Arizona Judge Rules Election Vendor Runbeck Not Subject to Public Records Law, Ignores Precedent Set in Cyber Ninjas Case

Maricopa County Superior Court Judge Bradley Astrowsky issued a ruling Friday dismissing a complaint filed by We the People AZ Alliance (WPAA) that requested video surveillance from Runbeck Election Services. Although another judge ruled previously that the private company Cyber Ninjas was subject to public records requests due to conducting a partial audit for the Arizona Senate of the 2020 election, Astrowsky refused to apply the same reasoning to Runbeck, the vendor that processed all of Maricopa County’s mail-in ballots prior to signature verification.

The judge, appointed by Gov. Jan Brewer in 2012, has served on the bench for a little more than a decade. A court insider familiar with Judge Astrowsky’s decisions told The Arizona Sun Times he is well-known as a moderate in legal circles.

Mohave County Supervisors Vote 3-2 Against Conducting Hand Count in 2024 Election After Arizona AG Threatens Them with Prosecution

In a close 3-2 vote, the Mohave County Supervisors vetoed a move to conduct a hand count during the 2024 election on Monday. State Senator Sonny Borrelli (R-Lake Havasu) told The Arizona Sun Times prior to the vote that there were enough votes to approve it, but after the supervisors received a threat to prosecute them from Democratic Arizona Attorney General Kris Mayes at the last minute, one of the supervisors, Chair Travis Lingenfelter, switched his vote.

Borrelli said Lingenfelter is part of the powerful establishment in the county, with deep family roots in the area. “They all caved to a radical leftist attorney general’s abuse of authority,” he told The Sun Times. “I’m disappointed they didn’t have enough courage to stand up against the tyrannical left. If you don’t go along, we’ll put you in the Gulag.”

The influential National Republican Senatorial Committee (NRSC) released a new advertisement targeting Arizona voters on Monday that labels Representative Ruben Gallego (D-AZ-03) a “deadbeat dad” and Senator Kyrsten Sinema (I-AZ) a “liberal Democrat.” The ad is the latest indication the political action committee will support Lake, should she secure the Republican nomination.

In a 30-second ad, the narrator bemoaned “Rotten Ruben Gallego” for being “a spokesman for a crooked bank that targeting immigrants,” referencing a March report exposing a bank he founded that was meant to cater to illegal immigrants. Federal regulators eventually determined the bank’s founder illegally sold shares.

$33 Million in Federal Funding to Support Tucson Area Water Resources

Funds from the Infrastructure Investment and Jobs Act will be used to for water cleaning resources by developing a new treatment center in Tucson. 

Specifically, the facility would focus on PFAS chemicals, which the United States Environmental Protection Agency describes as “widely used” and “long-lasting,” but could also have negative health consequences when they make their way into water and other consumables. Out of $10 billion targeted toward getting chemicals out of water in the act, $33,520,000 is Tucson bound, according to a news release.

Sinema successfully passed legislation last week that will allow the U.S. Senate to vote to confirm the promotions of more than 300 high ranking military officials at once, which she said is necessary because the Senate would otherwise struggle to handle the volume once Tuberville’s protest ends or is bypassed.

Arizona State University Cancels Rashida Tlaib’s Speech Scheduled for Friday on Campus After Outrage

Arizona State University canceled a speech by controversial Representative Rashida Tlaib (D-MI-12) a day before she was to speak there on Friday. A spokesperson stated that the organizers had not complied with ASU’s policies for events. Tlaib’s speech was titled “Palestine is an American Issue.”

“Organizers of ASU events using facilities must be properly registered with ASU and must meet all university requirements for crowd management, parking, security, and insurance,” the spokesperson said. “In addition, the events must be produced in a way which minimizes disruption to academic and other activities on campus. The event featuring Congresswoman Tlaib was planned and produced by groups not affiliated with ASU and was organized outside of ASU policies and procedures. New Brief Filed in Kari Lake’s Election Challenge Alleges Maricopa County ‘Lied’ About the 2022 Logic and Accuracy Testing and ‘A Plan to Rig the Election’

Kari Lake filed a reply brief in her election case appeal with the Arizona Court of Appeals on Tuesday. It accused Maricopa County of rigging the 2022 election, and said the county admitted wrongdoing in its answering brief. Her appeal is asking to overturn the lower court’s ruling rejecting her Rule 60(b) motion, which asked to consider new evidence that had arisen since the trial. A Rule 60(b) motion asks the court for relief from an entry or judgment, which the trial court refused to grant after her trial.

