Texas National Guard Says It Apprehended over 2,600 Illegal Migrants at the Border in One Week

Rep. Boebert Introduces Legislation to Ban Federal Settlement Payments to Illegal Migrants

Ohio Joins Lawsuit Fighting Illegal Immigration

Ohio has joined a federal lawsuit challenging the Biden administration’s new federal immigration policy, which Ohio Attorney General Dave Yost said stops nearly all deportations and handcuffs U.S. immigration officers.

Yost and attorneys general in Arizona and Montana want to stop the U.S. Department of Homeland Security’s Guidelines for the Enforcement of Civil Immigration Law, which is scheduled to take effect Nov. 29. The lawsuit called the guidelines irrational and said they likely will increase a border crisis.

House Democrats Censure Arizona Rep. Gosar over Tweeting Cartoon Parody, Remove Him from Committee Posts

The House of Representatives narrowly voted 223-207 to censure Rep. Paul Gosar (R-04-AZ) and remove him from his committee posts for tweeting an animated video showing his head on the body of an anime character stabbing Rep. Alexandria Ocasio-Cortez (D-14-NY) and lunging with a knife at President Joe Biden. Twitter did not take the video down, merely labeling it “hateful content” and stating that it was in the public’s interest for it to remain.

House Minority Leader Kevin McCarthy (R-23-CA) denounced the action before the vote. “It’s an old definition of abuse of power: rules for thee, but not for me. That’s exactly what’s happening here today,” he said. “House Democrats are preparing once again to break another precedent of the United States House of Representatives.”

Commentary: Illegal Immigrants Would Get $10.5 Billion From Reconciliation Bill

The budget reconciliation package pushed by Democrats creates a new expanded child tax credit (CTC) that would pay illegal immigrants some $10.5 billion next year. All immigrants with children are eligible, regardless of how they got here and whether their children are U.S.-born. This includes the roughly 600,000 unaccompanied minors and persons in family units stopped at the border in FY2021 and released into the country pending a hearing. Cash welfare to illegal immigrants is not just costly; it also encourages more illegal immigration. 

Although it is referred to as a “refundable credit,” the new CTC, like the old additional child tax credit (ACTC) it replaces, pays cash to low-income families who do not pay any federal income tax. The new program significantly increases the maximum cash payment from $1,400 per child to $3,600 for children under 6, and to $3,000 for children ages 6 to 17. After 2022, the maximum payment would be $2,000 per child, but advocates hope the much larger payments will be extended. 

In an analysis conducted in October, my colleague Karen Zeigler and I estimated that illegal immigrants with U.S.-born children would receive $8.2 billion from the new CTC. However, we had assumed that the new program, like the old ACTC, would require children claimed as dependents to have Social Security numbers (SSNs).  But reconciliation (page 1452, line 14) would permanently repeal this requirement.

Border Agents Ordered to Cease Deporting Nicaraguans under Public Health Emergency Authority

On Friday, Customs and Border Patrol agents received instructions on a new policy: Effective immediately, the Department of Homeland Security would no longer allow deportations of Nicaraguan illegal aliens under Title 42, a clause within the 1944 Public Health Services Law that “allows the government to prevent the introduction of individuals during certain public health emergencies.”

All Nicaraguans entering the U.S. illegally, with some exceptions related to criminal history, will be released directly into the U.S. as of Friday afternoon, Just The News has learned.

The order to all CBP agents was issued verbally on a conference call. Official orders in writing are expected soon. The Department of Homeland Security has not issued a statement, nor has CBP.

ICE to Send Documents to 78,000 Illegal Migrants Who Were Released into U.S. Without Court Dates

U.S. Immigration and Customs Enforcement officials announced a plan to send court documents to 78,000 illegal migrants who were released into the U.S. after crossing the southern border this year, CBS News reported on Tuesday.

The documents describe court hearings where migrants can make their cases to stay in the country to an immigration judge, according to CBS News. The documents will include notices to appear and other information typically issued during regular processing.

Texas Officials Have Arrested over 8,500 Illegal Migrants Since Gov. Abbott Launched Operation Lone Star

Texas law enforcement officials have made more than 8,520 criminal arrests of illegal migrants since Texas Republican Gov. Greg Abbott launched Operation Lone Star in March, a Texas Department of Public Safety spokesperson told the Daily Caller News Foundation on Wednesday.

