Commentary: A Common Sense Strategy for a Safer, Healthier Tennessee

As a longtime law enforcement professional serving and protecting the people of Putnam County, Tennessee, my career has been focused on ensuring the safety and security of our communities. An increasingly critical issue that poses a threat to our public safety is the explosion of unregulated and illicit vaping products that have infiltrated our country and our state.

These vapes, manufactured in unknown factories primarily in China, using unknown materials, and smuggled from China using underground networks, have flooded our market due to the Biden-Harris administration’s failure to enforce its own regulations.

The unregulated illicit vape market in Tennessee not only endangers users but also undermines our legal markets and supports criminal networks that profit from these illegal activities.

Manufacturers and distributors of illicit vapes often operate outside the law, with little regard for consumer safety, making it challenging for law enforcement to ensure public safety effectively.

The challenge we face when we tackle this problem is that banning all vapes will only create more harm than good by fueling the illegal market. In fact, President Trump predicted the influx of illicit Chinese vapes, stating in 2019 that “somebody’s going to open up a shop in China and ship it in with flavors and you don’t know what standard you’re getting.” We also need to keep in mind smokers who are using vapes to try and quit cigarettes. So how do we fix the chaotic market and address the danger that the federal government has created through policy that balances public health and public safety priorities?

The right path is creating a strategy that shines a light on this market, gives retailers and regulators the information they need about authorized products, and empowers law enforcement with a powerful tool to combat bad actors.

Tennessee can achieve this with the implementation of a Nicotine Vapor Products Directory. This tool will primarily protect our communities by curtailing the spread of unregulated, illicit vapes, and fostering an environment where smokers can confidently buy less harmful products than cigarettes.

Implementing a Nicotine Vapor Products Directory would provide law enforcement with the tools needed to identify and eliminate these illicit products from the market. Such a directory would list products authorized or currently under consideration for authorization, bringing much-needed transparency and accountability to the marketplace. This would significantly aid in distinguishing between authorized and illicit products, directly supporting law enforcement efforts to combat the sale and distribution of illicit vapes.

The experience of other states underscores the value of such directories. In Louisiana, for example, the introduction of a vape directory led to a significant reduction in the circulation of illicit products. When the directory was temporarily suspended, illicit vapes surged back into the market. Once reinstated, the directory helped restore legal sales and reduce illegal activities. This approach has proven to be both effective and cost-efficient, addressing public safety concerns without imposing excessive burdens on legal businesses and consumers.

While the benefits of regulated vaping products are recognized, as a law enforcement officer, my focus is squarely on the public safety risks presented by illicit vapes. These products do not only harm individual users but also foster broader criminal activities that threaten the safety and
well-being of all Tennesseans.

For law enforcement, a product directory is crucial. It simplifies the identification of illicit products, enabling officers to act more effectively and focus resources on safeguarding the community. For retailers, it clarifies which products can be legally sold, promoting compliance with the law and building trust among consumers. For the public, it ensures that available products adhere to safety standards, protecting them from the risks associated with illicit vapes.

By championing the adoption of a Nicotine Vapor Products Directory, we have the opportunity to enhance public safety, curb illicit vape distribution, and reinforce the rule of law in Tennessee. Let’s take decisive action to clean up the illicit vaping market, eliminate public safety threats, and demonstrate our commitment to protecting our communities.
