Supreme Court Associate Justice Samuel Alito on Monday issued an order pausing a ruling that would restrict access to the abortion drug mifepristone amid an appeal by the manufacturer.
The order keeps the appellate ruling and its block on pause for one week, The Hill reported.
The Fifth Circuit, last week, issued an order temporarily blocking the distribution of the drug via mail, amid ongoing legal battles over statewide abortion bans. Danco Laboratories, the manufacturer, asked the Supreme Court to stay the lower court ruling last week, resulting in Monday’s order.
The case addresses a dispute involving Louisiana, which has a sweeping abortion ban, and a Biden-era federal rule on the drug. The lower court found that Louisiana would likely succeed in its challenge to the rule.
“Today’s ruling is a huge victory for victims and survivors of Biden’s reckless mail-order abortion drug regime,” SBA Pro-Life America President Marjorie Dannenfelser said at the time. “Women and children suffer and state sovereignty is violated every day the FDA allows abortion drugs to flood the mail.”
SBA Pro-Life America also called on FDA Commissioner Marty Makary to be removed from his position, following a report by The Wall Street Journal detailing his “indifference” to abortion drugs.
Dannenfelser said Makary “should be fired immediately.”
“Indifference is completely unacceptable to millions of pro-life voters expecting the administration to act to save lives. Abortions are up, not down after Dobbs, with at least 1.1 million deaths a year. More than 90,000 abortions occur each year just in states that protect babies in the law throughout all nine months of pregnancy – a direct result of Biden’s Covid-era mail-order abortion drug rule, which the Trump administration inexplicably allows to continue,” she said.