Drafted by attorney Bryan Blehm and signed also by Lake’s attorney Kurt Olsen, the summary in the introduction stated, “In its Answering Brief, Maricopa makes demonstrably false or misleading arguments to distract the Court from the evidence and admissions showing that Maricopa blatantly violated Arizona election laws, falsely certified it conducted L&A testing on October 11, 2022, and apparently rigged the November 2022 Election to fail on Election Day.”

Poll Shows Kari Lake Has 26-Point Lead Among Arizona Republicans

Polling released on Thursday by an Arizona pollster showed former gubernatorial candidate Kari Lake with a commanding 26-point lead in the race for the Arizona Republican Party (AZGOP) nomination for U.S. Senate.

Conducted between October 25 and October 31, the Noble Predictive Insights (NPI) poll showed Lake has the support of 40 percent of Arizona’s Republican primary voters. Pinal County Sheriff Mark Lamb (R) placed in second place with 14 percent of support.

The university’s SJP chapter plans for Tlaib to headline an event its hosting on Friday.

Former Maricopa County Elections Worker: Many Houses Had Exactly 25 Voters Registered, Other Anomalies

A grassroots activist concerned about election fraud worked for Maricopa County Elections Department in signature verification for five weeks prior to the 2020 election. After she was fired, for what she believed was asking too many questions, she continued to look into anomalies, such as signatures accepted on mail-in ballot affidavits that did not match the voters’ signatures on their voter registrations. The activist, who does not want to be identified for fear of retaliation, canvassed at some of the homes with mismatching signatures after the election looking for votes for Donald Trump to cure, and discovered that many of them — which were generally smallish houses in heavily Democratic areas — had exactly 25 people registered to vote at each one.

Shelby Busch, co-founder of We the People AZ Alliance, which has worked uncovering evidence of wrongdoing in the 2020 and 2022 elections, told The Arizona Sun Times, “Unfortunately, these stories are not isolated occurrences. We received similar reports all across the state of Arizona.” Busch explained how her team found while preparing for Abe Hamadeh’s election lawsuit, “thousands of voters across the state who were disenfranchised from voting, many of whom never even knew their vote didn’t count. This includes people who showed up to vote and a ballot had already been received, people whose voter registrations were altered without their knowledge or consent and registered voters who didn’t even appear in the registration records,” she said.

Phoenix Woman Sentenced After Recruiting Arizonans to Smuggle Illegal Immigrants Using Social Media

A Phoenix woman became the latest Arizonan to be convicted and sentenced to prison for using social media to entice American citizens to participate in human smuggling of illegal immigrants, the Department of Justice (DOJ) revealed on Wednesday.

In a press release, the DOJ revealed Destiney Rae Montoya, a 22-year-old, was sentenced to 12 months and one day in prison by United States District Judge Raner Collins. The prosecutors explained that Montoya’s sentence was enhanced due to her status as the “coordinator” of the human smuggling operation.

Former President Donald Trump continues to lead President Joe Biden in Arizona, according to a new poll released by Arizona pollster Noble Predictive Insights on Tuesday.

Conducted between October 25 and October 31, the poll found Trump leads Biden by 8 percentage points. 46 percent of Arizona voters support Trump, while 38 percent support Biden, and 16 percent told pollsters they were unsure. Trump’s lead was well outside the margin of error, which pollsters reported to be 3.1 percent.

