Border Patrol Encounters Another Commercial Vehicle Involved in Human Smuggling Attempt

The federal government will no longer fine illegal aliens who fail to depart from the U.S. and it plans to pursue the cancellation of any currently outstanding debts for people who previously incurred such financial penalties.

“There is no indication that these penalties promoted compliance with noncitizens’ departure obligations,” Department of Homeland Security Secretary Alejandro Mayorkas said in a statement. “We can enforce our immigration laws without resorting to ineffective and unnecessary punitive measures.”

While U.S. Immigration and Customs Enforcement had already stopped issuing such fines as of Jan. 20, 2021 — the day that President Biden was sworn into office — two delegation orders pertaining to the collection of the fines were rescinded on Friday, according to a Department of Homeland Security press release.

Representative Harshbarger on Visit to Border: Crisis Far Worse Than Reported

Representative Diana Harshbarger (R-TN-01) claimed that the border crisis is far worse than what has been reported. Sunday, Harshbarger visited the RGV sector of the southern border. She relayed that the Department of Homeland Security (DHS) is flying illegal immigrants further into the country, without COVID-19 tests or legitimate ID and no clarity of who is footing the bill. She also reported that there are an estimated 15,000 “got aways” in the Rio Grande Valley (RGV) sector alone – illegal immigrants who were observed breaching the border but not apprehended or turned back.

Over 23,000 Illegal Aliens Released into U.S. by DHS in Two Months

Under Joe Biden, the Department of Homeland Security has overseen the release of over 23,400 illegal aliens into the United States since February, according to Breitbart.

These illegals were released after they had already been detained at the border for attempting to cross. Of that 23,400, around 15,600 were released in the month of March alone. This is in addition to the thousands of more illegals who have similarly been released by Immigration and Customs Enforcement (ICE) over the same period, with the exact numbers currently being unavailable.

Illegal Immigrants in Rio Grande Valley Being Released Without Court Date

Border Patrol agents in the Rio Grande Valley Sector of Texas are reportedly releasing illegal immigrants seeking asylum into the U.S. without giving them court dates, Fox News reported Sunday.

Illegal immigrants claiming asylum are not given a Notice to Appear before being released from Customs and Border Protection (CBP) custody, multiple unnamed Border Patrol agents confirmed with Fox News. Since the migrants aren’t given a court date to attend an asylum hearing, the responsibility is on them to schedule one through Immigrations and Customs Enforcement or other legal assistance.

Border Patrol agents were reportedly told to use prosecutorial discretion when determining to skip the paperwork needed to schedule a court date, according to Fox News. Biometrical data is gathered from the migrants before they’re released into the U.S.

House Republicans Kill Bill Requiring More Fair Use of E-Verify by Tennessee Employers

A bill that would create equity amongst Tennessee employers as to the required use of the E-verify system was killed by five Republicans in the House Banking and Consumer Affairs Subcommittee, even as thousands of illegal immigrants surge the southern border.

HB 0801, sponsored by Rep. Bruce Griffey (R-Paris), would require employers in the state with six or more employees to utilize the federal government’s E-verify system in hiring future employees.  Griffey’s bill lowered the threshold from the current law, which required e-verification for employers with 50 or more employees.

ICE Detainees Refuse Coronavirus Tests, Rush Officers and Trash Detention Center

Immigration and Customs Enforcement (ICE) detainees in Massachusetts rushed officers, barricaded themselves inside the facility and caused more than $25,000 worth of damage after being told they would be transferred to a medical wing of the facility and tested for coronavirus, authorities said.

Roughly 10 inmates at an immigration detention center in Dartmouth, Massachusetts reported symptoms of COVID-19 to medical personnel, according to a press release from the Bristol County Sheriff’s Office.

Commentary: Why Doesn’t the Supreme Court Want to Know How Many Illegal Aliens America Has?

by Robert Romano   The Supreme Court unanimously ruled that a citizenship question can be included in a Census under the U.S. Constitution, however a narrower 5 to 4 majority threw out the specific rationale used by the Trump administration for the 2020 Census, remanding the case to lower courts for adjudication. Chief Justice John Roberts, joining the higher court’s liberal justices, stated “We do not hold that the agency decision here was substantively invalid. But agencies must pursue their goals reasonably. Reasoned decisionmaking under the Administrative Procedures Act calls for an explanation for agency action. What was provided here was more of a distraction.” This is the so-called reasoned analysis that is supposed to accompany a regulation under Supreme Court precedent. The Department said it relied on the Department of Justice saying the information was needed to enforce the Voting Rights Act. In this case, however, the court ruled that the Department of Commerce “adopted the Voting Rights Act rationale late in the process” and the “evidence established that the Secretary had made up his mind to reinstate a citizenship question ‘well before’ receiving DOJ’s request, and did so for reasons unknown but unrelated to the VRA.” The court…

