Legal commentator and retired attorney Mark Pulliam said a recent Pennsylvania Supreme Court opinion sharply criticizing Philadelphia District Attorney Larry Krasner illustrates the dangers of progressive prosecutors who, he argues, fail to fully enforce the law and undermine the integrity of the criminal justice system.
Speaking during Monday’s edition of The Michael Patrick Leahy Show, Pulliam discussed the court’s decision and argued that prosecutors who decline to aggressively enforce criminal laws can undermine the justice system.
“We’ve talked on this show quite a bit about rogue judges and judicial activism, and your audience may think that’s the only problem in our legal system,” Pulliam said. “It’s not the only problem, and in fact, it’s not even necessarily the most serious problem.”
Pulliam argued that prosecutors play a critical role in ensuring laws are enforced after arrests are made.
“I would say these George Soros-funded prosecutors, district attorneys for the most part, are an absolute wrench in the works of our legal system because we rely on the prosecutor, once they’re elected, to enforce the laws,” he said.
According to Pulliam, some progressive prosecutors have openly campaigned on policies that reduce enforcement of certain crimes.
“If somebody like George Soros with significant resources at his disposal can fund the campaign of somebody to become district attorney who has promised … to be soft on crime and to be generous towards drug users and not enforce any laws against vagrancy, et cetera, you basically have turned these cities into hellholes because they basically are going to not be enforcing laws passed by the legislature,” Pulliam said.
The discussion centered on a recent Pennsylvania Supreme Court ruling involving Krasner’s office and its handling of cases brought under the state’s Post Conviction Relief Act.
Pulliam explained that the law allows convicted criminals to seek review of their convictions and potentially obtain new trials.
“The district attorney is supposed to vigorously oppose it, representing the interests of the public,” Pulliam said.
However, Pulliam said the state’s highest court concluded that Krasner’s office failed to fulfill that role.
“Lo and behold, the Pennsylvania Supreme Court recently reviewing one of these cases that had been brought under the Post Conviction Relief Act, found out that Larry Krasner was taking a dive,” Pulliam said. “That these cases would get filed, and not only would they not oppose it, they would be complicit with the defense lawyers in stipulating to things that weren’t true, conceding things that they shouldn’t have conceded.”
Referencing commentary by legal analyst Jonathan Turley, Pulliam added, “Larry Krasner is something of a bargain for Philadelphia. Not only does he serve as the city’s prosecutor, but he’s also its top public defender.”
Pulliam noted that the Pennsylvania Supreme Court is controlled by Democrats but said the justices were nonetheless highly critical of Krasner’s office.
“The Pennsylvania Supreme Court is controlled by Democrats, but they were furious because this case was not an aberration,” Pulliam said. “In fact, this is symbolic of a pattern that there have been over 100 cases filed before the, under this Post Conviction Relief Act, where Krasner’s office has basically colluded with the defense lawyers.”
According to Pulliam, the court expressed concern that many more cases could follow.
“The concerning thing is, according to the Pennsylvania Supreme Court, there’s 1,000 more cases in the pipeline,” he said.
Pulliam said victims’ rights groups helped bring the issue before the court.
“They brought it to the court’s attention, and they are just all over Krasner, basically accusing him of lying to the court,” Pulliam said.
Asked what consequences Krasner might face, Pulliam suggested political accountability was more likely than professional discipline.
“Ultimately it’s up to the voters of Philadelphia to vote him out,” Pulliam said.