Around 1,600 of the arrests were for criminal trespassing and about 6,800 felony charges were filed against illegal migrants from the time Abbott’s directive was issued through Oct. 28, Texas Department of Public Safety (DPS) Press Secretary Ericka Miller told the DCNF.

Report: Biden Considering $450,000 Payments to Illegal Immigrant Families Separated at Border

The Biden administration is considering paying illegal immigrant families who were separated at the border under former President Donald Trump’s policies up to $450,000 per person, The Wall Street Journal reported on Thursday.

The illegal immigrants filed a lawsuit claiming the federal government detention resulted in major psychological trauma, according to the WSJ. Most of the families were made up of one parent and child who could receive around $1 million in payouts, though the amount could vary by family depending on the circumstances.

The American Civil Liberties Union (ACLU) represents some of the families involved in the lawsuit against the Departments of Justice, Homeland Security (DHS) and Health and Human Services, the WSJ reported. Around 940 families filed claims and the number of those who might qualify for the settlement is expected to be lower.

Rep. Andy Biggs (R-05-AZ) and Rep. James Comer (R-01-KY) sent a letter to Secretary of Homeland Security Alejandro Mayorkas demanding answers regarding new “Guidelines for the Enforcement of Civil Immigration Law” that they assert hamper the ability of ICE agents to enforce immigration laws. They warn that the new guidelines will restrict enforcement even more than the interim guidance which was implemented in January, which caused arrests and removals to plummet by more than 60 percent.

Biggs called to remove Mayorkas in a statement accompanying the letter, “These guidelines are an affront to the rule of law and will only further incentivize illegal immigration. Instead of preventing ICE from enforcing the law, the Biden administration should be empowering them to keep our country safe. Moreover, Secretary Mayorkas should be removed from his position of authority immediately for implementing crisis-creating policies.”

Arizona State Rep. Jake Hoffman Asks Attorney General Brnovich for Legal Opinion on Biden Administration’s Failure at the Border

Arizona Rep. Jake Hoffman (R-Queen Creek) sent a letter to Arizona Attorney General Mark Brnovich requesting a legal opinion on whether the Biden administration has failed its obligations at the U.S. border with Mexico. He is concerned there is an “invasion” taking place due to the vast numbers of illegal immigrants entering the country, the increase in crime, and the control the drug cartels have over areas along the border.

He wrote, “In light of the efforts by the new federal administration of President Joe Biden to encourage, rather than discourage, illegal aliens coming to our country, including by crossing the Arizona border illegally, I am writing to ask for your formal legal opinion of whether or not the federal government has failed — intentionally or unintentionally — to uphold its obligations to protect our state from invasion under Article IV, Section 4 of the U.S. Constitution.”

Border Patrol Reports 192,000 Border Encounters in September, Says 26 Percent Immigrants Making Multiple Tries

The United States recorded 192,001 encounters with immigrants last month along the country’s southwest border with Mexico, according to U.S. Customs and Border Protection.

The agency on Friday reported 1.7 million apprehensions along the entire U.S. southern border in fiscal 2021, which ended Sept. 30.

The agency reported 26% percent of the encounters in September involved individuals who had at least one prior encounter in the previous 12 months. Last month’s overall number marked a 9% decrease compared to August.

Over 94,000 Migrants in Southern Texas Released into the U.S. with Notices to Report, Leaked Docs Show

Just over 94,500 migrants who entered the U.S. illegally were encountered by border officials in southern Texas and released into the country with notices to report, according to data obtained by Fox News on Wednesday.

The migrants were encountered in Texas’ Rio Grande Valley and Del Rio sectors since March 20, according to Fox News. Notices to report (NTR) direct migrants to check in with an Immigration and Customs Enforcement (ICE) office within 60 days and are different from notices to appear (NTA), which require migrants to show up at an immigration court, according to the Asylum Seeker Advocacy Project.

Border Patrol Agents Confiscate Counterfeit Vaccine Cards at Checkpoints Across U.S.

Charges Dropped Against Illegal Migrants Who Said They Were Transported to Private Property and Arrested for Trespassing

Criminal charges were dropped against 11 illegal migrants who said they were transported to private property and then arrested for trespassing in Val Verde County, Texas, The Texas Tribune reported on Tuesday.

The migrants told Democratic Val Verde County Attorney David Martinez that they were apprehended, restrained with zip ties, walked around 20 minutes to a fenced-in ranch and arrested by border officials for trespassing, according to The Texas Tribune. The migrants said border officials cut the fence around the private ranch to allow a police dog onto the property after making the migrants scale the 10-foot fence.