State Bar of Arizona Finds Probable Cause in Investigation of Kari Lake’s Attorney, He Expects to Be Disbarred

The State Bar of Arizona is pursuing charges against Kari Lake’s attorney, Bryan Blehm, not merely investigating complaints filed by others. More than 775,000 people illegally crossed the border into Arizona in fiscal 2023, according to official U.S. Customs and Border Protection data and preliminary gotaway data.

Frosty Taylor, founder and editor of Arizona’s GOP tipsheet known as Republican Briefs, died in early November at age 86. The retired journalist dutifully updated the site, referred to as “Briefs” by insiders, almost every morning, even on weekends, up until August. John Strasser, who assisted her with the technical aspects of the site, took over for her in August, and posted a remembrance page that included statements from Republican activists who knew her well.

Abe Hamadeh and AZ Voters Rights File Lawsuit Against Maricopa County Demanding Decertification of 2022 Election in Attorney General’s Race

Abe Hamadeh and AZ Voters Rights filed a Complaint in Special Action against Maricopa County this week demanding that the court issue a writ of mandamus ordering the county to decertify the Maricopa County and Arizona canvass for the 2022 General Election race for attorney general. Hamadeh has been challenging the outcome of his loss in that race in court, uncovering evidence during the litigation of votes that were not counted, decreasing his loss to only 280 votes. The trial court judge refused to give him a new trial based on the newfound evidence, which he has appealed.

The complaint, which was drafted by attorney Ryan Heath of The Gavel Project, argued that votes “were not counted due to various wrongful acts by Maricopa County officials — which disproportionately impacted Election Day voters, the majority of whom were Republicans and conservative leaning independent voters.”

Grassroots conservative activist Merissa Hamilton reported Tuesday evening that dozens of voters said they were told by the Maricopa County Recorder’s office that the polls closed at 7 p.m. However, eight polling locations closed at 4:30 p.m., which is “at least 17 percent” of the county’s locations, according to Hamilton who denounced it as “complete voter disenfranchisement!” Since Republicans are far more likely to vote in person on Election Day than Democrats, it disproportionately affected them.

Arizona Election Fraud Deniers Hold Event Discussing Election Reform, Andrew Yang Warns of Arizona Ushering in a ‘Dark, Authoritarian Government’

A group of leading election fraud deniers spoke at an event in downtown Phoenix put on by the civic organization Arizona Talks. The forum was moderated by Steve Goldstein, a longtime PBS host who recently moved on to join Save Democracy AZ, which is pushing open primaries. The panelists consisted of failed Democratic presidential candidate Andrew Yang, Maricopa County Recorder Stephen Richer, Secretary of State Adrian Fontes, and Jackie Salit, president of Independent Voting.

Goldstein said he supports rank-choice voting. He said since the Arizona Legislature isn’t getting the reforms passed that he wants, he recommends a version of ranked-choice voting to select legislators and members of Congress since he said their seats are gerrymandered — that picks the top two for those offices. He complained that members of the two parties no longer cross the aisle to vote with the other side, implying that the Republicans in the legislature aren’t compromising as much as they used to. The 2023 legislature is one of the most conservative in recent years, with several brand-new legislators scoring at the top of conservative ratings.

Four Salt Lake County residents face accusations of participating in the purchase of or attempted purchase of many firearms in Utah and attempting to supplying them to Mexico.

Jose Manuel Barbosa Torres, 36, of West Valley City, Utah; Armando Figueroa Jr., 20, of Magna, Utah; Cecilio Luis Arriaga, 27, of West Valley City; and Iliana Dennis, 20, of West Valley City, were charged in a sealed indictment last month, according to the U.S. Attorney’s Office for the District of Utah.

The nationally renowned large law firm Boies Schiller Flexner announced late last month that it had hired Former Attorney General Mark Brnovich as a partner. The disbarment trial of former President Donald Trump’s previous attorney and constitutional legal scholar, John Eastman, wrapped up on Friday, the 33rd day. Arizona Gov. Katie Hobbs is allocating $2.3 million in funds from the American Rescue Plan Act in order to support state elections ahead of 2024.

