The Supreme Court on Tuesday allowed the Trump administration to continue deporting illegal aliens to third countries while the case proceeds.
The court issued a one-page order without a vote count, permitting the administration to resume the practice, the New York Times reported. Oral arguments are set for December.
The Department of Justice filed an emergency request for a stay with the court last week, following a defeat at the appellate level, which saw a lesser court block the policy. Attorney General Todd Blanche had vowed to take the case to the Supreme Court, asserting that the policy was “an entirely legal and invaluable tool to stem the tide of illegal immigration.”
Under the Trump administration, immigration officials have pursued a policy of deporting illegal aliens whose home countries will not accept them to third countries that will. Among the most prominent of these has been South Sudan.
Currently, the Trump administration is trying to deport Kilmar Abrego Garcia to a third country. Abrego Garcia was deported to El Salvador last year, but was brought back to America and charged with human smuggling. A judge ruled in 2019 that Abrego Garcia could not be deported to El Salvador. The charges stem from a 2022 traffic stop in Tennessee where law enforcement suspected the foreign national of human smuggling, but were instructed by the “Biden-era FBI” to release him.
Countries Abrego Garcia could potentially be sent to include Liberia and Costa Rica.
