Virginia Court Denies Chincoteague Church Lawsuit Over Northam’s Executive Orders

A U.S. District Court has dismissed a lawsuit by Chincoteague Lighthouse Fellowship Church against Governor Ralph Northam. In April 2020, the church sued over Northam’s Executive Orders 53 and 55, which limited gathering sizes to 10 and issued a stay-at-home order. But in a January 27 decision, Judge Arenda Wright Allen dismissed the suit, saying that the complaint was moot since those executive orders no longer stand.

Virginia House Public Safety Subcommittee Killing Bills Limiting Executive Order Power

  Delegate Kirk Cox’s House bill limiting the length of executive orders will likely die in committee after a Public Safety subcommittee recommended tabling the bill. HB 2087, if passed, would limit the length of Governor Ralph Northam’s executive orders to just 45 days unless the General Assembly passes an extension. Delegate Les Adams (R-Chatham) filed a similar bill, HB 2149, that would have limited the length of executive orders to 60 days, but the subcommittee also recommended that it be tabled. “House Bill 2087 will curb the governor’s authority to declare long-lasting states of emergency without proper legislative oversight,” a Cox press release states. In the subcommittee on Thursday, Cox said, “The governor’s probably issued around 21 or 22 executive orders even with COVID-19. Several of his were of an indefinite nature and several have obviously been amended. And I think regardless of party, you’ve got to be concerned about that. We’re an equal branch of government and I think there are rare circumstances where a governor should have unchecked power for months.” Adams first filed his bill during the 2020 special session, where it was also killed in committee. Appomattox County Kills First Amendment Sanctuary Resolution

The Appomattox County Board of Supervisors declined to vote on a First Amendment Sanctuary resolution at a Monday night meeting. Multiple members of the board said that they share concerns over Governor Ralph Northam’s executive orders, but they said the board does not have the authority to enforce the resolution or to protect Appomattox County citizens from state-level enforcement of the executive orders. With no one willing to second Supervisor John Hinkle’s motion to vote on the resolution, the motion died.

Bedford Supervisor: No Shutdown Resolution Has Good Intentions but Oversteps Authority

Their presence alone was a protest — Bedford County residents turned out to support a No Shutdown resolution at the Monday Board of Supervisors (BOS) meeting. The amount of people present exceeded the 25 person capacity from Governor Ralph Northam’s executive orders. However, BOS Chairman John Sharp told supporters that the resolution had never been on the agenda, and the BOS decided to not make a last minute change to that agenda. Nevertheless, Sharp expressed support for the ideas behind the resolution.

Virginia Gov. Ralph Northam Executive Order Limiting Crowd Sizes Forces Cancelation of the Nation’s Gun Show

Organizers have canceled The Nation’s Gun Show scheduled to be held at the Dulles Expo Center this weekend after Governor Ralph Northam announced new group size restrictions at the end of last week. The organizers sued Northam and asked for an injunction that would allow them to hold the event, arguing that Northam’s emergency powers do not include the power to infringe the Second Amendment. However, the court denied the request for an injunction.