Democratic Arizona Rep. Ruben Gallego’s 2024 Senate bid spent thousands of campaign cash on luxury travel, private security and fancy restaurants during the year’s third fundraising quarter, according to financial records.

Gallego brought in $3.1 million and spent $1.9 million between July 1 and Sept. 30, entering the year’s final fundraising period with $5 million in the bank, according to the Federal Election Commission (FEC). His Senate campaign dropped over $3,000 on a luxury resort in Puerto Rico, $2,700 on private security, nearly $2,000 on fine dining in Washington, D.C., and thousands more on related expenses, the disbursements show.

The poll allegedly shows Gallego in first place with the support of 41 percent of Arizona voters and Lake in second place with 37 percent. Sinema finished in a distant third place, with the support of just 17 percent of Arizonans.

The Arizona branch of the Council on American-Islamic Relations (CAIR) has prepared form letters to help Arab- and Muslim-Americans shut down expressions of support for Israel from their colleagues at workplaces and schools.

“Your team, here at CAIR-AZ, has prepared templatized documents to advocate for you and your loved ones at work and school. Your voice is powerful. Use these letters to keep that power in your hands. Please reach out to CAIR-AZ if you feel you have been discriminated against,” said Azza Abuseif, executive director of the Mesa-based chapter.

Arizona Police Arrest Man for Alleged Terrorist Threats Against School Buses, Hospitals

Local and federal police announced the arrest of Amir Safavi Farokhi in Tucson on Monday, and revealed Farokhi allegedly made violent threats against two Tucson hospitals, school buses in Arizona and Indiana, and a female employee of the Bloomington, Indiana Police Department.

The Department of Justice (DOJ) claimed Farokhi made phone calls from Tucson threatening to place pipe bombs on school buses in Indiana, and apparently while speaking to the Bloomington Police Department, threatened to “rape and murder a female employee,” specifically claiming he planned to “wait outside for her at the end of her shift.”

U.S. Department of Homeland Security Secretary Alejandro Mayorkas this week admitted at a congressional hearing that 600,000 illegal “gotaways” crossed the border in 2023.

More than 3.2 million people illegally entered the U.S. in fiscal 2023 (ending September 30), the most in recorded U.S. history, according to new data from U.S. Customs and Border Protection.

Senator Sinema Calls Herself Arizona’s ‘Most Liberal Legislator’ in Newly Resurfaced Audio

Senator Kyrsten Sinema (I-AZ) declared herself to be “the most liberal legislator in the State of Arizona” in a 2006 radio interview that was shared by Kari Lake’s campaign for Senate on Tuesday.

The newly resurfaced video was recording during Sinema’s appearance on “The Ed Schultz Show” in February, 2006. Sinema, who was a state legislator at the time, declared herself to be the “most liberal” of her colleagues after Schultz asked about her political identity.

Apparently bowing to public pressure, the Sheraton Mesa in Wrigleyville West has canceled the controversial Council on American-Islamic Relations (CAIR) banquet featuring U.S. Representative Rashida Tlaib (D-MI-12).

“Thank you everyone! I am sure there were multiple groups working at this, but I believe we all contributed to this success,” celebrated the organizer of the change.org petition calling on the hotel to cancel the event, scheduled for Nov.18.

Trump’s Former Attorney John Eastman Foils California Bar Association During Disbarment Trial Cross Examination

The disbarment trial of Donald Trump’s former attorney and constitutional legal scholar, John Eastman, began its final week Monday, as the renowned former law clerk for Supreme Court Justice Clarence Thomas handled hours of cross-examination from State Bar of California attorney Duncan Carling. The California Bar is attempting to disbar Eastman over advice he gave Trump’s legal team regarding former Vice President Mike Pence accepting electoral slates from states suspected of election fraud in the 2020 election.

Carling asked Eastman about his belief that tens of thousands of mail-in ballots were returned in the 2020 Pennsylvania election before the date they were mailed out and wanted to know how Eastman figured out what the mailed-out date was. Eastman, who is prohibited from looking at any documents while testifying unless placed on the screen for the court, responded, “Footnote 1 of your exhibit 132.”
