Tom Pappert, lead reporter at The Tennessee Star, said the prolonged legal battle surrounding Kilmar Abrego Garcia highlights what he described as the lasting impact of judicial appointments made during the Obama and Biden administrations, arguing the case demonstrates how federal judges can shape immigration policy through their rulings.
Pappert previously broke the story for The Star that Abrego Garcia was stopped by the Tennessee Highway Patrol (THP) in 2022 while transporting nine people in a vehicle under circumstances that raised suspicions of human trafficking.
“Now, for those who don’t remember, this is the ‘Maryland man.’ He was deported to El Salvador. They said that he wasn’t deported legally, and it’s been a legal nightmare, I think it is safe to say, ever since,” Pappert said during Monday’s edition of The Michael Patrick Leahy Show.
Pappert explained THP stopped Abrego Garcia after troopers observed him allegedly speeding and swerving. The passengers reportedly lacked identification, seat belts, and luggage.
“At some point, we now know from a DHS-provided document, they began to suspect human trafficking,” Pappert said.
He further noted how troopers contacted the FBI after finding information about Abrego Garcia in a database and were instructed to release him.
“And we now know from court documents the Trump administration, the Department of Justice, has confirmed that it was our reporting at The Tennessee Star that sparked the human smuggling case that was filed against Abrego Garcia last year,” Pappert said.
The human smuggling case was later dismissed by a federal judge, who ruled the prosecution was vindictive. The U.S. Department of Justice (DO) has appealed that decision.
Pappert also discussed the separate litigation surrounding Abrego Garcia’s detention and deportation. The Fourth Circuit Court of Appeals recently agreed to consider whether ICE can re-arrest Abrego Garcia but sent the dispute over whether he can be deported to Liberia back to U.S. District Judge Paula Xinis, an Obama appointee.
“The Fourth District…Court of Appeals came back last week and said that they will consider whether or not ICE can re-arrest Abrego Garcia, but they will not consider whether he can be deported to Liberia. They sent the Liberia question back to Xinis,” Pappert explained.
Pappert said the situation could change depending on the outcome of the detention appeal and pointed to DHS Secretary Markwayne Mullin’s position that Abrego Garcia could be sent to Costa Rica.
“So now, if this Fourth Court of Appeals comes back with a ruling that says ICE can in fact re-arrest him, Xinis may not even get a chance to rule on the Liberia question, because under Mullen, this guy may be on the first DHS ICE flight to Costa Rica,” Pappert said.
However, Pappert stressed that ICE cannot yet re-arrest Abrego Garcia because the Fourth Circuit has not ruled on that question.
“The Fourth Circuit Court of Appeals has said that they will consider that issue. They’re going to weigh it. They’re going to give a ruling,” Pappert said.
He noted the next deadline for motions is expected in September, adding, “So if they give a rapid response, maybe by Christmas.”
Pappert also estimated that the extensive legal proceedings surrounding Abrego Garcia could have generated more than $10 million in legal fees so far.
“When you look at it, these are some of the top law firms in the country,” Pappert said. “And when you look at how many filings each of these cases have had, and I think there’s a total of five different court cases involving Abrego Garcia, some of them will be three, four pages long. So I would estimate, we don’t have hard numbers, you’re talking upward of $10 million just in lawyer bills.”
Reflecting on the length of the legal battle, Pappert said the case has demonstrated the impact of judicial appointments made during previous administrations.
“I think it’s been a learning experience about exactly- … what it means to have eight years of Obama and four years of Biden appointing judge- … after judge,” Pappert said.