Border Officials Arrested Around 9,000 Criminal Migrants in Fiscal Year 2021

Border Patrol officials made nearly 9,700 criminal arrests from October 2020 through August 2021, according to Customs and Border Protection data.

Of the nearly 9,728 arrests, 325 individuals were associated with gang organizations, according to Customs and Border Protection (CBP). Over 100 of those arrested with connections to gangs were affiliated with MS-13, and border officials arrested at least nine individuals associated with the group in August, according to CBP.

Brnovich asked Department of Homeland Security (DHS) Secretary Alejandro Mayorkas for a list of every official and agent who was “given the options of retirement or reassignment” since President Joe Biden took office, according to the letter. Brnovich was concerned that top DHS officials were forced out of their positions just as border officials encountered a record number of migrants illegally entering the U.S. at the southern border.

“At a time when we need them most, DHS seems to be purging qualified leaders who have attempted to uphold the rule of law,” Brnovich said. “These actions only lead to more chaos and further empower the cartels who now control both sides of the border.”

24 Legislators Want Ducey to Declare a State of Emergency on the Border Crisis

A significant group of Arizona Republican legislators is calling upon Gov. Doug Ducey to declare a state of emergency over the crisis on the border between Arizona and Mexico. The 24 senators and representatives sent the letter to Ducey on Tuesday.

Former Arizona Sheriff Arpaio ‘Strongly Considering’ Running for Mayor of Fountain Hills

Nationally renowned former Sheriff Joe Arpaio told The Arizona Sun Times that he is “strongly considering” running for mayor in his town of Fountain Hills, located in the greater Phoenix Valley. He was defeated for reelection as Maricopa County Sheriff in 2016, when billionaire George Soros poured $2 million into the race. Laurene Powell Jobs, the widow of Apple co-founder Steve Jobs, contributed a quarter of a million dollars.

Arpaio said he wants to elevate the profile of mayors in society, just like he elevated the profile of sheriffs by becoming the most well-known sheriff in the country in the modern era. He has lived in Fountain Hills for 21 years, and has ties to the town going back 30 years due to serving as Maricopa County Sheriff and head of the Drug Enforcement Agency for Arizona. One of his goals is to attract a significant business to move to the town. The town of about 25,000 is an affluent, Republican-leaning community.

Number of Detained Illegal Immigrants Declines as ICE Arrests Hardly Any

Arizona Attorney General Brnovich Leads 16 States to Stop Biden’s Lack of Immigration Enforcement Related to Crime

Arizona Attorney General Mark Brnovich led 15 other attorneys general to file an amicus curiae brief on August 30 in a lawsuit requesting to halt the Biden administration’s “Interim Guidance” policy of not enforcing laws against illegal immigration when it comes to crime. The lawsuit was filed against the Biden administration on April 6 by the attorneys general of Texas and Louisiana accusing Biden of endangering Americans by no longer arresting or deporting nearly all illegal immigrants involved in crime. Brnovich and the coalition asked the Fifth Circuit Court of Appeals to deny Biden’s request for a stay of his policy while his administration appeals a trial court’s ruling halting the policy. 

“The Biden Administration continues to intentionally violate federal immigration laws and endanger all Americans,” said Brnovich in a statement. “We continue to see the release of convicted felons, COVID-19 positive migrants, and record levels of dangerous drugs into cities across our country. These reckless policies are illegal, unconscionable and disgraceful. The Biden Administration must be held accountable.”

Border Officials Are So Overwhelmed They’re Struggling to Verify Whether Illegal Migrants Are Adults or Minors

MCALLEN, Texas — Customs and Border Protection agents are so overwhelmed with the number of migrants arriving at the southern border they’re having a hard time verifying whether some illegal migrants are minors or adults, agents told the Daily Caller News Foundation on Tuesday.

Customs and Border Protection (CBP) officials are supposed to conduct extensive interviews with migrants they suspect of lying about their age, a senior agent told the DCNF. The agents spoke to the DCNF on the condition of anonymity since they were not authorized to speak on the matter.

“In the past, our intelligence would interview these subjects until eventually getting them to admit they had falsely claimed to be minors. But now with the sheer volume of people coming in and people that we have to process and move, that part of the equation is just a hindrance and would create a bottleneck,” the senior CBP agent told the DCNF. “In other words, our processing machine has now switched gears to quantity over quality. Sad.”

