The judge presiding over the case against former President Donald Trump involving allegations surrounding classified documents indefinitely postponed the trial date Tuesday.

United States District Judge Aileen M. Cannon, a Trump appointee, said that setting a date would be “imprudent” before a number of pre-trial motions were addressed in her ruling. Special counsel Jack Smith unsealed a superseding indictment on July 27, 2023, that included charges against Carlos De Oliveira, a maintenance worker at Mar-a-Lago, the Florida estate owned by Trump after the special counsel initially secured a 37-count indictment against Trump and aide Walter Nauta in June 2023.

For the first time, the highest court in the land will publicly debate the untested and unsettled question as to whether a former president is immune from criminal prosecution for his conduct in office. And despite claims by Democrats, the news media, and self-proclaimed “legal experts” to the contrary, the matter is far from clear-cut.

The case arises from Special Counsel Jack Smith’s four-count indictment against Trump related to the events of January 6 and alleged attempts to “overturn” the 2020 election. Trump’s comments on Thursday come after Smith and his team of prosecutors made it clear they think Judge Aileen Cannon’s latest ruling was based on “an unstated and fundamentally flawed legal premise.” Prosecutors objected to Cannon’s order to produce proposed jury instructions under two different legal scenarios. Smith said both legal scenarios were flawed.

Federal Judge Orders January Trial, Cites Report Stating Georgia’s 2020 Election Was Not Secure

Ninth District Court Judge Amy Totenberg on Friday ordered a January 7 trial for a lawsuit against Georgia state officials which claims their administration of the 2020 election was not secure due to the state’s adoption of new ballot imaging devices (BMDs), which it continues to use less than one year before the 2024 election.

Totenberg ordered the January 9 trial for Curling v. Raffensperger, a lawsuit that has been ongoing since 2017, and maintains Georgia’s electronic voting equipment is not secure. Though Georgia modified its election equipment ahead of the 2020 election, a report for the plaintiffs by University of Michigan computer science professor Alex Halderman asserted that the state’s voting equipment, as it is being used, is vulnerable to hacking and manipulation.

Special Counsel Jack Smith’s office’s requested gag order against former President Donald Trump is not quite as “narrowly tailored” as he claimed, legal experts told the Daily Caller News Foundation.

Prosecutors asked U.S. District Judge Tanya Chutkan on Sept. 15 to issue a “narrowly tailored” gag order barring Trump from making public statements that are “disparaging and inflammatory, or intimidating” toward any “party, witness, attorney, court personnel, or potential jurors,” as well as any statements “regarding the identity, testimony, or credibility of prospective witnesses.” The scope and circumstances surrounding the request — which a hearing scheduled for Monday will consider — are far outside what is normal in criminal trials, experts told the DCNF.

Special Counsel Subpoenas Secretary of State Raffensperger in Investigation of Efforts to Block Certifying 2020 Election

Georgia Secretary of State Brad Raffensperger has been subpoenaed by Special Counsel Jack Smith, who is leading the U.S. Department of Justice’s investigation into efforts to interfere with certifying the 2020 election on January 6, 2021, or to interfere with the lawful transfer of power.

The subpoena, obtained by The Washington Post, orders Raffensperger to produce any communications dating June 2020 through January 20, 2021, with former President Donald Trump, his campaign, and allies including some lawyers. Similar subpoenas were sent to officials in other 2020 battleground states, according to The Post.
