Virginia Governor Youngkin Aims His First Veto at Arlington County Civilian Review Board

Governor Glenn Youngkin vetoed a bill for the first time, he announced Tuesday. Delegate Patrick Hope’s (D-Arlington) HB 670 would have authorized counties operating under a county manager plan to hire an independent policing auditor to oversee its civilian review board; the bill passed out of the Senate along party lines, and out of the House of Delegates with some bipartisan support. Arlington County is the only Virginia county operating under the county manager plan.

“The best way to ensure that any bad actors within law enforcement are held accountable is to stand up for law enforcement, not tear them down or subject them to politically motivated inquiries,” Youngkin said in the press release.

City of Phoenix Sues Arizona over New Laws on Police Review Boards and Broadening Attorney General’s Investigative Powers

The City of Phoenix filed a lawsuit against the State of Arizona on Tuesday, contending that new legislation regulating police review boards and expanding the Attorney General’s powers of investigation violates the state constitution. HB 2893 requires that the members of police misconduct boards be partially composed of police officers, but the City set up its own review board a month before the legislation was passed which says police officers or former police officers shall not sit on its police review board. 

Similarly, the City objects to the qualifications laid out in the law for civilian review boards; the City merely wants non-City employees serving on it, but the legislation requires that board members have some training. And finally, the City objects to a provision which states that when requested by a legislator, the Attorney General may investigate laws or rules passed by lower levels of government that appear to violate state law, and withhold state funding if a violation is found.

Bill Giving AG Increased Authority to Investigate Patterns of Misconduct by Police Signed into Law

Governor Ralph Northam signed a bill into law on Wednesday that gives the state attorney general additional powers to investigate unlawful patterns or practices by law enforcement officers and file civil action to stop the misconduct.

Introduced by Sen. Louise Lucas (D-Portsmouth), Senate Bill 5024 was one of several bills approved by the governor this week.

Legislation Allowing Localities to Establish Law Enforcement Civilian Review Boards Heads to Governor’s Desk

Compromised legislation that gives localities the authority to establish law enforcement civilian review boards (CRB) successfully passed final votes in the Senate and House of Delegates Wednesday afternoon, and now goes to the governor’s desk for final approval.

Joint conference committee reports for Senate Bill 5035 passed the Senate (21-Y 17-N) and for House Bill 5055 passed the House (53-Y 35-N), mostly along the party lines of both chambers.
