Ohio Ballot Board Approves Condensed Version of Abortion Amendment for November Election

The Ohio Ballot Board on Thursday rejected using the full text of a proposed amendment for the November ballot that would enshrine abortion into the state Constitution, instead adopting a condensed version of the text written by the Ohio Secretary of State’s Office.

The board approved the condensed language, now titled Issue 1 for the November general election, in a 3-2 split decision. The board can decide to use the full text of the proposed amendment or use a condensed version of the text for the ballot language.

A coalition of pro-abortion activists on Monday submitted proposed ballot language to the Ohio Ballot Board for consideration on a proposed amendment for the November ballot that would enshrine abortion into the state Constitution.

The Ohioans for Reproductive Freedom, a coalition of radical pro–abortion activists that includes Planned Parenthood, Pro–Choice Ohio, the Abortion Fund of Ohio, the American Civil Liberties Union (ACLU) of Ohio, along with the Ohio Physicians for Reproductive Rights has proposed “The Right to Reproductive Freedom with Protections for Health and Safety” which would add a Section 22 to Article 1 of the state Constitution.

Ohio Supreme Court Rejects Lawsuit to Block Abortion Amendment from November Ballot

The Ohio Supreme Court has rejected a lawsuit filed by a group of pro-life advocates requesting that they block a proposal that aims to enshrine abortion into the state constitution from the November ballot.

All of the seven Supreme Court justices dismissed the lawsuit brought by former state Representative Tom Brinkman from Cincinnati and former legislative candidate Jennifer Giroux who say that that the Ohio Supreme Court should block the proposal as the submitted signature petitions to get on the ballot fails to specify which state laws would need to be abolished if voters approved the constitutional amendment.

The Ohio Secretary of State’s Office certified on Tuesday the petitions submitted by a coalition of pro-abortion activists who want Ohioans to vote in November on a proposed amendment that would enshrine abortion into the state Constitution.

Ohio Pro-Abortion Activists Submit Signatures for November Ballot Initiative

A group of pro-abortion activists delivered thousands of signatures to the Ohio Secretary of State’s office on Wednesday in an attempt to put an amendment to enshrine abortion into the state constitution on the ballot in November.

The Ohioans for Reproductive Freedom, a coalition of radical pro-abortion activists that includes Planned Parenthood, Pro-Choice Ohio, the Abortion Fund of Ohio, the American Civil Liberties Union (ACLU) of Ohio, along with the Ohio Physicians for Reproductive Rights submitted 710,131 signatures to the Secretary of State’s office before the deadline to go before voters in November.

Ohio Secretary of State LaRose: Abortion and Marijuana Legalization Efforts Will Make the November Ballot

Ohio Republican Secretary of State Frank LaRose, who is an undeclared candidate for the U.S. Senate, told The Ohio Star that he thinks that the abortion and marijuana legalization efforts in the state will both obtain enough signatures to get on the November 2023 ballot.

“Both efforts are very well funded and it wouldn’t shock me if they are able to get the adequate number they need to get on the November ballot,” LaRose told The Star.

Ohio Supreme Court Upholds Ballot Board Decision Advancing Amendment to Enshrine Abortion in State Constitution

On Thursday, the Ohio Supreme Court issued a ruling that upholds the Ohio Ballot Board’s unanimous decision that the proposed constitutional amendment called “The Right to Reproductive Freedom with Protections for Health and Safety,” incorporated only one constitutional amendment.

The Court’s 7-0 ruling rejects a lawsuit by Margaret DeBlase of Montgomery County and John Giroux of Hamilton County claiming that the Ohio Ballot Board erred in its decision and that the proposed amendment contains multiple topics.

The ad, entitled “All Our Kids,” is the third 60-second digital advertisement released in a series by Protect Women Ohio, aimed at defeating Ohio’s pro-abortion, anti-parent amendment, championed by the leftist organization the ACLU.

Ohio Governor DeWine Calls on Lawmakers to Consider Strengthening ‘Heartbeat Law’ Ahead of Potential Vote on Abortion Amendment

In advance of a potential November referendum on an proposed constitutional amendment aiming to legalize abortion throughout the state, Ohio Governor Mike DeWine said he wants the General Assembly to consider strengthening Ohio’s “heartbeat law.”

According to DeWine, to avoid passage of the abortion amendment, Ohio needs to revisit the heartbeat law and ensure that Ohio has sustainable legislation that voters will not overturn at the polls.

