It seems like only yesterday the Left went to war to stop Judge Brett Kavanaugh from ascending to the Supreme Court. Crackpots and charlatans flocked to the call for accusations, no matter how fictional, that might sink his nomination. The Left extracted a compromise from squishy Republicans to give the FBI enough time to frame . . . er, “investigate” Kavanaugh before proceeding to a confirmation vote. The Left is still furious at FBI Director Christopher Wray for failing to gin up a predicate for stopping Kavanaugh’s eventual confirmation.

Even then, it was very clear that the public relations assault had nothing to do with Kavanaugh’s history with the opposite sex. As they tried to weaponize sketchy sexual abuse allegations against Kavanaugh, we learned later that Democrats suppressed allegations of sexual abuse committed by their own leaders and supporters (Andrew Cuomo, Harvey Weinstein, U.S. Represenative John Conyers, former New York Attorney General Eric Schneiderman, and Bill Clinton to name just a few examples). When these leaders were held accountable, it usually followed a long period of cover-ups and denials by their political allies. 

But Democrats didn’t really care about whether Kavanaugh committed sexual assault in the 1980s. It was, everyone knew, all about abortion.

Supreme Court Throws Out Case Where Prosecutors Illegally Excluded African American Jurors

by Kevin Daley   The Supreme Court tossed out capital defendant Curtis Flowers’s death sentence Friday, finding that prosecutors unlawfully rigged his jury by excluding African Americans. Justice Brett Kavanaugh delivered the opinion for a seven-justice majority, which said the prosecution violated the 1986 Batson v. Kentucky decision. Batson provides that peremptory strikes — which allow lawyers to boot prospective jurors for any reason at all — cannot be used to exclude people based on race. “The state’s relentless, determined effort to rid the jury of black individuals strongly suggests that the state wanted to try Flowers before a jury with as few black jurors as possible, and ideally before an all-white jury,” Kavanaugh wrote. “The trial judge was aware of the history. But the judge did not sufficiently account for the history when considering Flowers’ Batson claim.” “In the Dark,” an American Public Media podcast, produced an award-winning series on the Flowers case. A white prosecutor, Doug Evans, has tried Flowers six times in the Mississippi courts for a 1996 quadruple homicide. Two of those cases resulted in a mistrial due to deadlocked juries. Flowers was found guilty in the other three, but appeals courts lifted those convictions because…

Sexual Assault Accusation Against Virginia Lt. Gov. Draws Comparison to Kavanaugh Claims

Justin Fairfax, a Democrat, has drawn comparisons to the uncorroborated allegations against Supreme Court Justice Brett Kavanaugh. Fairfax issued a statement early Monday morning disputing a report by the right-wing blog Big League Politics, which linked Fairfax to an accusation of sexual assault at the 2004 Democratic National Convention. Fairfax said at a press conference Monday that he had a consensual encounter with the woman, but denied that he sexually assaulted her. Fairfax is poised to succeed embattled Gov. Ralph Northam if the Virginia Democrat resigns over a racist photo on his yearbook page that showed a man wearing blackface and another wearing a Klu Klux Klan robe. Northam first admitted to being one of the people in the photo, before backtracking and saying he wore blackface on a different occasion, but not in the photo. The Washington Post reported on Monday that it had been aware of the allegation against Fairfax for over a year, but was unable to corroborate it. Tennessee Democrats’ Favorite Spokesman Mark Brown Calls Gun Owners ‘Biggest Terrorist Organization’

Tennessee Democratic Party spokesman Mark Brown is under fire once again, this time for calling American gun owners the “biggest terrorist organization on the planet.” Fox News reported on Brown’s 2015 Facebook post making that statement. The Fox News report was based on a story by The Washington Free Beacon, which said, “A top spokesman for the Tennessee Democratic Party’s effort to get Phil Bredesen elected U.S. senator has said he views ‘white male’ gun owners as ‘the biggest terrorist organization on the planet.’” Brown is communications director for Tennessee Victory 2018, a project of the state Democratic party that’s been working exclusively on electing Bredesen. The group is hosting Bredesen for a Johnson City meet-and-greet on Thursday afternoon. Bredesen Keeps One Democratic PAC’s Support, While Another That Has Never Supported Him Financially Will Withhold Funds Over Kavanaugh Statement

