Trump Admin Asks SCOTUS to Stop Order Allowing Transgender People Choose Sex Markers on Passports

The Trump administration asked the Supreme Court on Friday to stop an order allowing transgender and nonbinary people to choose sex markers on passports.

The lower court order lets transgender or nonbinary people request a male, female, or “X” identification marker on their passports, rather than choosing their biological sex, The Associated Press reported.

In January, President Donald Trump signed an executive order that recognizes only two genders: male and female.

“This unhealthy road is paved by an ongoing and purposeful attack against the ordinary and longstanding use and understanding of biological and scientific terms, replacing the immutable biological reality of sex with an internal, fluid, and subjective sense of self unmoored from biological facts,” the executive order says.

In the last couple of years eight states, Kansas, Texas, Florida, Oklahoma, Iowa, Indiana, Montana, and Tennessee have taken steps to restrict transgender people from chaning their state IDs.

As an example, Tennessee passed a law in 2023 preventing transgender people from getting their preferred gender on state IDs.