Ohio Ballot Board Requests State Supreme Court to Dismiss Abortion Amendment Lawsuit

The Ohio Ballot Board requested that the Ohio Supreme Court dismiss a lawsuit claiming that it erred in a decision to advance a proposed constitutional amendment to legalize abortion throughout the state.

Ohio Attorney General Dave Yost wrote a brief on behalf of the ballot board saying that the relators “fail to state a claim upon which relief can be granted” and the relators “do not have a clear legal right to the relief sought.” Additionally, the Ohio Ballot Board requested that the judge dismiss the relators’ claims.

The Ohio Supreme Court set a schedule on Tuesday for briefs and evidence in a lawsuit claiming that the Ohio Ballot Board erred by approving a proposed abortion constitutional amendment as one issue.

Earlier this month, the Ohio Ballot Board unanimously certified that the proposed constitutional amendment by the Ohioans for Reproductive Freedom, a coalition of radical pro-abortion activists that includes Planned Parenthood, Pro-Choice Ohio, the Abortion Fund of Ohio, the American Civil Liberties Union (ACLU) of Ohio, along with the Ohio Physicians for Reproductive Rights that would legalize abortion throughout the state called “The Right to Reproductive Freedom with Protections for Health and Safety,” incorporated only one constitutional amendment and therefore advanced to the signature gathering stage.

Ohio Residents Ask Ohio Supreme Court to Split Abortion Constitutional Amendment Proposal into Multiple Issues

On Monday, two Southeast Ohio residents asked the state Supreme Court to overturn the Ohio Ballot Board’s decision last week to advance a proposed constitutional amendment that would legalize abortion throughout the state.

According to the lawsuit, the Ohio Ballot Board erred last week when it decided that the proposed amendment contained only one issue, when it actually contained two or more. A proposal including more than one amendment would need to be divided into separate issues under Ohio law.

On Monday, the Ohio Ballot Board unanimously certified that the proposed constitutional amendment that would legalize abortion throughout the state called “The Right to Reproductive Freedom with Protections for Health and Safety,” incorporates only one constitutional amendment and therefore advances.

The Ohioans for Reproductive Freedom, a coalition of radical pro-abortion activists that includes Planned Parenthood, Pro-Choice Ohio, the Abortion Fund of Ohio, the American Civil Liberties Union (ACLU) of Ohio, along with the Ohio Physicians for Reproductive Rights, must now gather over 413,000 signatures from registered voters in at least 44 counties, which equals 10 percent of the votes cast in the most recent gubernatorial election before July 5th. The amount of signatures must equal at least 5 percent of the votes cast in the most recent gubernatorial race in each county.

Existing Ohio Law Protecting Unborn Babies Blocks FDA Approval of Pharmacy Distribution of Abortion Pills

The “Abortion Pill,” also known as RU-486, could previously only be prescribed by medical professionals in the United States. The Federal Drug Administration (FDA) has officially authorized pharmacy distribution of RU-486, but an Ohio law passed in 2004 forbids pharmacies from distributing these harmful pills.

The drug, commonly known as Mifepristone, has recently received FDA approval, and retailers like Walgreens and CVS across the U.S. have already declared they will stock it. In Ohio however, only doctors with specific training and certification can offer, sell, dispense, or administer the drugs.

Ohio Senate Republicans Aim to Clarify Women’s Health Exemptions on Six-Week Abortion Ban

Senate President Matt Huffman (R-Lima) said after feedback from medical professionals, Republicans in the Ohio Senate are working to clarify language on the six-week limits on  abortion.

According to Huffman, they are working to clarify definitions regarding the health and life of the mother. The new limit known as the “heartbeat bill,” prohibits most abortions after a fetal heartbeat can be detected, which is at about six weeks of pregnancy.

Hold on Ohio Abortion Restriction to Last at Least Two More Weeks

Hamilton County Court of Common Pleas Judge Christian Jenkins (D) this week indicated he will extend his hold on a significant Ohio abortion-restricting law for two additional weeks. 

Jenkins’s decision prolongs the effect of a decision he made last week to obstruct the Heartbeat Act’s implementation, with the initial freeze to last two weeks. The state General Assembly passed and Governor Mike DeWine (R) signed the bill (SB 23) in 2019. The legislation, which prohibits aborting unborn children who have detectable heartbeats, could not take effect until this year after the U.S. Supreme Court overturned the 1973 Roe v. Wade decision that legalized abortion nationwide.