Democratic U.S. Senate candidate Phil Bredesen will keep the backing of a top liberal political action committee but lost the support of another PAC because of his wishy-washy belated support of Judge Brett Kavanaugh. CNBC on Friday afternoon reported that Majority Forward, a nonprofit group that spends millions to elect Democrats to the Senate, will continue to support Bredesen. “Yes, Phil Bredesen is the only candidate who has an independent record of results for Tennessee families,” Chris Hayden, a spokesman for Majority Forward, told CNBC. The nonprofit’s affiliated super PAC, the Senate Majority PAC, will also move ahead with plans to back Bredesen. Majority Forward has spent just over $1.6 million in support of Bredesen and $4.1 million against his opponent, U.S. Representative Marsha Blackburn (R-TN-07). Earlier Friday, Bredesen, a former Tennessee governor, issued a half-hearted statement of support for Kavanaugh and praise for accuser Dr. Christine Blasey Ford. U.S. Senator Bob Corker (R-TN) said he thinks Judge Brett Kavanaugh will be confirmed. The Hill reported on Corker’s statement Wednesday. Corker said on Tuesday evening that he is confident Senate Republicans will have enough votes to confirm Kavanaugh by “no later than Saturday.” Corker also accused Democrats of having “overplayed their hand” in leveling accusations of sexual misconduct and assault by several women and demanding an FBI investigation. The Senate had previously been scheduled to vote on Kavanaugh’s nomination but the Republican majority on Friday agreed to a demand from some members to delay the vote by one week to give the FBI more time to investigate the accusations. “Cloture may be filed tomorrow … it feels to me like the FBI reports could come in as early as tomorrow, maybe Thursday … my guess is we’re going to vote no later than Saturday,” Corker said in an interview. by George Rasley   As we know from The Lives of the Saints and the Bible, in ancient Rome and Persia those who refused to worship the gods recognized by the pagan elite, such as Christians and Jews, were executed publicly by having wild animals tear them apart before baying crowds in the arena. In more modern, but less enlightened times, those who refused to hew to the scripture dictated by the elite were hanged, drawn and quartered in public; they were dragged to the place of execution through the public streets, drawn-up a gibbet, cut down, their head and genitals cut-off, their heart excised and burnt, and their body divided into four parts. That was the sentence originally passed upon St. Thomas More by Henry VIII, but the king mercifully commuted it to simply chopping off More’s head. The point of this ritualized torture was of course to cow the observers into obeisance and numb potential opponents with fear, but it was also intended to dehumanize the victim to make him and his beliefs less likely to appeal to others and spread. Senate Democrats Inadvertently Admit President Trump Can Order and Conclude FBI Investigations

by Robert Romano   The Senate Judiciary Committee on Sept. 28 advanced to the Senate floor for a vote the nomination of Judge Brett Kavanaugh to the Supreme Court. But, retiring Sen. Jeff Flake (R-Ariz.) did so conditionally, saying he would only support Kavanaugh on the floor if the FBI is ordered by President Donald Trump to conduct another background check on Kavanaugh in a limited period of time no longer than a week. The Committee then issued a statement saying it “will request that the administration instruct the FBI to conduct a supplemental FBI background investigation with respect to the nomination of Judge Brett Kavanaugh to be an Associate Justice on the Supreme Court. The supplemental FBI background investigation would be limited to current credible allegations against the nominee and must be completed no later than one week from today.” And then President Donald Trump ordered the additional background investigation, issuing a statement saying, “I’ve ordered the FBI to conduct a supplemental investigation to update Judge Kavanaugh’s file. Commentary: The Art of the Never-Ending Investigation

