Legal Issues May Arise as Tucson Ignores Arizona’s ‘Second Amendment Sanctuary’ Law

The city of Tucson passed a resolution recently declaring that it will defy Arizona’s “Second Amendment Sanctuary” law, which says the state will not comply with federal laws and regulations that violate the Second Amendment. Arizona’s law prohibits the police and sheriffs from enforcing those laws. The state passed the 2nd Amendment Firearm Freedom Act into law in April. 

Tucson City Councilman Steve Kozachik introduced the resolution last month. Democratic Mayor Regina Romero and the City Council unanimously passed the resolution on June 22, which they labeled an emergency.

Tucson Pledges Allegiance to Biden Administration on Gun Regulation, Snubs Arizona’s New Second Amendment Protection Law

Tucson will side with the federal government over state law when it comes to gun regulations, according to its city council’s latest resolution. 

According to the resolution, passed last Tuesday, states don’t have the right to reject federal law. The city council directed the city manager to continue using city personnel and financial resources to carry out any federal actions or programs regulating guns. It also directed the city attorney to engage in litigation concerning Second Amendment sanctuary laws or proclamations.

Bedford Supervisor: No Shutdown Resolution Has Good Intentions but Oversteps Authority

Their presence alone was a protest — Bedford County residents turned out to support a No Shutdown resolution at the Monday Board of Supervisors (BOS) meeting. The amount of people present exceeded the 25 person capacity from Governor Ralph Northam’s executive orders. However, BOS Chairman John Sharp told supporters that the resolution had never been on the agenda, and the BOS decided to not make a last minute change to that agenda. Nevertheless, Sharp expressed support for the ideas behind the resolution.

Court Decision Pending on Norfolk Second Amendment Preservation Ordinance

The Norfolk 2nd Amendment Preservation Coalition is awaiting the court’s decision on whether they will secure an ordinance or a special election for it. The ordinance would restrict gun ownership regulations.
The 2nd Amendment Preservation Coalition went to court after the COVID-19 shutdowns hindered their ability to collect petition signatures to put the ordinance on the ballot.

Chesapeake Passes Second Amendment Sanctuary Resolution

The Chesapeake City Council voted 6-1 with one “present” vote to approve a Second Amendment sanctuary city resolution on Tuesday evening. The council also voted to add a clause to the resolution asking “the Governor of Virginia and the General Assembly to preserve the authority of local governing bodies to make legislative decisions to the best interest of the citizens.”

Tennessee House Votes to Be Second Amendment Sanctuary Amid Nationwide Riots

Tennessee is now one step closer to becoming a Second Amendment sanctuary after the state House of Representatives passed a resolution Monday strengthening legal protections of gun ownership.

Resolution HJR074, drafted in March, requires the state to “[extend] a safe harbor to Virginians and other United States citizens whose constitutional rights are being violated by elected officials.” It also affirms that citizens have a right to maintain arms equivalent “to those of their government’s basic infantry unit.”
