D.C. Bar Disciplinary Panel Makes Nonbinding Preliminary Determination of Culpability for a ‘Thought Crime’ in Disbarment Trial of Trump’s Former DOJ Official Jeffrey Clark

The disciplinary trial of Donald Trump’s former DOJ official Jeffrey Clark wrapped up on Thursday with the D.C. Bar’s disciplinary panel making a nonbinding preliminary determination that Clark was culpable on at least one of the two counts against him.

For drafting a letter that was never sent to Georgia officials advising them of their options in dealing with the 2020 election illegalities, he was charged with engaging in conduct involving dishonesty, fraud, deceit, or misrepresentation, and engaging in conduct that seriously interferes with the administration of justice, Rules 8.4(c) and (d) of the Rules of Professional Conduct.

The second and final week of the disbarment trial of Donald Trump’s former DOJ official began to wind down on Wednesday with more testimony from operations security expert Harry Haury. Clark, who is also a defendant in Fulton County District Attorney Fani Willis’ RICO prosecution, is being disciplined for drafting a letter that was never sent to Georgia officials after the 2020 election advising them of their options for dealing with the election illegalities.

The trial is expected to wrap up on Thursday with closing statements.

Disbarment Trial of Trump’s Former DOJ Official Jeffrey Clark Features Stonewalling by D.C. Bar’s Attorney

The disbarment trial of Donald Trump’s former DOJ official Jeffrey Clark began last week, featuring testimony from several prominent statisticians. Clark, who is also a defendant in Fulton County District Attorney Fani Willis’s RICO prosecution, is being disciplined for drafting a letter that was never sent to Georgia officials after the 2020 election advising them of their options for dealing with the election illegalities. The trial is expected to last two weeks, into this coming week.

Hamilton Fox, the D.C. Bar’s attorney who has aggressively gone after other Trump attorneys, attempted to keep most of Clark’s witnesses from testifying. He described them as “sketchy witnesses” who want to talk about “supposed irregularities.” However, one of the witnesses who ultimately testified on Thursday had been allowed to testify in the similar disbarment trial of Trump’s former attorney and constitutional legal scholar John Eastman last year.

Fulton County Superior Court Judge Scott McAfee heard arguments last week from defense attorneys about why Fulton County District Attorney Fani Willis should be disqualified from her RICO case against former President Donald Trump and his associates.  

Willis had an affair with Nathan Wade, the prosecutor she appointed to lead the case. This caused attorneys, including Harry MacDougald, who represents Jeffrey Clark, to list six conflicts of interest she faces in a presentation to the court.

D.C. Court of Appeals Panel Gives Trump’s Former DOJ Official Jeffrey Clark a Unanimous Victory on Subpoena Violating His Fifth Amendment Rights

A panel of the D.C. Court of Appeals ruled unanimously on Monday that the D.C. Bar’s Office of Disciplinary Counsel (ODC) unconstitutionally subpoenaed documents from former President Donald Trump’s former DOJ official Jeffrey Clark in violation of his Fifth Amendment rights.

In addition to facing ODC disciplinary charges for his role in assisting Trump in handling the 2020 presidential election irregularities, Clark was indicted along with Trump and others in Georgia and is an unnamed co-conspirator in another case. The court issued its decision immediately after a hearing on Friday.

Former Trump DOJ Official Jeffrey Clark Appeals Denial of Removal of Bar Disciplinary Trial to Federal Court

Jeffrey Clark, an attorney who served at high levels of the Department of Justice under former President Donald Trump, is undergoing both prosecution and bar disciplinary proceedings for his slight involvement with the 2020 election challenges. The District of Columbia Bar, its disciplinary panel, and the federal trial court judge refused to let Clark remove the disciplinary proceedings to federal court, despite the fact there is a federal law providing for removal when the actions in question involve a federal official, so Clark filed an appeal with the D.C. Court of Appeals on Thursday.

Clark is being disciplined and prosecuted for drafting a letter to Georgia election officials after the 2020 election advising them of options the Georgia Legislature could take to address the concerns about election illegalities. The letter was never sent or even circulated.

Attorneys for Jeffrey Clark are asking Fulton County Superior Court Judge Scott McAfee to dismiss the charges against their client in a filing on Wednesday. District Attorney Fani Willis charged Clark in her sweeping racketeering case against former President Donald Trump.

At the time of the 2020 election, Clark was the acting assistant attorney general for the Civil Division of the Department of Justice. After the election, Clark twice attempted to send a document expressing concerns about possible election malfeasance in battleground states. Willis claims Clark’s unsuccessful attempts to send this document were illegal, and even though Clark had no contact with Georgians during the 2020 election contest, his efforts constitute a violation of the Georgia RICO Act and a criminal attempt to commit false statements and writings.

Former Trump DOJ Attorney Urges D.C. Bar to Delay His Disbarment Trial Pending Georgia RICO Prosecution with Trump

Jeffrey Clark, an attorney who served at high levels of the Department of Justice under President Donald Trump, including briefly as acting Attorney General, has been indicted by Fulton County District Attorney Fanni Willis along with Trump in the racketeering case over the 2020 election challenges, and charged with dishonesty and attempting to interfere with the administration of justice by the District of Columbia Bar. The charges in both relate to a memo Clark drafted about 2020 election irregularities in Georgia addressed to Georgia officials that was never sent. His bar disciplinary trial is scheduled for January, but he has been attempting to postpone it until after the criminal proceedings are finished.

On Thursday, the District of Columbia Court of Appeals Board on Professional Responsibility held a hearing to consider his deferral request. The court is expected to issue a ruling shortly.

Mark Meadows Argues Fani Willis ‘Committed Errors’ in ‘Unnecessary’ Effort to Keep Case in Fulton County

Mark Meadows, the former White House Chief of Staff for the Trump administration, argued in a Monday legal filing that Fulton County District Attorney Fani Willis “committed errors” that raise “serious constitutional concerns” in her “unnecessarily complicated” attempts to prevent his case from being removed to a federal court.

Meadows has repeatedly asserted the case brought against him by Fulton County should be tried in a federal court, citing his position as a government employee who answered directly to former President Donald Trump when his alleged offenses were committed. U.S. District Court Judge Steve Jones denied various attempts from Meadows to remove the case, but late last week the 11th Circuit announced it would hear his appeal and grant it expedited status.

Republicans Condemn FBI Seizure of Pennsylvania Congressman Scott Perry’s Phone

One day after the Federal Bureau of Investigation searched former President Donald Trump’s Palm Beach home on Monday, agents seized the cell phone belonging to U.S. Rep. Scott Perry (R-PA-10), eliciting outrage on his side of the political aisle.

The FBI has refused to comment on the investigation, leaving it presently uncertain what messages or other data the bureau seeks to obtain from the lawmaker’s device. Perry, who represents Harrisburg, York and surrounding communities, has been at odds with Congress’s Democratic majority and Joe Biden’s White House over investigations related to the January 6, 2021 riot and Capitol Building breach. The U.S. House select committee probing the event issued a subpoena to the congressman with which he declined to comply.

Feds Raid the Home of Former Trump DOJ Official Who Wanted to Investigate Allegations of Voter Fraud

In a pre-dawn raid Wednesday, armed federal law enforcement agents searched the home of Jeffrey Clark, a former Trump Justice Department official who has emerged as a central figure in the partisan House Select Committee’s investigation into the January 6 riot.

Clark’s name was expected to come up in the Jan. 6 Committee hearing on Thursday.
