Montana’s Race And Sex-Based Requirements for Key Medical Board Are Unconstitutional, Lawsuit Alleges

A medical watchdog sued the Montana governor Tuesday over race and sex-based requirements for the state’s top medical board.

The lawsuit was filed by the Pacific Legal Foundation (PLF), a public interest law firm, on behalf of Do No Harm (DNH), a medical activist organization, in the United States District Court for the District of Montana Helena Division against Republican Montana Gov. Gregory Gianforte. The PLF is representing an unidentified woman affiliated with DNH who cannot apply to the Montana Board of Medical Examiners due to the sex-based requirements, which PLF alleges violates the Equal Protection Clause of the Constitution, according to a DNH press release.

University of Michigan Spending on ‘Diversity’ Grew 66 Percent in One Year

The University of Michigan’s (UM) spending on diversity, equity and inclusion (DEI) increased about 66% from the 2022-2023 school year, according to an analysis by Mark Perry, a senior fellow at Do No Harm.

The school’s DEI payroll for the 2022-2023 school year came in at $18 million, but increased to over $30 million for the 2023-2024 academic year, according to Perry’s analysis. UM’s DEI department had 132 full-time diversity employees in the 2022-2023 school year and now has over 300.

Med Schools Redo ‘Diversity’ Programs After Federal Complaints

Several medical schools across the nation have recently amended or scaled back diversity, equity and inclusion programs and policies after they were flagged by Do No Harm, a medical advocacy group that seeks to push back against declining meritocratic standards and DEI encroachments in med school curricula.

The watchdog organization has filed more than 140 complaints with the Department of Education’s Office for Civil Rights within the last two years, and nearly 40 investigations have been opened so far, with 30 still active, according to a spokesperson.

Gov. Kristi Noem (R-SD) signed legislation Monday that protects minor children and teens from experimental puberty blockers, cross-sex hormones, and mutilating irreversible surgeries for the treatment of gender confusion.

Utah Governor Spencer Cox (R) signed a bill last week prohibiting gender transition surgeries and puberty blockers for minors in most situations.

Cox signed the Transgender Medical Treatments and Procedures Amendments (SB 16), introduced by State Senator Mike Kennedy (R), a physician, which bans “permanent and life-altering” gender transition treatments for minors as well as puberty blockers for patients not already diagnosed with gender dysphoria.

Med School Trained Faculty to Admit, Address Their Own Racial ‘Bias’

The University of Utah School of Medicine reportedly trained its faculty to acknowledge their own biases through diversity, equity and inclusion training modules, according to documents obtained through a Freedom of Information Act (FOIA) request by the medical watchdog group Do No Harm.

Do No Harm obtained three training presentations which were used between 2021-2022 to train faculty members about how to incorporate diversity, equity and inclusion in the workplace. The trainings instructed faculty to understand their own biases and lectured the school on using affirmative action practices to increase minority hires.

University of Iowa Trains Committee to Hire Faculty Based on Diversity, Equity And Inclusion Standards

The University of Iowa Office of the Provost trained its Faculty Search Committees to interview candidates through diversity, equity and inclusion (DEI) lenses, documents obtained by Do No Harm through a Freedom of Information Act (FOIA) and shared with the Daily Caller News Foundation revealed.

A training given to the Department of Pediatrics at UI’s medical school broke down different types of implicit biases and provided a list of practices committee members could follow to limit bias in hiring decisions, which included having a diverse committee that is trained and use “accountability strategies,” spending 15-20 minutes on each candidate and evaluating through standard criteria, the documents show. Committee members were also taught to “grade” prospective candidates after an interview rather than use a ranking system and to evaluate whether they made biased decisions if “women and people of color” were not advancing.
