First son Hunter Biden on Wednesday asked the federal judge presiding over his criminal case in Delaware to approve subpoenas of former President Donald Trump and his former top Justice Department officials as he argues that his investigation was the result of “incessant, improper, and partisan pressure” from the former president and his allies. 

The court filing asked U.S. District Judge Maryellen Noreika, a Trump appointee, to subpoena the former president, former Attorney General Bill Barr, former acting Deputy Attorney General Richard Donoghue and former acting Attorney General Jeffrey Rosen, according to NBC News.

President Joe Biden is trailing former President Donald Trump in four key swing states for a potential 2024 head-to-head rematch, according to a Thursday poll.

Biden would lose to Trump in Georgia, Pennsylvania, Nevada and Arizona by anywhere from 2 to 8 points among likely voters, and is tied in Wisconsin and narrowly leading in Michigan, according to an Emerson College survey. The poll comes after a series of other surveys suggest similar margins where the former president is beating Biden in crucial battleground states, most of which Trump won in 2016 but lost in 2020.

Minnesota Supreme Court Dismisses Lawsuit Seeking to Remove Trump from 2024 Primary Ballot

The Minnesota Supreme Court dismissed a lawsuit Wednesday seeking to remove former President Donald Trump from the 2024 presidential primary ballot in the state.

The court found that state law permits parties to do as they wish in the primary election, writing that “winning the presidential nomination primary does not place the person on the general election ballot as a candidate for President of the United States.” However, the court did not address the question at the center of the case: whether Trump is eligible for office under Section 3 of the 14th Amendment, which disqualifies public officials who took an oath to the Constitution and then “engaged in insurrection” from holding office.

Commentary: Trump’s Popularity Is Not Inexplicable

In a routine that has become familiar of late, CNN’s Jim Acosta reports the ongoing ascendancy of Donald Trump in the polls with a mixture of dismay and disbelief. With these emotions front and center on his November 5 cable show, Acosta grimly reported the latest polling on the 2024 presidential candidates, noting that Trump is now ahead of Biden in five out of six crucial swing states. In Nevada, where Trump lost by 2 percentage points in 2020, Trump is now up by 11 points over Biden.

As Acosta proceeded to interview experts in an attempt to make sense out of this, the prevailing message was Biden is too old, and that has voters worried. David Frum, a reliable uniparty stalwart, reassured Acosta that “Trump is only three years younger than Biden,” and that Trump is so weak and elderly that he “can’t even open a jar of pickles.” The men then proceeded to applaud Biden as physically hale and hearty, dismissing concerns about his age as unwarranted.

Trump is beating DeSantis 60% to 21% among a crowded Republican primary field in Florida’s primary, according to a University of North Florida Public Opinion Research Lab survey. Several Republican state officials in Florida recently flipped their endorsements from DeSantis to Trump over the weekend, Republican Sen. Rick Scott of Florida threw his support behind the former president and the state party did away with its loyalty pledge, backed by the governor, to support the eventual nominee to participate in its primary.

The TV show 60 Minutes aired a story about the lawfare against Donald Trump’s former attorney and constitutional legal scholar John Eastman on Sunday, which repeated much of the mainstream media’s talking points about his legal advice to Trump regarding the illegal activity in the 2020 election. Host Scott Pelley interviewed both Eastman and former Vice President Mike Pence’s attorney Greg Jacob, who has made a considerable effort distancing himself from his advice in December 2020 stating that it was unclear whether the vice president had substantive authority regarding the acceptance of disputed electoral slates. 

Pelley described Eastman as a “little known law professor” until he represented Trump in 2020, but Eastman is arguably the most preeminent law professor on the right, having clerked for Supreme Court Justice Clarence Thomas, founded the Claremont Institute’s Center for Constitutional Jurisprudence, and served as dean for Chapman University’s Dale E. Fowler School of Law.

Federal Appeals Court Temporarily Pauses Trump Gag Order

A federal appeals court temporarily paused the gag order against former President Donald Trump in his 2020 election case on Friday.

The Court of Appeals for the District of Columbia temporarily paused the order issued Oct. 17 by District Judge Tanya Chutkan to allow time to consider Trump’s request for a longer freeze on its enforcement pending appeal. The court ordered Trump’s appeal to be expedited, requesting briefing from Trump’s legal team by Nov. 8 and scheduling oral arguments for Nov. 20.

Judge Finds Trump’s Former Attorney John Eastman ‘Culpable’ in His Bar Disciplinary Trial as He Refuses to Express Remorse

The disbarment trial of former President Donald Trump’s former attorney and constitutional legal scholar, John Eastman, finished its 32nd day on Thursday. California Bar Disciplinary Judge Yvette Roland could not get the former law clerk for Supreme Court Justice Clarence Thomas to express remorse for his actions, and she pronounced him “culpable.”