ICE Releases List of Murderers And Rapists Protected Under Sanctuary City Policies

Self-Deportations Are Rising Dramatically Under Trump Administration

Illegal immigrants who were granted voluntary departure — also known as “self-deportation” — increased by 50% in 2017, according to information compiled by The Marshall Project. In fiscal year 2018, the number of aliens who asked an immigration court to leave the country on their own accord doubled from the previous fiscal year. Applications in 2018, in fact, reached a seven-year high. The rising number of self-deportations far outpaces the 17 percent growth in overall U.S. immigration cases, indicating that a higher percentage of illegal migrants are opting to leave rather than face government-coerced deportation. There are incentives for illegals who choose to voluntarily leave. Instead of being held in a detention center for an indefinite amount of time or undergo a strenuous courtroom battle, undocumented immigrants can simply return to their home country. Trump Attorney General Barr Cracks Down on Phony Asylum Seekers

According to a Department of Justice decision document released on Tuesday, Barr concluded that illegals who fit certain criteria after applying for asylum will not be eligible for release during the deportation process. Proposed Bill Takes Aim At Sanctuary City Sheriffs in North Carolina

Another North Carolina Sheriff says he will not uphold ICE detainers and will release criminal illegal aliens back onto the streets. In response, state lawmakers are taking action to protect the public with a bill the would require law enforcement to cooperate with immigration enforcement officials. “The sheriff’s office will continue to comply with all applicable state and federal laws, however, we do not make or enforce immigration laws; that is not part of our law enforcement duties,” Buncombe County Sheriff Quentin Miller said at a March 19th press conference. Miller is the latest in a line of sheriffs from Durham, Wake and Mecklenburg counties who are refusing to contact ICE or honor ICE detainers on illegal aliens they have in custody. ICE spokesman Bryan Cox responded to Miller’s remarks, telling the Asheville Citizen-Times that “as a direct result of this policy, persons in Asheville will see an increased presence of ICE.” North Carolina’s top law enforcement official, Attorney General Josh Stein, has made similar moves. Shelby County Official: New State Law on Illegal Aliens Does Not Apply to Us

Shelby County officials seem to say they won’t cooperate with a new Tennessee law that helps federal officials detain and deport illegal aliens. The state law took effect Jan. 1, according to The Associated Press. The law, The AP went on to say, “threatens local governments with the loss of future state economic and community development money” if they have sanctuary policies. Federal immigration officials have the power to deport illegal aliens arrested on other charges. But some local laws have kept those local law enforcement officers from cooperating with the feds. The new law bans those local policies, according to The AP. “That includes barring local policies that require federal officials to obtain a warrant or show probable cause beforehand,” The AP said. In the wake of the hard fought win by former House of Representatives Republican Ron DeSantis in the Florida governor’s race, legislators in the state House and Senate are inspired to try again to move two bills that would have a chilling effect on the ability of businesses to hire illegal aliens and for local governments to harbor them from federal law enforcement. An immigration restriction group headquartered in Washington, DC, the Federation for Immigration Reform (FAIR), reported the news about the bills to its members on Friday. Although the legislature does not reconvene until March 2019, committees will discuss the bills during January and February. Ninth Circuit Court of Appeals Blocks Trump Effort to Deny Asylum for Illegal Aliens

by Kevin Daley   The 9th U.S. Circuit Court of Appeals upheld a temporary restraining order against a Trump administration policy that denies asylum to illegal aliens. The 2-1 decision is the latest setback the 9th Circuit has rendered to President Donald Trump’s immigration agenda. “Just as we may not, as we are often reminded, ‘legislate from the bench,’ neither may the executive legislate from the oval office,” Judge Jay Bybee wrote for the majority. Former President George W. Bush appointed Bybee to the bench, and the judge has a conservative reputation. Read the 9th Circuit’s full decision here. U.S. District Court Judge Jon Tigar entered an injunction against President Donald Trump’s new asylum rules on Nov. 19. In effect, the reforms withhold asylum from illegal aliens, though foreign nationals who present for inspection at designated ports of entry remain eligible for legal status. Bybee sympathetically notes the rules were meant to address “a staggering increase in asylum applications” between 2008 and 2018. Trump issued the new guidelines as several thousand caravan migrants congregated near the U.S. border in Tijuana, Mexico. Carol Swain Commentary: President Trump’s Ingenious Plan to Get the Supreme Court to Rule on the Constitutionality of Birthright Citizenship

