interrogated the accused men. President Trump said Friday he plans to revoke the security clearance of Bruce Ohr, a Justice Department official whose wife was employed at the company that was involved in producing the dossier on Trump’s links to Russia. Trump called Ohr a “disgrace” outside the White House and said, “I suspect I will be taking it away very quickly.” Ohr is under intense Republican scrutiny for his contacts with Glenn Simpson, who co-founded the opposition research firm Fusion GPS. The president also suggested he may revoke Special Counsel Robert Mueller’s security clearance, and said, “Mr. Mueller has a lot of conflicts also, directly himself.” Trump said, nevertheless, that Mueller should be allowed to finish a report on Russia’s interference in the 2016 U.S. presidential election. The clearances of other former officials also are under review, including those of former National Intelligence Director James Clapper, former FBI Director James Comey, former Obama administration National Security Adviser Susan Rice, former National Security Agency Director Michael Hayden and former Deputy Attorney General Sally Yates. “Security clearances for those who still have them may be revoked, and those who have already their lost their security clearance may not be able to have it reinstated,” White House Press Secretary Sarah Sanders said to reporters on Wednesday, reading out the statement in the president’s name. Our friend Sara Carter reports the Kentucky Senator later took to Twitter and wrote, “Just got out of WH meeting with @RealDonald Trump. by Chuck Ross   The Senate Select Committee on Intelligence is endorsing a January 2017 report from three intelligence community agencies that found the Russian government, with the approval of Vladimir Putin, attempted to influence the 2016 election. The Senate panel released a summary report on Tuesday, two weeks before President Trump is poised to meet with Putin in Finland. “The Committee finds that the overall judgments issued in the [Intelligence Community Assessment] were well-supported and the tradecraft was strong,” reads the Senate Intel’s unclassified summary report. “The course of the Committee’s investigation has shown that the Russian cyber operations were more extensive than the hack of the Democratic National Committee and continued well through the 2016 election.” On Jan. 6, 2017, the Office of the Director of National Intelligence released a report known as the Intelligence Community Assessment [ICA] that reviewed Russia’s efforts to meddle in the 2016 election. The Crisis of Confidence in the United States’ Intelligence Community Reaches New Heights

The American people are losing confidence in the bureau. FBI Deputy Director David Bowdich stated in January, “When I look through the prism of risk for our organization, I find the No. 1 risk for our organization is losing the faith and confidence of the American people.” The FBI has reason to be fearful because public trust in the institution is headed in the wrong direction. A recent poll by Axios showed that less than half of America had confidence in the FBI, with only 38 percent of Republicans having faith in the bureau. This should be extremely worrying to any prosecutor using the FBI’s evidence or agents as a witness at a trial — and a dream for any defense attorney. Half the jury pool has an unfavorable opinion of the feds, and recent revelations about the once revered law enforcement agency are sure to increase the unfavourability.