The proceedings began with more cross-examination and redirect of Eastman on the witness stand. The California Bar’s attorney, Duncan Carling, attempted to get Eastman to admit that he was inciting violence by giving a speech at January 6. He asked Eastman if his speech risked causing violence. Eastman responded and said there was a risk to the republic if the election was illegal and allowed to stand.

Judge Expands Gag Order to Include Trump’s Attorneys in His New York Case

The New York judge overseeing former President Donald Trump’s civil fraud trial expanded his gag order Friday to include Trump’s attorneys.

Judge Arthur Engoron issued an order Friday barring Trump’s attorneys from making “any public comments about court staff” referring to “confidential communications” between him and his staff. Engoron said the attorneys on Trump’s legal team — Christopher Kise, Clifford Robert and Alina Habba — have made “on the record, repeated, inappropriate remarks” about his law clerk “falsely accusing her of bias against them and of improperly influencing the ongoing bench trial.”

At one point during a contentious hearing in her Florida courtroom on Wednesday afternoon, U.S. District Court Judge Aileen Cannon confronted the Department of Justice about its concurrent federal indictments against Donald Trump.

Cannon pressed Jay Bratt, the chief prosecutor on Special Counsel Jack Smith’s classified documents case, to name another instance when the government brought charges against the same defendant on two different matters within a few months of each other. (Smith indicted the former president last June in the southern district of Florida for unlawfully keeping national defense information at Mar-a-Lago and obstruction of justice. Seven weeks later, Smith charged Trump in the District of Columbia with four counts related to the events of January 6.)

The disbarment trial of Donald Trump’s former attorney and constitutional legal scholar, John Eastman, began its final week Monday, as the renowned former law clerk for Supreme Court Justice Clarence Thomas handled hours of cross-examination from State Bar of California attorney Duncan Carling. The California Bar is attempting to disbar Eastman over advice he gave Trump’s legal team regarding former Vice President Mike Pence accepting electoral slates from states suspected of election fraud in the 2020 election.

Carling asked Eastman about his belief that tens of thousands of mail-in ballots were returned in the 2020 Pennsylvania election before the date they were mailed out and wanted to know how Eastman figured out what the mailed-out date was. Eastman, who is prohibited from looking at any documents while testifying unless placed on the screen for the court, responded, “Footnote 1 of your exhibit 132.”

ACLU Declares Trump Gag Order to Be Unconstitutional

On Wednesday, the far-left American Civil Liberties Union (ACLU) made a surprising statement condemning a federal judge’s attempted gag order on former President Donald Trump.

As Politico reports, the ACLU’s statement came as a shock to many who support the group, as it had been one of Trump’s primary enemies during his presidency, frequently suing his administration to block many of his policies. The reason you have not heard of a gag order on par with the one imposed on former President Trump is that it is highly unusual. Normally, in a criminal proceeding, there are no gag orders. To the extent they exist, they typically only bind the lawyers, who are admonished to adhere to the rules of professional conduct. Expert in Disbarment Trial of Trump’s Former Attorney John Eastman Contrasts ‘Unusual’ Vote Spikes for Biden in 2020 Compared to Hillary Clinton’s Election

The disbarment trial of Donald Trump’s former attorney and constitutional legal scholar John Eastman continued on Thursday during its eighth week, featuring testimony from statistician Dr. Stanley Young and two character witnesses. Young, who has been designated as an expert by California Bar Disciplinary Judge Yvette Roland, spent much of the time discussing the election contrast report he co-authored with a team of statistical PhDs, which focused on what he repeatedly characterized as “unusual” differences between the number of votes Joe Biden received in 2020 versus the number of votes Hillary Clinton received in 2016.

Eastman’s attorney Randy Miller began his line of questioning asking Young about the report, which focused primarily on 10 states. Young observed how California stood out in comparison to the other states, with Biden receiving around 800,000 more “unexpected” votes than Clinton, taking into account the growth in population. In two states that decreased in population, there were around 300,000 more unexpected votes for Biden in New York, and Illinois got 75,000, he said. In some states that had population increases, the increases were significantly higher than those increases. Arizona and North Carolina each had 80,000 unexpected votes for Biden, Texas had 200,000, and Georgia over 200,000.

In Disbarment Trial of Trump’s Former Attorney John Eastman, He Discussed How Nixon Exercised Substantive Authority Accepting Electoral Slates

The disbarment trial of Donald Trump’s former attorney and constitutional legal scholar John Eastman is in its eighth week, and expected to continue into a ninth week. On Wednesday, Eastman testified all day, focusing especially on the 1960 election and then-Vice President Richard Nixon’s role deciding which of three electoral slates from Hawaii to accept. 

Eastman said Nixon received three slates of electors from Hawaii, including one that was not certified — the second one from the Democrats. Nixon opened up all three envelopes and chose which one to accept, the third Democratic one that was certified by the governor after the recount. None of the alternate slates of electors in the 2020 election were certified by a state government entity.
