On Thursday, government lawyers with the Department of Justice (DOJ) declared that former President Donald J. Trump can face civil lawsuits over the peaceful protests that took place at the U.S. Capitol on January 6th, 2021.

The New York Post reports that the attorneys from the DOJ’s Civil Rights Division made this statement in a filing with a D.C. appeals court, claiming that President Trump cannot use legal immunity to shield himself from the lawsuits that have already been filed against him by two Capitol Police officers and 11 Democratic members of the House of Representatives. The determination by the DOJ would also leave him susceptible to further lawsuits of a similar nature.

Trump claims in his suit that CNN defamed him by repeatedly likening him to Hitler and, in particular, by claiming that his complaints about the integrity of the 2020 election are nothing but a “Big Lie,” such as was used by Hitler to win and maintain power. For its part, CNN claimed in a motion for dismissal filed over the holidays that, even if it said everything Trump alleges, he still has no case. According to CNN, its comparisons of Trump to Hitler were mere “opinion” and “rhetorical hyperbole,” not the kind of factually false derogatory claims for which one can sue for defamation.

Former President Donald Trump is the top choice for the 2024 Republican presidential primary, with Florida Gov. Ron DeSantis coming in as the runner-up, according to a new poll.

The Harvard CAPS-Harris Poll released Friday found that 48 percent of GOP voters said they would support Trump if the primary were held today, while 25 percent said they would vote for DeSantis. If Trump does not run in 2024, 48 percent of GOP voters said they would support DeSantis, with former Vice President Mike Pence as the runner-up with 15 percent support.

Commentary: The Real Trump Card in 2024

After a disappointing outcome for the U.S. Congressional midterm elections – Democrats will retain the U.S. Senate  without any net loss of seats, and Republicans poised to retake the U.S. House by a slim majority – political attention is already shifting to the race for 2024 and the White House against President Joe Biden, and to whether former President Donald Trump might run again for the nation’s highest office.

Midterms usually favor the opposition party, with a 90 percent likelihood of picking up seats in the U.S. House from 1906 to 2018, which did happen. The question now is how many seats and if it was definitively enough to win the race. As of this writing, Republicans have 212 seats to Democrats’ 205 seats in races that have been called, and Republicans have leads in nine races not yet called, just barely enough to get a majority.
