Nashville Court Dismisses Home-Based Business Lawsuit

  Nashville’s Chancery Court of Davidson County this week dismissed a lawsuit that a Grammy-winning producer and a hairstylist filed against the city’s regulations restricting home-based businesses. The Nashville-based free market think tank the Beacon Center of Tennessee assisted these two individuals, Lij Shaw and Pat Raynor. Beacon Vice President of Legal Affairs Vice President Braden Boucek discussed the matter with The Tennessee Star Thursday. “The court granted summary judgment to the city of Nashville, saying it is rational to keep a little old lady from cutting hair in her garage and threatened to seize the property of a home studio in Nashville,” Boucek said. “The clients are disappointed, but we build these things to be won at the appellate court level from the ground up. The judge is a good judge. We like her, but she felt bound by her analysis to rule based on metro imagining what would happen if these people were allowed to have home businesses and she felt obligated to disregard the actual facts, which showed that they would have zero impact on the neighborhood in any way. The runoff election for mayor, metro council and a few council districts, turned out to be a low turnout affair. Mayor-elect John Cooper was the big winner with a clear mandate to lead Nashville with his 40 point victory over incumbent David Briley. Rep. Jay Reedy Issues Statement from State Legislators to Mayor Briley: ‘Nashville Is Subject to the Laws of Tennessee: Sanctuary Policies Are Illegal’

State Representative Jay Reedy (R-Erin), the House sponsor of HB2315, the 2018 legislation that prohibits state and local governmental entities and officials from adopting sanctuary policies, issued a statement Tuesday afternoon on behalf of legislators that addresses Nashville’s continued flouting of both state and federal laws. “Nashville is subject to the laws of the State of Tennessee and the United States of America, and the laws of both are clear: Sanctuary policies that shield illegal aliens are themselves illegal,” the statement said. “The law states clearly that local government entities that do not comply are potentially ‘ineligible to enter into any grant contract with the department of economic and community development,’ the statement continued. On Tuesday morning, Nashville Mayor David Briley, who by all accounts trails At-large Metro Council member John Cooper in the September 12 mayoral runoff election, stepped up the city’s flouting of state and federal laws when he  issued an executive order that, among other things, calls on the Nashville Davidson County delegation of the Tennessee General Assembly to fight to repeal HB2315. David Briley Issues Executive Order Preventing Nashville from Helping ICE

  NASHVILLE — Nashville Mayor David Briley announced at a press conference Tuesday that the city will not assist the U.S. Immigration and Customs Enforcement or U.S. Customs and Border Protection officers, as long as it can legally help it. At the press conference, Briley also took issue with HB 2315, a state law that prohibits state and local governmental entities and officials from adopting sanctuary city policies. “Frankly, HB2315 is un-American. It’s reminiscent of the general warrants that resulted in the American Revolution. HB2315 delegates the power to arrest to unnamed bureaucrats in Washington, D.C., and it is a law that should be rescinded, repealed, and challenged in our state,” Briley said. “Additionally, today I am also calling on the Metro Legal Director to explore any and all legal challenges to HB2315 that would result in it being declared unconstitutional.” Briley said that once the law is overturned “we will take immediate action.” Among those actions: • Unless they are issued with a valid and properly issued warrant, no Metro agency or Metro employee or agent will give ICE or CBP access to a person being detained by or in the custody of that agent or agency.   Maplewood High in Nashville is the only school in the nation with its own Firestone Service Center, and company officials say they had a constructive purpose in mind when they created it. Nashville Minority Students Who Disrupt Class Don’t Get Traditional Punishment

  Traditional methods of punishing public school students who act out in class oppress blacks and Latinos, according to a New York City-based education official who defends a much softer way of teaching them discipline. That person, Kesi Foster, said as much in a scholarly journal in 2015. And that’s the same soft approach members of the Metro Nashville Public School System use for their own minority students. As The Tennessee Star reported this week, Nashville officials use this method, Positive and Safe Schools Advancing Greater Equity, or PASSAGE for short. But, as of Friday, those same Nashville officials had yet to describe precisely how they discipline minority students under this program. Metro Nashville Schools’ spokeswoman Dawn Rutledge had yet to respond to our requests for comment. Members of the Metro Nashville School Board also had yet to respond. Much of the material available online about PASSAGE is long on jargon and short on specifics. But the same scholarly journal Foster wrote for, Voices in Urban Education, seems to give some insight as to how school officials in other cities administer PASSAGE.