San Diego Border Patrol Encounters 7,300 Brazilian Nationals, a 2,200 Percent Increase in One Year

Since Oct. 1, 2020, San Diego Sector Border Patrol agents have apprehended more than 7,300 Brazilian nationals, an increase of more than 2,200% from the prior fiscal year. In all of fiscal 2020, 330 Brazilian nationals were apprehended, the sector reports.

Every month since April 2021, San Diego Border Patrol has encountered more than 1,000 Brazilian nationals who enter the U.S. illegally. In fiscal 2020, the sector apprehended six, the agency states.

Over the past 10 months, U.S. Customs and Border Patrol agents have arrested 8,691 known criminals who have entered the U.S. illegally through the southern border. Combined, they have committed 12,685 crimes in the U.S., according to federal data.

Because Border Patrol agents do not have access to criminal records from other countries, they rely on information reported in the National Crime Information Center database. Many individuals arrested by Border Patrol are registered sex offenders who were previously convicted and served time in U.S. prisons. They were released and deported only to reenter the U.S. again illegally this year.

‘It’s Everywhere’: Migrants Say They’re Not Responsible for Spreading COVID-19

MCALLEN, Texas — Several illegal migrants told the Daily Caller News Foundation that they aren’t responsible for spreading COVID-19 in America.

Migrants who illegally crossed into the U.S. near the Hidalgo Point of Entry on Aug. 10 in a group of about 20 people said they weren’t worried about catching COVID-19 at any point in the journey to their final destinations in America.

“Everywhere people are getting infected,” a vaccinated man from Ecuador told the DCNF after illegally entering the U.S. near the same location on Aug. 7. “It’s honestly not that the migrants are bringing the virus. It’s everywhere.”

Migrants Coming to America Illegally Say They’re Coming to the U.S. for a Variety of Reasons

MCALLEN, Texas — Some migrants who spoke to the DCNF said they were motivated to come to the U.S. by the Biden administration, while others cited death threats from “narcos” and disaster in their home countries.

“Suddenly, the situations during the previous years weren’t like this one. This year was much more difficult,” a Honduran migrant named Javier told the DCNF after illegally crossing into the U.S. near the Hidalgo Point of Entry early Tuesday morning.

Javier said increasing “crime and a lot of insecurity” including “extortions and death threats from the cartels” motivated him to leave Honduras. He said it took him a little over a month to reach the U.S.

The request was made by Tania Mattos, who serves as a policy director with the far-left pro-amnesty group Freedom for Immigrants. Mattos was an illegal alien herself before being granted amnesty by the Deferred Action for Childhood Arrivals (DACA) program, and has publicly called for the abolition of ICE.

New federal reporting shows illegal immigration has continued to grow worse as the Biden administration increasingly takes heat for the crisis at the southern border.

U.S. Customs and Border Protection released new immigration data that shows border agents encountered 212,672 undocumented migrants attempting to enter the country illegally in July, the highest number in more than two decades.

“The situation at the border is one of the toughest challenges we face,” Department of Homeland Security Secretary Alejandro Mayorkas said. “It is complicated, changing, and involves vulnerable people at a time of a global pandemic.”

The Biden administration is reportedly flying migrants to Abilene, Texas, before releasing them to board other flights with destinations around the U.S., KTAB News reported Thursday.

Immigration and Customs Enforcement (ICE) has reportedly flown migrants to the Abilene Regional Airport in unmarked planes before loading them onto buses on at least two occasions this month, according to KTAB. Migrants were later recorded disembarking the same buses and boarding flights to several U.S. cities.

Commentary: Biden’s Open Borders Drain America’s Resources

The current surge of migrants at our southern border is the direct result of the Biden administration eliminating the Trump rules that had once tamed the flow. Gone are the “safe third country” agreements that helped migrants apply for asylum in countries through which they had already traveled. Report: Border Officials Encountered 21-Year Record High Number of Migrants in July

Border officials encountered an estimated 210,000 migrants at the southern border in July, the highest monthly total since 2000, the Associated Press reported Tuesday.

Preliminary government data reportedly shows border officials encountered some 19,000 unaccompanied migrant minors, a record high from previous months including just over 18,800 in March, Department of Homeland Security Assistant Secretary for Border and Immigration Policy David Shahoulian said, the AP reported.
