Federal Lawsuit Claims Tennessee’s New PBM Law of Violates U.S. Constitution, State Lawmakers ‘Will Be Personally Enriched’

A federal lawsuit claims Tennessee’s new law prohibiting vertical integration between pharmacies and pharmacy benefit managers (PBMs) violates the dormant Commerce Clause of the U.S. Constitution, federal law governing employer-sponsored health plans, rules specific to Medicare Advantage and Medicare Part D plans, and the Constitution’s Takings Clause, which prohibits private property from being taken for public use without compensation.

The lawsuit was filed by CVS and affiliated PBM and insurance companies in the U.S. Court for the Middle District of Tennessee last Thursday, shortly after Governor Bill Lee signed Senate Bill (SB) 2040, the Freedom, Access, and Integrity in Registered Pharmacy (FAIR Rx) Act, beginning the countdown for vertically integrated companies to divest by January 1, 2027, ahead of a complete prohibition that will start in January 2028.

U.S. Attorney Braden Boucek on Monday told The Tennessee Star that prosecutors in the Middle District of Tennessee are evaluating plans to appeal the Friday ruling by Obama-appointed District Court Judge Waverly Crenshaw, who dropped the federal human smuggling case against Kilmar Abrego Garcia, determining the Department of Justice (DOJ) “failed to rebut the presumption of vindictiveness.”

“The undisputed evidence shows that the decision to charge Abrego was made by a career prosecutor based solely on the facts and the substantial evidence that a serious crime had been committed and deserved prosecution,” said Boucek.

Supreme Court Rejects Florida’s Attempt to Sue California and Washington over Immigrant Truck Drivers

CBS News   The Supreme Court on Tuesday rejected Florida’s bid to file a lawsuit against Washington and California for allegedly providing commercial driver’s licenses to truck drivers who are in the U.S. illegally and not proficient in English. Florida sought to sue the two states following a fatal crash on a state highway in August 2025 that occurred when truck driver Harjinder Singh, an Indian national who crossed into the U.S. from Mexico, attempted to make an illegal U-turn. State and federal investigations showed that Singh likely could not read the road signs. He faces criminal charges and has pleaded not guilty. Washington State Loosens Bar Exam Eligibility, Joining Wave of States Sidelining ABA

Washington state will open its bar exam starting in September to graduates of non-ABA-accredited law schools, provided they are already eligible to sit for the exam in at least one other state. The Washington State Bar Association’s Board of Governors approved the change in early May.

The decision makes Washington the fourth jurisdiction in recent months to reduce its dependence on ABA accreditation as a prerequisite for attorney licensing. Earlier this year, the highest courts in Alabama, Florida and Texas – all under Republican leadership – moved to either eliminate the ABA requirement entirely or expand recognition to include additional institutions.

A disappointing study came out in the U.K., polling Britons on what they think about nuclear energy. In general, U.K. voters believe nuclear power is good for the national energy mix but are undecided on whether there should be more of it. The interesting part of the polling comes when results are broken down by gender.

Only 30% of women support the use of nuclear power, compared to 74% of men. Most shocking, 69% of women said they do not believe nuclear has low carbon dioxide emissions, compared to 32% of men.
