A federal moratorium on evictions ended on Saturday night, giving landlords the ability to remove tenants who have not paid their rent.
In Florida, a Zillow forecast estimates that there are currently 144,220 households that rent their homes or apartments and may be at risk of getting evicted. This is 9,879 more than last month. The analysis indicates 357,194 renter households in Florida are currently behind on rent, 48,969 less than in June.Read More
A federal lawsuit was filed Monday in Tampa by statewide real-estate group Florida Realtors, and Pinellas County based real-estate firm, R.W. Caldwell Inc. that challenges the federal moratorium implemented by the Centers for Disease Control and Prevention (CDC).
The moratorium established by the CDC was originally issued in September 2020 and was meant to expire by December 31st , 2020. The expiration date has since been extended three times, with the new expiration date on June 3oth, 2021. A federal judge in Washington D.C. ruled on Wednesday that the Centers for Disease Control (CDC) does not legally have the authority to uphold a federal freeze on evictions due to the coronavirus pandemic, according to ABC News.
The ruling was made by Judge Dabney Friedrich of the D.C. Circuit Court, who subsequently ordered that the CDC and the Department of Health and Human Services (HHS) vacate the policy. The eviction moratorium, which had been in place since it was first implemented last year under the Trump Administration, was meant to assist those who have been unable to pay rent due to the shutdown of small businesses, forbidding landlords from evicting such tenants until said tenants can return to work and start paying their rent again.Read More
