Victim Who Was Sexually Assaulted by Trans Student Files Lawsuit Against Loudoun County School District

A former female student, who was sexually assaulted by a male student claiming to be transgender, filed a lawsuit Wednesday against Loudoun County Public Schools (LCPS) for allegedly covering up the attack, according to court documents.

The assault was first reported in 2021 by the Daily Wire after the student’s father, Scott Smith, was arrested for disorderly conduct at a board meeting after he demanded that the board admit they covered up his daughter’s attack. Now the student and her parents, identified in the lawsuit as Jane Doe, Jane Roe and John Doe respectively, are suing the district for $30 million for its “indifference to sexual assault” and failure to protect Jane Doe from harm, according to court documents.

Gov. Youngkin Pardons Virginia Dad Who Protested after Daughter’s Sexual Assault by Transgender Student

Virginia Gov. Glenn Youngkin on Sunday pardoned Scott Smith, a father who was convicted for protesting the Loudoun County School Board after his daughter was brutally sexually assaulted at school by a boy with a skirt in the girl’s bathroom.

“Scott Smith is a dedicated parent who’s faced unwarranted charges in his pursuit to protect his daughter,” Youngkin said when issuing his absolute pardon to Smith. “Scott’s commitment to his child despite the immense obstacles is emblematic of the parental empowerment movement that started in Virginia.”

Court Recuses Commonwealth’s Attorney Biberaj in Criminal Case Against Parent Arrested at 2021 Loudoun School Board Meeting

Loudoun County Circuit Court Judge James Plowman recused Commonwealth’s Attorney Buta Biberaj from prosecuting a criminal case against Scott Smith, a parent who faces a disorderly conduct charge after being arrested at a June 2021 Loudoun County School Board meeting. While Plowman disagreed with Smith’s defense’s argument that there was a conflict of interest mandating removal of Biberaj, he granted the motion to recuse her and wrote in an order, “The concerns about the public confidence in the integrity of the prosecution as well as the Defendant’s concerns regarding the impartiality of the Commonwealth’s Attorney are sufficiently grounded.” In May 2021, one of Smith’s children was allegedly assaulted on school property; the school board’s handling of that situation has generated frustration among Republicans and a grand jury investigation. A month later, Smith was arrested at a rowdy school board meeting where officials seemed to deny the existence of assaults in district bathrooms and locker rooms. He faced an obstruction of justice charge and a disorderly conduct charge. Mother of Raped Loudoun County Teen Blasts School District in First Interview Since Incident

In an interview with Daily Mail, the mother of the teenage girl who was raped in a bathroom at Stone Bridge High School in Loudoun County blasted the school district.

“This is not about politics,” said Jessica Smith. “This is about sexual assault and how we need to make changes in our schools in order to protect victims, get them the help they need sooner, and believe them. And don’t allow a perpetrator back into another school.”

Juvenile Court Finds Sufficient Evidence in Loudoun School Assault Case

A juvenile court judge found sufficient evidence to sustain charges of a May sexual assault in a Loudoun County Public Schools (LCPS)  bathroom, allegedly committed by a “gender fluid” student. The judge’s decision in the Monday trial is equivalent to a guilty verdict, The Washington Post reported.

“We are relieved that justice was served today for the Smith’s daughter.  This horrible incident has deeply affected the Smith family, and they are grateful for today’s outcome,” Senator Bill Stanley (R-Franklin) said in a Monday press release. “No one should have to endure what this family has endured, and now their focus is completely upon their daughter’s health and safety as she progresses forward with her life.  She is a very smart and strong young woman, and she is deeply loved by her parents.”
