Grand Canyon University Wins Nonprofit Status Lawsuit Against Department of Education

The U.S. Department of Education (ED) may soon recognize Grand Canyon University’s nonprofit status after the Court of Appeals for the Ninth Circuit remanded the school’s case back to the department.

The university announced that “in a significant win for Grand Canyon University, the United States Court of Appeals for the Ninth Circuit, in a 3-0 decision, held that the U.S. Department of Education (ED) acted unlawfully by applying the incorrect legal standard in determining GCU’s nonprofit status and remanded the case back to ED.”

U.S. Representatives Paul Gosar (R-AZ-09) and Andy Biggs (R-AZ-05) are pushing back against the Biden administration’s record $37.7 million fine of Grand Canyon University (GCU), calling the Department of Education “weaponized” in its “targeted” attack of the Christian school.

The six-term congressman told The Arizona Sun Times, on Tuesday “GCU is being targeted for its religious views and for being the largest Christian university in the country. The Department of Education should recognize GCU’s lawful nonprofit status and stop the harassment.”

Feds Refuse to Drop $37 Million Fine, Lawsuit Against GCU Despite Audit Finding No Fault with Christian School

A state auditor’s office recently completed a review that found no proof there is any wrongdoing on the part of Grand Canyon University, but two federal agencies are continuing with their campaigns against the Christian university despite the findings.

The Arizona State Approving Agency, an arm of the state’s Department of Veteran Services, issued a determination Feb. 20 that risks identified by “court actions by the government” could not be substantiated, which means the private nonprofit’s students can still use GI bill funding to pay tuition.

A Grand Canyon University student says she has not been allowed to offer her opinions in class while her econ textbook is full of them.

Elizabeth Olson sent excerpts of the book, “Essentials of Economics” by Gregory Mankiw, to The College Fix and a syllabus showing it is being used for assignments and discussions throughout the course at the private Christian Arizona university.

A recent risk-based audit of Grand Canyon University conducted by the Arizona State Approving Agency (SAA) for the U.S. Department of Veterans Affairs did not “show any findings” related to the institution’s doctoral disclosures, which have been targeted by the Biden administration’s Federal Trade Commission (FTC) through a $37.7 million fine.

Goldwater Institute Sues Department of Education over ‘Unprecedented’ $37 Million Fine Assessed Against Arizona’s Christian Grand Canyon University

The Goldwater Institute (GI) sued the U.S. Department of Education last week over fining Grand Canyon University (GCU) almost $40 million.

The fine was purportedly for “insufficiently inform[ing] PhD students that they may have to take continuing courses while completing their doctoral dissertations,” GI said in a press release. GI noted that the $37 million fine against the Christian university “is 10 times bigger than penalties the Education Department assessed against Penn State and Michigan State for covering up the sexual crimes of Jerry Sandusky and Larry Nassar.”