by Dr. Carol M. Swain   On October 30, President Donald Trump announced plans to issue an executive order ending the practice of giving U.S. citizenship to children of illegal aliens. By taking this bold action, the President is poised to make history by forcing the U.S. Supreme Court to issue its first-ever clarification on whether the USA-born children of illegal aliens are entitled to birthright citizenship. Following the President’s lead, Senator Lindsey Graham expressed his support by stating his plans to file legislation addressing the matter. Birthright citizenship comes from the 14th Amendment’s citizenship clause, which states, “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” Although some scholars argue it would take a constitutional amendment to end the practice, others point to statutory language and the text of the 14th Amendment to argue that Congress has the authority to address the matter. Congress’s authority, they argue, is found in the language that implies anyone not subject to the jurisdiction of the United States is excluded from automatic citizenship. The United States Constitution does contain a few references relative to immigration and naturalization as well as to persons seeking to enter the United States in contravention of its laws — whether violently or non-violently and whether singly or in the form of a human tsunami. In its Article I, Section 8, Clause 4, the Constitution specifically grants Congress the power “To establish a uniform Rule of Naturalization….” By expressly allocating this capacity to Congress, the Constitution seeks to prevent the confusion which would inevitably result if an individual state could itself bestow U.S. citizenship upon a person not born within the boundaries of that — or any other — state. Construing Clause 4, the United States Supreme Court, in the 1892 case of Boyd v. Nebraska ex rel. Thayer, defined “naturalization” as “…the act of adopting a foreigner, and clothing him with the privileges of a native [U.S.] citizen.” In Clause 11 of that same Article I, Section 8, the Constitution authorizes Congress “To declare War…and make Rules concerning Captures on Land and Water….” Interpreting Clause 11, the High Court ruled in the 1795 case of Penhallow v. Inevitably, the diners would get thirsty and buy expensive drinks—thus was born the expression, “there’s no such thing as a free lunch.” Despite its humble origins, the phrase captures a deep and omnipresent truth: everything has a price, an opportunity cost, a trade-off. This is as true of lunches as it is of America’s immigration policy. Although The Economist‘s propaganda-artists claim otherwise, mass immigration does not enrich all Americans. There are obvious winners and losers. The winners are wealthy Americans and the immigrants themselves; the losers are everyone else, especially the working class, Millennials, and black Americans. Black Americans are an interesting demographic. On the one hand, black Americans vote for Democrats by obsequious margins—often in excess of 90 percent. And yet black Americans are hurt most by the Democrats’ immigration policy. MIT Study: The Number Of Illegal Immigrants Could Be Double Previous Estimates

by Will Racke   The true number of illegal immigrants living in the U.S. — long a subject of intense debate — could be twice as high as commonly accepted figures, according to a study by a Massachusetts Institute of Technology researcher. The study published Friday by Mohammad Fazel-Zarandi, a senior lecturer at MIT’s Sloan School of Management, estimates there are about 22.1 million illegal immigrants in the U.S. today. Most frequently cited estimates put the number between 11 and 12 million. Such a wide discrepancy is explained by deficiencies in the methods researchers have used to arrive at previous estimates, according to Fazel-Zarandi. In the past, researchers typically extrapolated the total number of illegal immigrants from population surveys and legal immigration records. Fazel-Zarandi and his colleagues used mathematical modeling based on “operational data” — border apprehensions, deportations, visa overstays and demographic data — to arrive at their estimate. Commentary: Yes, Aliens, Including Illegal Aliens, Vote in Our Elections

by CHQ Staff   Back in February of 2017 Time Magazine’s Wendy Weiser And Douglas Keith published “The Actually True and Provable Facts About Non-Citizen Voting,” claiming that “Like voter fraud generally, non-citizen voting is incredibly rare. Simply put, we already know that ineligible non-citizens do not vote in American elections — including the 2016 election — except at negligible rates.” They based their analysis on state prosecutions of vote fraud, but what they failed to account for was the fact that few states, even those run by Republicans, conduct the kind of investigations necessary to uncover vote Illegal votingfraud, and even fewer elected officials want to risk the charges of racism and vote suppression typically hurled at any official conducting such an investigation. Indeed, during the Obama years the US Department of Justice was actively working on the other side to discourage and impede such investigations. Liberal federal judges also joined in to strike down state voter ID laws and force consent decrees upon the Republican Party and elected officials who might be inclined to strict enforcement of voter registration and election laws.