They are currently using this strategy in an attempt to delay and destroy Judge Brett Kavanaugh. Unfortunately, some Republicans—namely Senator Jeff Flake—do not understand this strategy and continue playing into Democrats’ hands. Herewith is a brief primer to help confused Republicans like Flake understand how they’re being played and help them grow a spine. Make a damning accusation that is difficult to prove but nearly impossible to disprove. A charge of attempted rape is devastating—even when it is alleged to have occurred nearly four decades ago. It is hard enough to prove a negative, let alone prove one 36 years after the fact. Memories fade and warp and the facts get increasingly difficult to pin down. Few prosecutors would touch a decades-old case and many states (not including Maryland) have statutes of limitations to encourage victims to step forward while memories are still relatively fresh. by Robert Romano   Article II, Section 2 of the Constitution states that “The president shall… nominate, and by and with the advice and consent of the senate, shall appoint… judges of the supreme court…” Those are the simple words that outline the process prescribed by the U.S. Constitution for confirming Supreme Court justices. The President nominates a justice, in the current case Judge Brett Kavanaugh, and the Senate advises and then either consents or not to the nomination. Not the Federal Bureau of Investigation, which is not even in the Constitution. Lindsey Graham of South Carolina, as well as Mike Lee and Orrin Hatch of Utah. All three senators sit on the Senate Judiciary Committee, and their personal information was posted shortly after each questioned Supreme Court nominee Brett Kavanaugh during Thursday’s hearing. “They appear to be targeting Republican members of the committee after they question Judge Kavanaugh,” a Hatch spokesman told The Daily Caller News Foundation. The staffer noted the change revealed Hatch’s home address and that Thursday was the senator’s wife’s birthday. The changes were immediately highlighted by a watchdog account that monitors Wikipedia changes made using IP addresses located in the House. A Lee staffer confirmed the senator’s home address in Utah and personal cell phone number were posted to the public page. The GOP of Paul “throw-granny-off-a-cliff-and-give-her-Social-Security-check-to-the-Koch-Brothers” Ryan has never been popular, and for good reason. This is why Donald Trump, despite having ostensibly low approval ratings, is virtually unstoppable compared to his purported “allies” in Congress. Against this alleged political party with approval ratings somewhere between those of Typhoid Mary and the man who ran over your dog, and with all the instinct to fight of said dead dog, a blue wave should surprise no one. On the surface, therefore, the potential success of the Democratic Party would seem to be a banner day for #TheResistance. Except it won’t be. Indeed, should a blue wave arrive in November, it will be the high water mark of #TheResistance’s influence. President Donald Trump won the election in 2016 due in part to his promise to put mainstream conservative judges on the federal bench. Trump also won Tennessee by more than 26 points. It’s fairly obvious that Tennesseans want the President’s nominees to be confirmed, Garren Shipley, Republican National Committee spokesman, said in a statement Friday. Democratic U.S. Senate candidate Phil Bredesen has said he is “embarrassed” by Democrats’ treatment of Judge Brett Kavanaugh in his Supreme Court confirmation hearings, the Tennessee Star reported last week. He has also been dragging his feet for more than two months in saying whether he would support Kavanaugh. Shipley accused Bredesen of hedging his bets, hoping he can avoid having to take a stand on Kavanaugh’s nomination — following Democrat Senate leader Chuck Schumer’s advice of staying neutral for as long as possible. Shipley pointed to a story by The Star showing Schumer’s Senate Majority PAC has booked more than $2 million in ads in Tennessee, perhaps giving Bredesen a reason to stay quiet. Schumer’s PAC donated $10,000 to Bredesen’s campaign earlier this year. The woman accusing Supreme Court nominee Brett Kavanaugh of sexually assaulting her three decades ago when they were in high school wants to testify next week before a Senate panel, her lawyers told committee aides Thursday. The lawyers said that California psychology professor Christine Blasey Ford “would be prepared to testify next week,” as long as the lawmakers offered “terms that are fair and which ensure her safety,” news outlets reported. Calls for New FBI Probe of Kavanaugh Have No Precedent

Christine Blasey Ford, a professor of clinical psychology at Palo Alto University in California, alleges that Kavanaugh attempted to sexually assault her when the two were teenagers in suburban Maryland in the early 1980s. The Senate Judiciary Committee was scheduled to reconvene Monday to hear from both Ford, 51, and Kavanaugh, 53, a judge on the U.S. Circuit Court of Appeals for the District of Columbia since 2006. But Tuesday night, Ford’s lawyer asked for an FBI investigation into the matter before Ford would talk to the committee. “Dr. Ford’s request is in reverse order,” Michael J.
