Arizona’s attorney general Friday gave an update about his lawsuit against the Biden administration seeking to halt the termination of Title 42.
“Title 42 was so important because it’s one of the last tools we have in our toolbox to prevent even further illegal immigration in this country,” Attorney General Mark Brnovich said. “You look at the numbers just in April. We saw a record number of people illegally entering our country because the Biden administration has decriminalized, incentivized people coming here illegally.”
“America is indeed the land of immigrants,” he said. “But we have to have order and [we] can’t cede control of the Southern border to the cartels and we cant have chaos. And that’s why myself and my colleagues were in court fighting to preserve Title 42, because we need to do everything we can to secure our Southern border, because border security is national security.”
Brnovich said that he and the 20 other attorneys general who joined in the lawsuit against the Biden administration are “awaiting a federal judge’s ruling in our Title 42 case.”
He did not say when that ruling would be handed down, but Title 42, which was a measure implemented by former President Donald Trump to turn away illegal aliens at the border during the COVID-19 pandemic, is set to be lifted Monday.
The lawsuit centers around the procedure by which the Biden administration revoked Title 42.
According to the lawsuit, the Biden administration did not provide a public “notice and comment” period, as required by the Administrative Procedure Act.
All executive branch decrees must be federally registered, and the public must be given a chance to provide feedback.
In April, a record 234,000 migrants were encountered by U.S. Customs and Border Protection (CBP).
“Of the 234,088 total encounters, 28 percent involved individuals who had at least one prior encounter in the previous 12 months, compared to an average one-year re-encounter rate of 15 percent for FY 2014-2019,” said CBP.
Seventy-one percent of those who crossed into the United States last month were single adult males.
In 2021, Border Patrol agents encountered more than two million illegal aliens crossing the border.
